About this file

Summary

Exhibit N is a Domestic Products Procurement Act certification form required by the Missouri Department of Transportation for the Herbicide UTV Blends contract opportunity. Bidders must provide detailed information regarding the point of manufacture for each product being offered to determine eligibility for the Buy American preference under Missouri Revised Statutes sections 34.350-34.359. The exhibit requires bidders to certify whether all products are U.S.-manufactured, all products are foreign-manufactured and ineligible for preference, or to provide item-by-item certification for mixed product sourcing. The contract period extends from Notice of Award through April 30, 2027, with two additional one-year renewal option periods available.

Products qualify for the Domestic Products Procurement Act preference if they are manufactured or produced in the U.S., imported into the U.S. under an existing international trade treaty that affords them equivalent status to domestically produced goods, or if only one U.S. manufacturer produces the product line. Bidders must complete the applicable certification tables (Tables 1-6) identifying either blanket U.S. or foreign sourcing, or providing specific item numbers with corresponding manufacture locations and country of origin. For foreign products qualifying under trade treaties or single-source U.S. manufacturer exceptions, bidders must provide the applicable treaty or manufacturer information and supporting documentation. The bidder bears responsibility for certifying the accuracy of all submitted information and acknowledges that misrepresentation constitutes a Class A misdemeanor under Missouri law.
