Task Order GS00Q14OADS417 W9113M18F0012 Integrated Fires Mission Command (IFMC) Project Office
(Source Selection Information – See FAR 2.101 and 3.104-4)
Justification for an Exception To Fair Opportunity Under FAR 16.505(b)(2)(i)(A)
1. Contracting Activity: Department of the Army, Army Contracting Command- Redstone, Space, Missile Defense and Special Programs (ACC-RSA SMD/SP) Directorate, CCAM-CAB-C, Redstone Arsenal, Alabama 35898-5280.
2. Description of Action:
The Integrated Fires Mission Command (IFMC) Project Office (PO), Program Executive Office Missiles and Space (PEO M&S), requests approval to execute a contract modification increasing the current task order (TO) ceiling dollar amount by $60,809,498 for TO GS00Q14OADS417 W9113M18F0012 on a cost-plus-fixed-fee (CPFF) basis with Intrepid, L.L.C. (Intrepid), 990 Explorer Blvd. NW, Huntsville, AL 35806-2839, Commercial and Government Entity (CAGE) Code 1VDA4. In support of the IFMC PO, TO GS00Q14OADS417 W9113M18F0012 provides invaluable system engineering and technical assistance (SETA) support services to include program management/operations, system engineering, test and evaluation, user assessments, and logistics. Approval of this sole-source modification will provide Intrepid with the funding necessary to continue to support the IFMC PO. The IFMC PO requests approval of this action no later than the end of the 2nd Quarter FY 2022 in order to ensure continued support of its mission. Research, Development, Test and Evaluation;
Other Procurement, Army; and Operations and Maintenance, Army funds will be used.
The ACC-RSA Principal Assistant Responsible for Contracting approved an acquisition plan in accordance with Defense Federal Acquisition Regulations System (DFARS) 207.103(d)(i)(B) on 06 June 2017 for the IFMC PO TO. TO GS00Q14OADS417 W9113M18F0012 was solicited as a FAR Subpart 16.5 competitive acquisition under the General Services Administration One Acquisition Solution for Integrated Services (GSA OASIS) Small Business (SB) Program with only one received proposal from the incumbent contractor Intrepid.
The TO has a current obligated dollar value of $144,842,069.92 and a ceiling dollar value of $161,846,641. The TO was issued with a base period of 19 July 2018 to 18 July 2021 with two, one-year options for a TO period of performance (PoP) end date of 28 July 2023. Due to ceiling demands and a higher burn rate than expected at TO issuance, in August 2020, the option ceiling dollar amounts were incorporated into the base ceiling for the total ceiling value amount of $161,846,641. Subsequently, the TO was modified to a five-year base period of 19 July 2018 to 18 July 2023 with no options.
The TO is currently projected to reach its ceiling value in February 2022.
The current TO PoP end date is 18 July 2023 and a PoP extension is not required for this effort. The requested ceiling increase will be used from 15 February 2022 through 14

FY22 and declare a milestone event (Initial Operational Capability of the IBCS) in the third quarter of FY22; without SETA support provided by the IFMC PO TO, the IBCS program will not pass IOT&E after the Army invested thirteen years and $1.4B, which will be a significant adverse impact on the PEO M&S and would result in unacceptable delays. Additionally, the IFMC PO relies heavily on the support and expertise of its SETA contractors and does not have sufficient USG employees or SETA contractors from other contracts to successfully execute the IFMC PO missions without approval of the ceiling increase. Approval of the TO ceiling increase supports an urgent need of the IFMC PO.
Moreover, a caveat of the PEO M&S realignment was that no SETA contracts in the PEO M&S would be curtailed as a result of the realignment. Thus, the other contracts providing SETA support to the missions and responsibilities that the IFMC PO gained during realignment will begin expiring in the first quarter of FY22 and that SETA support must transition to the IFMC PO TO. As a result, not approving the requested TO ceiling increase will result in a shortage of SETA service support contractor employees who support critical IFMC PO mission functions, which in turn will have a significant adverse impact on the PEO M&S and would result in unacceptable delays. Approval of the TO ceiling increase supports an urgent need of the IFMC PO.
Finally, the IFMC PO has coordinated with other organizations within PEO M&S and other contract holders are unable to provide additional SETA support to the IFMC PO until the follow-on TO is issued, which further supports the urgency determination underlying the TO ceiling increase request. Other than the ceiling increase discussed above, there are no other known alternatives to fulfill this requirement without a gap in SETA support to the IFMC PO; a gap in service will have a significant adverse impact and is unacceptable to the Government.
6. Efforts to Obtain Competition:
(a) Effective Competition: On 28 July 2016, ACC-RSA SMD/SP published a Notice of Intent to industry of the Government’s intention to transition IFMC PO SETA support services from SETA Contract 2010 to the GSA OASIS SB Program. Subsequently, ACC-RSA SMD/SP competitively solicited the IFMC PO SETA support services under GSA OASIS SB Pool 4; only one proposal was received from the incumbent contractor (Intrepid) and TO GS00Q14OADS417 W9113M18F0012 was issued on 19 July 2018. As noted above, TO GS00Q14OADS417 W9113M18F0012 was competed under GSA OASIS SB Pool 4; while efforts will not be taken to obtain competition in support of this ceiling increase request due to the nature of the urgent and compelling circumstances, as a follow-on acquisition to TO GS00Q14OADS417 W9113M18F0012, the IFMC PO intends to pursue future SETA support services using a competitive, fair opportunity strategy.

Approval
For Task Order GS00Q14OADS417 W9113M18F0012, based on the foregoing justification, I hereby approve the ceiling increase (without a period or performance extension) in the amount of $60,809,498 using an exception to fair opportunity pursuant to the authority of FAR Part 16.505(b)(2)(i)(A) – The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays, subject to availability of funds, and provided that the services or supplies herein described have otherwise been authorized for acquisition.
