Summary of U.S. Coast Guard Justification for Other Than Full and Open Competition

This document is a justification for restricting competition on a federal contract opportunity under FAR 12.102(a), Class Deviation 25-21. The U.S. Coast Guard (USCG) is procuring Original Equipment Manufacturer (OEM) Evolution Trailer parts from Evolution Trailer Technologies, Inc., located at 16301 Domestic Ave., Suite 100, Fort Myers, FL 33912 (UEI: KHP5TG6X1GD9). The estimated total contract value, including options, is below the Simplified Acquisition Procedures (SAP) threshold, with SAP provisions increasing to $1 million on October 1, 2025, under ALCOAST 143/25 for contingency operations supporting the National Emergency at the Southern Border. This is a commercial products acquisition utilizing a One-Time Purchase Order under SAP procedures in accordance with ALCOAST 143/25.

The justification for sole-source procurement centers on the OEM exclusivity requirement, as Evolution Trailer parts are the only authorized components configured to maintain technical requirements of the 29' Response Boat-Small (29' RB-S) asset class. The USCG lacks necessary technical data and design documentation to support a full and open competitive solicitation for non-OEM replacement parts and cannot verify compatibility of alternative solutions with currently installed systems. The OEM declined the USCG's offer to purchase data rights necessary for open competition in an email dated September 9, 2025. Additionally, in communications from September 10, 2025, and an RFI dated April 22, 2026, Evolution Trailer Technologies confirmed intent to bid on future solicitations while maintaining exclusive authorized distributor agreements and refusing support for third-party distributors. The contracting officer's fair and reasonable price determination methods include market research, comparison of proposed prices with previous purchase prices, and comparison to IGCE.
