About this file

This is a Confidential or Proprietary Information Exhibit submitted to the Texas Department of Agriculture (TDA) for the Texas Farm Fresh Strategic Plan contract opportunity. The exhibit serves as a declaration form regarding the treatment of confidential or proprietary information under the Texas Public Information Act (PIA). Respondents must indicate which of three options applies to their proposal submission: that the proposal is exempt from disclosure under the PIA and is clearly marked as containing confidential or proprietary information; that the proposal contains confidential or proprietary information and a separate public information act copy has been submitted; or that the proposal contains no confidential or proprietary information and no separate public information act copy is being submitted. The form requires authorization from the respondent, including printed name, company representation, authorized signature, and date of submission.

The exhibit emphasizes that the TDA is obligated under the PIA to provide notice to third parties if a public information request seeks third-party information. The document cautions that blanket assertions of confidential or proprietary information may result in an adverse ruling from the Office of the Texas Attorney General. Respondents are required to submit this exhibit as part of their proposal response and must clearly mark any confidential or proprietary information with specific language identifying such designations. The document was revised on March 7, 2024.
