EXCEPTION TO FAIR OPPORTUNITY JUSTIFICATION
1. Nature and/or Description of the Action
The Defense Threat Reduction Agency contracting activity proposes to procure, without requesting proposals from all five contractors on the Weapons of Mass Destruction (WMD)
Defeat Indefinite Delivery/Indefinite Quantity (IDIQ), an effort entitled Counter WMD Systems
Engineering (SE) Science and Technology Support. Science Applications International
Corporation (SAIC) will be the only contractor solicited to provide the required technical effort.
This will be an extension under the existing SE support task order, DTRA01-03-D-0017-0050.
2. Description of the Supplies/Services Required
The purpose of this effort is to provide SE and Integration (SE&I) support for the Innovation and
Systems Engineering Office by adding an option to the existing task order. This option will continue to execute the requirements under the existing Statement of Work (SOW). These include: qualified SE expertise to support DTRA in Concept Determination and Requirements
Analysis; Synthesis and Architectural Design; Systems Integration, Testing, Demonstration, and
Transition; and Systems Engineering Management Support; Subject Matter Expertise; and
Program Management.
An option for this Period of Performance (POP) was not included at the time Task Order 50 was competed as the Program Office was planning to develop a new IDIQ for SE support. This new
IDIQ never came to fruition as management changed direction by deciding to include it as part of the follow-on Combating WMD (CWMD) Research and Development (RD) IDIQ for award in
2013.
Task Order 50’s current POP is 10 Mar 2010 to 10 Mar 2012. The anticipated POP of the new option is 18 months from award of the task order modification, ending 9 Sep 2013. The option is estimated to cost $4.6M and is to be funded in FY12. The anticipated pricing structure is
Cost-Plus-Fixed-Fee (CPFF). This effort falls within the period of performance of contract
DTRA01-03-D-0017, 01 May 2003-30 Apr 2013, whose ordering period ends on 30 Apr 2013.
Orders placed within the ordering period must be completed by 30 Apr 2014.
3. Exception to Fair Opportunity
Under FAR 16.505(b)(2)(c), the order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

4. Justification Rationale
The exception to fair opportunity was not used previously for this project under this IDIQ. This added option is an extension of the existing work accomplished under DTRA01-03-D-0017, Task Order 50, which was competitively awarded under the WMD Defeat IDIQ, 10 Mar 2010.
All five IDIQ holders submitted a proposal in response to the Task Order Request Package, i.e., SAIC, Applied Research Associates, L-3 Services, Cubic Applications, and ManTech SRS
Technologies. Based on an integrated assessment of all evaluation criteria, SAIC was selected for award of the task order. SAIC represented the best value and best met all of the subfactors. It was determined from the proposals that SAIC was the only Offeror that possessed the experience in systems engineering requirements capture and life-cycle management as well as superior
Chemical, Biological, Radiological, Nuclear, and Explosives (CBRNE) subject matter expertise.
Additional rationale is as follows:
Award to any other source would likely result in increased cost to the government that is not expected to be recovered through competition. The cost of recruiting, training, and familiarizing personnel with the requisite systems engineering (SE) skill set and experience could exceed $1M.
Award of the task order to a different source would cause unacceptable delays in fulfilling the government’s requirements. No other source could provide the requisite SE experience and knowledge, skills, and abilities without encountering a steep learning curve in providing SE&I support to the various divisions in the DTRA RD Enterprise. That learning curve could entail a delay of up to six months.
The follow-on procurement should be placed with SAIC to continue the existing effort until a new competitive contract is awarded in FY 13. The scope of the new option is the same as the current effort and will use the existing SOW. The extended effort will consist of systems engineering and integration support in four areas: Innovation and Systems Engineering Office
Directed, Intra-Enterprise, Inter-Enterprise, and external to DTRA. Support to the Innovation and Systems Engineering Office will consist of SE activities facilitating and enabling technical innovation projects and high risk and emerging technology research. Intra-Enterprise SE will support research and development projects within the Enterprise but across directorates and divisions, primarily within the RD Enterprise. SE support to Inter-Enterprise activities will focus on programs that involve more than one Enterprise or DTRA Office and support to DTRA Major
Acquisition Programs and Campaign initiatives. Finally, for those programs where DTRA is collaborating with other Federal, state, local, or international governments and agencies, SE support will be applied to ensure integration and interoperability. The continuation effort will include SE, subject matter expertise, and program management support. It is a critical effort and it would entail a great deal of unnecessary risk to turn this effort over to a new contractor in
March 2012. The most cost effective and efficient course of action is for DTRA to execute a cost extension under the existing task order to provide interim support until the follow-on CWMD
RD IDIQ is awarded.
5. Market Research
In accordance with Federal Acquisition Regulation (FAR) Part 10, market research has been conducted for this task order. The following techniques were used: historical acquisition information (review of recent market research results for similar or identical supplies/services;
this also included review of the capabilities of the five offerors, the source selection evaluation, and final results for awarding Task Order 50) and personal knowledge in procuring supplies/services of this type. Based on this research, as detailed in the Project Manager’s market research report, dated 30 Nov 2011, this requirement cannot be met by commercial items, commercial items with modifications, or non-developmental items. No other source could provide the requisite SE experience and skill set without a substantial learning delay and transition period resulting in increased cost and schedule delay.
6. Other Supporting Facts
The ceiling increase was determined by creating an Independent Government Cost Estimate based on anticipated support required. The resultant cost/price of this option will be determined to be fair and reasonable based on a price and cost analysis of the contractor’s proposal to include direct labor rates, materials, travel, and overhead rates. This analysis will include a technical/cost evaluation by the task order Contracting Officer’s Representative (COR) and the contracting office’s comparison to the current task order’s rate data. A Preliminary/Final Price Negotiation
Memorandum will be accomplished to document the proposed costs, cost and price analysis, findings, and result of any required negotiations.
7. Subsequent Actions.
The requirements for SE&I support under the existing task order are planned to be competed under the follow-on CWMD RD IDIQ for award in 2013.
Contracting Officer Certification and Determination
I certify that this justification is accurate and complete to the best of my knowledge and belief.
Additionally, I determine that the order represents the best value consistent with Federal
Acquisition Regulations.
