About this file

This is an Exhibit N form from the Missouri Department of Transportation regarding the Domestic Products Procurement Act (Buy American) Preference requirements. The document establishes the framework for bidders to certify the country of manufacture for products being bid on the React 350 Attenuator System contract. The contract period runs from March 19, 2026 through March 18, 2027, with HCI - The Hoosier Company, Inc. identified as the sole regional authorized distributor for the REACT 350 Attenuator System and related repair parts.

Bidders must complete one of six certification tables to document the manufacturing origin of their products. Products manufactured or produced in the United States qualify for the preference, as do certain foreign-manufactured products covered by international trade treaties, laws, agreements, or regulations that afford them equivalent status to U.S.-manufactured products, and foreign-manufactured products for which only one U.S. manufacturer exists. Conversely, foreign-manufactured products without these qualifying conditions are ineligible for the preference. Bidders must provide accurate information regarding the point of manufacture for finished products and are subject to potential requests for supporting documentation. Any misrepresentation in the certification constitutes a Class A misdemeanor under Missouri law, requiring the bidder's signature attesting to the accuracy and compliance of the submitted information.

This information is requested for the finished product only, not for components of the finished product. The bidder may be required to provide supporting documentation indicating proof of compliance.

Qualifying for the Domestic Products Preference:

A product qualifies for the preference if one of the following circumstances exist:

• if manufactured or produced in the U.S.; or

• if only one line of products is manufactured or produced in the U.S.

Non-Domestic Product:

If the product is not manufactured or produced in the U.S. and does not otherwise qualify as domestic, then it will be considered non-domestic and not eligible for the preference.
