About this file
Exhibit N is a Domestic Products Procurement Act (Buy American) Preference form required by the Missouri Department of Transportation for the Flatliner Planer Attachment procurement. This form mandates that bidders provide information regarding the point of manufacture for each product being bid to determine eligibility for the Buy American preference under Missouri Revised Statutes sections 34.350-34.359. Bidders must certify whether all products are manufactured or produced in the United States, all products are foreign-manufactured and do not qualify for preference, or provide item-by-item certification for mixed sourcing. The contract is for the FL48-PCD Diamond Bits attachment from Keystone Engineering, designated as the single feasible source provider. The contract period extends from the Notice of Contract Award through November 30, 2026, with an 8-week delivery lead time following receipt of order.
The form requires bidders to complete applicable certification tables depending on product sourcing: Table 1 for all U.S.-manufactured products eligible for preference; Table 2 for all foreign-manufactured products ineligible for preference; or Tables 3-6 for item-by-item certification distinguishing between U.S.-manufactured products, foreign-manufactured products without preference eligibility, foreign products covered by U.S. trade treaties or agreements, and foreign products where only one U.S. manufacturer exists. Bidders must provide supporting documentation as required and certify the accuracy of submitted information under penalty of class A misdemeanor for misrepresentation. The form does not specify pricing terms, set-asides, or funding amounts in this exhibit, as it functions solely as a sourcing certification mechanism for the procurement.
