About this file
This document is an insurance requirements exhibit prepared by the State of Oregon, Department of Fish and Wildlife, for a vessel charter contract supporting marine research operations near Cape Perpetua Marine Reserve. The contractor must obtain and maintain comprehensive insurance coverage prior to performing any services under the agreement and continue coverage throughout the contract duration and applicable warranty periods. Required coverage includes workers' compensation insurance as mandated by Oregon law, employer's liability insurance with minimum limits of $500,000 per occurrence, and marine protection and indemnity coverage with per-occurrence limits of $1,000,000 for any single claimant and $2,000,000 for any number of claimants. All liability insurance except workers' compensation, professional liability, and network security liability must designate the State of Oregon, its officers, employees, and agents as additional insureds using specific ISO forms for ongoing and completed operations coverage. The contractor must provide certificates of insurance before commencing work and shall waive all rights of subrogation against the agency and state.
If any required insurance operates on a claims-made basis without an extended reporting period of at least 24 months, the contractor must maintain tail coverage or continuous claims-made liability coverage for a minimum of 24 months following contract completion, agency acceptance, contract termination, or expiration of warranty periods. The contractor or its insurer must provide 30 days' written notice before cancellation, material changes, potential exhaustion of aggregate limits, or non-renewal of required coverage. All insurance providers are subject to agency acceptance, and the agency reserves the right to request complete copies of insurance policies, endorsements, and related documentation for verification. Insurance coverage shall be primary and non-contributory with any other insurance or self-insurance, with the contractor responsible for all deductibles and self-insured retention amounts.
