About this file

This document is a FAR Part 16 Exception to Fair Opportunity Justification for the U.S. Army Mission and Installation Contracting Command (MICC)-Fort Eustis. The justification supports a delivery order under contract HC108424D0003 with Dell Federal Systems L.P. for Adobe Joint Enterprise License Agreement (JELA) IV Renewal for Headquarters TRADOC (Training and Doctrine Command) G6. The procurement includes multiple Adobe software licenses: 1,266 Creative Cloud Enterprise Full Suite, 4 Dreamweaver, 13 Photoshop, 10 Premiere Professional, 139 Captivate Enterprise, 2 CC Pro Adobe Audition with Firefly, 1 Adobe RoboHelp Office, 5 Adobe Substance 3D, and 2 CC Pro Adobe InDesign with Firefly.

The contract period of performance is from 30 March 2025 to 29 March 2026, using Fiscal Year 2025 Operations and Maintenance, Army (OMA) funds. The justification cites FAR 16.505(a)(4) for restricting consideration to an item peculiar to one manufacturer. The CHESS (Commercial, Hardware, Enterprise Software and Solutions) program is the mandatory ordering vehicle, and Dell Federal Systems is identified as the sole authorized distributor for Adobe software under the JELA IV agreement. The document emphasizes the integrated nature of the Adobe products and the potential security risks of not maintaining the current software ecosystem.
