Evaluation Criteria (Lowest Price Technically Acceptable)
The Government will award multiple baseindefinite delivery, indefinite quantity (IDIQ) contracts resulting from this solicitation to the responsible offerors whose offer conforms to the solicitation and has the lowest evaluated price of all offers meeting or exceeding the acceptability standards for non-cost factors. Any offer that does not conform to the requirements in the solicitation’s base Performance Work Statement (PWS) and individual task PWS will not be found to be technically acceptable, and no more than four (4) base IDIQ contracts will be issued as a result of this solicitation.
1. Technical Acceptability:
The technical acceptability element of the evaluation will be a determination as to whether the proposed product meets the performance characteristics and specifications in the solicitation, as well as the prior experience requirement. The prior experience requirement for this solicitation is evidence that the offeror has completed mechanical engineering patent drafting services, electrical engineering patent drafting services, and chemical engineering patent drafting services under at least three previous USPTO Patents Issued in each area respectively. The prior experience requirement applies to the company itself only, and not individual employees’ experience. The Technical element of the evaluation shall be based solely on information furnished by the vendor. The Government is not responsible for locating or securing any information, which is not identified in the proposal. To ensure sufficient information is available, vendors must furnish as part of their proposal all descriptive material (such as cuts, illustrations, drawings, or other information) necessary for the Government to determine whether the product meets the performance characteristics and specifications of the requirement. If the offeror proposes to modify a product so as to conform to the requirement of this solicitation, the offeror shall include a clear description of such proposed modifications and clearly mark any descriptive materials to show modifications.
Each offer’s technical acceptability will be evaluation in accordance with the rating table below:
Technical Acceptable/Unacceptable Rating Method Adjectival Rating Description Acceptable Proposal meets the requirements of the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation.
2. Past Performance:
Past performance will be evaluated on an acceptable/unacceptable rating basis.
An “Acceptable” rating is defined as the Government having reasonable confidence that the offeror can complete all requirements under the contract and meet stated delivery dates. An “Unacceptable” rating is defined as the Government having minimal confidence that the the offeror can complete all requirements under the contract and meet stated delivery dates. The ratings will be based upon past performance information submitted by the offeror, as well as any other past performance information the Government obtains. The offeror shall submit three records of past performance for each of requirement’s three focus areas—mechanical engineering patent drafting services, electrical engineering patent drafting services, and chemical engineering patent drafting services—from the past five years with their offer. Only offerors rated “Acceptable” will be eligible for award. Award will be made to the lowest price technically acceptable offer out of all offers rated “Acceptable”.
3. Price:
Prices/rates will be evaluated based on the total proposed price/rates and cumulative total price for each sample individual patent application disclosure task. Furthermore, the Government may perform price realism analysis on any offer determined to be so low that it may pose a risk regarding the offeror’s understanding the requirements of the solicitation. Any offer determined to be unrealistically low will not be considered for award.
