About this file

This document is a Justification and Approval (J&A) for a limited/sole source contract award under FAR Part 18 Acquisition for portable chemical toilets (PCTs) for emergency disaster response and recovery efforts related to Hurricane Helene.

The J&A indicates that the Army had an immediate need for PCTs due to the impacts of Hurricane Helene, and that Parrish Enterprises Inc., a small business, was able to meet this urgent requirement. No competitive solicitation was issued due to the exception for unusual and compelling urgency. The contract was awarded to Parrish on a same-day basis for a base two-week period with a two-week option. Previous related contracts were held by Portable Services Inc. and Major Contracting Services, Inc. The total value of the new contract award to Parrish was $735,000.

Control No: MICC 2025-1

The portable chemical toilets (PCTs) emergency disaster response and recovery contract is required to obtain essential supplies in the aftermath of Hurricane Helene.

b. This contingency contract was required due to the immediate need for basic sanitation services to be fulfilled by this requirement.

c. The availability of the portable chemical toilets was impacted negatively by Hurricane Helene and the demand for the PCTs increased significantly. A small business was able to meet a similar emergency disaster response and recovery requirement post Hurricane Helene under W911S024P0042 and Parrish Enterprises Inc. (Parrish), a small business, was able to meet this requirement.

d. Alternatives: There are no other reasonable alternatives that will ensure urgent delivery of this critical supply than to award a contingent contract to Parrish. A day prior to knowledge of this requirement, the Government previously sought to add additional PCT support on an existing contract, W9124921D0002; however, the incumbent contractor was at full capacity and was not capable of additional work. Parrish has the necessary equipment available to provide the Army with the required quantity of PCTs within a two-day delivery timeframe. The absence of an immediate disaster response and recovery effort would cause a significant adverse impact to the mission. There is a clear and present need for the Army to obtain additional PCTs during the aftermath of Hurricane Helene, therefore, to forgo services until full and open competition could be provided for is not a viable option.

e. Justification: Approval of this request for other than full and open competition will ensure emergency disaster response and recovery efforts continue in support post Hurricane Helene.

f. Impact: The failure to award this requirement on an emergency basis would response and recovery efforts. Any delay could result in illness to Soldiers, Army civilians, and contracting supporting the effort.

6. Efforts to Obtain Competition: No Request for Information (RFI) nor Request for Proposals (RFP) was posted due to the exception listed in FAR 5.202(a)(2) as this contract was made under the conditions described in 6.302-2 and the Government would have been seriously injured if the agency complied with the time periods specified in 5.203.

a. Effective competition. Competition for this emergency disaster response and recovery contract was not practicable given the urgent delivery timeframe needed.

Additionally, there was insufficient time to include competition as this requirement needed to be a same-day award.

b. Subcontracting competition. Parrish is a small business concern under NAICS

Control No: MICC 2025-1 code 562991, and in accordance with FAR 19.702(b)(1), subcontracting plans are not required from small business concerns.

7. Actions to Increase Competition: As indicated previously in Section 5, Parrish was the only known entity that could realistically provide the PCTs in such a short delivery timeframe. The emergency disaster response and recovery contract to Parrish provided the only viable solution to prevent unacceptable delays that would have caused a significant adverse impact to virtually all Fort Eisenhower missions.

8. Market Research: Market research was conducted for contract W911S025P0002 in accordance with FAR Part 10 and DFARS 210.001 on 1 October 2024. See Market Research Report dated 21 October 2024 located in the contract file.

9. Interested Sources: There are no other known interested sources due to utilizing the authority at FAR 6.302-2, Unusual and Compelling Urgency and FAR 5.202(a)(2) that allowed an exception to posting a request for information or a sources sought notice.
