About this file

This limited sources justification document proposes extending an existing blanket purchase agreement and order with Environmental Systems Research Institute, Inc. for geospatial software, licenses, training, and consulting services. The Department of Justice and Federal Bureau of Investigation require a comprehensive geospatial software platform for location intelligence, mapping, and data analysis. The extension would be from June 1, 2023 to August 31, 2023 for a total firm-fixed-price of $1,682,917.28. Only Esri, Inc. offers the full suite of proprietary geospatial capabilities needed including editing, analytics, mapping tools, web and mobile integration, security, and technical support. Market research found no other single vendor that could meet all requirements, such as FedRAMP approval for web-based solutions. The agreement utilizes General Services Administration Multiple Award Schedule contract GS-35F-253CA.

LIMITED SOURCES JUSTIFICATION (FAR PART 8)

LIMITED-SOURCES JUSTIFICATION FOR FEDERAL SUPPLY SCHEDULE PROGRAM

FAR 8.405-6(c)

Requisition Number: DJF-23-4750-PR-0000057

Title: Esri Blanket Purchase Agreement (BPA) and Order Extension Date: 05/25/2023

The following Limited Sources Justification (LSJ) for the use of sources limited to fewer than those required in FAR 8.405-1, Ordering procedures for supplies, and services not requiring a statement of work, is prepared in accordance with Federal Acquisition Regulation (FAR) 8.405- 6(c), Limiting Sources. This acquisition is conducted under the authority of the Multiple-Award Schedule (MAS) Program (41 U.S.C. 251).

1. Identification of the agency and the contracting activity.

The U.S. Department of Justice (DOJ), Federal Bureau of Investigation (FBI), Information Technology Acquisition Unit (ITAU) proposes to extend BPA 15F06718A0008180 and order 15F06722F0001204 pursuant to FAR 8.405-6(a), Limited Sources, to Environmental Systems Research Institute (Esri), Inc. to renew geospatial software, software licenses, remote training, and remote consulting services on behalf of the Enterprise License Agreement Management Unit (ELAMU), Office of the Chief Information Officer (OCIO).

2. Nature and/or description of the action being approved.

It is the intent of the Government to extend BPA 15F06718A0008180 and order 15F06722F0001204 for a period of performance of 06/01/2023 – 08/31/2023. The total cost of the firm fixed price (FFP) extension is $1,682,917.28. The extension will be executed as a contract action through a single sole source, made to Esri, Inc. under General Services Administration (GSA) MAS GS-35F-253CA.

BPA 15F06718A0008180 and order 15F06722F0001204 was awarded to Esri, Inc. on 09/28/2019 for geospatial software licensing, maintenance, remote support, and remote services. In order to ensure there is not a lapse in services, the Government is executing a three

(3) month extension per clause 52.217-8.

3. A complete description of the supplies and/or services required to meet the agency’s needs. Provide the estimated total value to complete the work (including any options, if any).

The DOJ and FBI have a requirement for a geospatial software platform that can provide location intelligence and mapping services. At a more granular level, the capabilities need to highlight hidden patterns, trends, and relationships through data and mapping. The location intelligence needs to provide unique insights that are conducted in real time and provide a level of understanding which can lead to decision making. There is also a need for remote consulting services which would include on and off-site personnel to provide expert advice and guidance to leverage the geospatial software to its fullest extent and trouble shoot any issues as issues arise. This software is proprietary to Esri, Inc and Esri, Inc. is the only source that can provide the entire geospatial software platform and services.

The total estimated value for the BPA and order extension will be $1,682,917.28.

4. The authority and supporting rationale (see 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

FAR 8.405-6 (a)(1)(i)(B) – Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

Esri, Inc. possesses unique qualifications due to being the sole provider of the comprehensive geospatial software platform that can meet all of the Government’s current geospatial requirements which include editing, analysis, and mapping tools, integration with Web Geographic Information System (GIS) solutions, Subject Matter Expert (SME) training options integrated into licensing, Help desk support 24/7 Contiguous United States (CONUS), Robust help documentation, Interoperability with other platforms, Share content, Mobile application capabilities integration, Perform system reporting and analytics, Information security (CONUS)

– Desktop, and Information security (FEDRAMP) – WebGIS.

Esri, Inc. has authorized resellers but none of the authorized resellers sell the entire geospatial software platform. Esri, Inc. is the only source that can grant a right to copy and deploy products in an Enterprise Agreement (EA) allowing the DOJ and FBI full use of the geospatial software platform. Consideration for information security like FedRAMP for web-based GIS disqualifies the majority of the market. Esri is the only FedRAMP approved seller of geospatial products currently on the market.

5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).

The Contracting Officer is responsible for determining fair and reasonable prices for orders placed against FSS contracts. Supplies offered on the schedule are listed at fixed prices. Services offered on the schedule are priced either at hourly rates, or at a fixed price for performance of a specific task (e.g., installation, maintenance, and repair). GSA has determined the prices of supplies and fixed-price services and rates for services offered at hourly rates to be fair and reasonable for the purpose of establishing the schedule contract. GSA’s determination does not relieve the ordering activity Contracting Officer from the responsibility of making a determination of fair and reasonable pricing for individual orders, BPAs, and orders under BPAs, using the proposal analysis techniques at FAR 15.404-1. The complexity and circumstances of each acquisition should determine the level of detail of the analysis required.

6. A description of the market research conducted among schedule holders, and the results of the research. A statement must be made that the supplies and services are available from the FSS.

The FBI conducted market research during the period of October 2022 – March 2023 to determine other commercial products that could meet the Government’s requirements. In addition to Esri Inc., three (3) additional companies (QGIS, Maptitude, and Mapbox) have been identified as alternate geospatial software providers. An analysis was performed by DOJ Geospatial Community of Interests Subject Matter Experts (SMEs) which resulted in a conclusion that the Esri Inc. geospatial software platform was the only platform that could provide all the requirements. QGIS, Maptitude, and Mapbox could perform portions of the geospatial software requirement, but their software could not meet the entire scope of requirements.

In addition to the DOJ Geospatial Community of Interest analysis, the FBI SMEs have assessed and concluded based on their FBI user experience that it is not feasible to replace the Esri Inc.

software in the FBI without seriously degrading the Government’s ability to conduct Geospatial Intelligence. Additionally, the Government reviewed acquisition history, GSA Advantage database information and GSA Schedule products offered with pricing information. Based on market research, the Government’s recommendation to continue the use of Esri Inc’s geospatial software products, remote consulting services, and training as it is the most advantageous and continues to meet the Government’s requirements.

7. Any other facts supporting the limited source justification.

There are no other facts supporting this justification other than what has been previously stated.

8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.

The FBI will periodically assess its current solution and the marketplace to determine if it is technically and fiscally feasible to utilize another competitors’ software products in a cost-effective manner to replace certain well-defined portions of the Esri Inc’s-based environments without introducing excessive performance, schedule, security, and cost risks to the current environment.

If the FBI decides to expand or change current applications to systems that no longer utilize Esri Inc. geospatial software, the Government will complete a thorough market research of the alternatives.
