About this file
This is a Justification for an Exception to Fair Opportunity document approving a single-source contract action with Everflence Middle East and Africa, LLC.
The Department of the Navy, Military Sealift Command (MSC) is placing an order under the existing Diesel Engine Support Services Multiple Award Contract (N3220526D1008/1010) with Everflence to complete engine overhaul services for a Port Main PC 4.2 Engine. The justification cites FAR 16.507-6(b)(2)—only one contractor is capable of providing the required services at the necessary quality level—as the basis for the exception to fair opportunity. MSC requires cylinder head installation to maintain engine operability and support critical upcoming mission assignments. Everflence previously overhauled PC 4.2-cylinder heads under a prior decommissioning contract and currently owns these cylinder heads, which are immediately available to meet time-sensitive requirements. MSC lacks funding for procuring new or refurbished cylinder heads and cannot support delays associated with production or delivery of new components. Additionally, using Everflence's already-refurbished cylinder heads provides warranty coverage and is the most cost-effective and time-effective solution. The vessel has experienced engine operational issues related to cylinder heads within the past year, making warranty assurance critical. The contracting officer has determined the anticipated cost is fair and reasonable, with detailed price analysis to be provided in the contract file. No actions are planned to remove barriers to future competition for this requirement.
