About this file

This document is a Request for Proposal (RFP) issued by the Houston Community College System (HCC) seeking proposals from qualified firms to provide First Aid Kit Supplies & Related Services. HCC is soliciting proposals for a term contract for first aid supplies and related services from qualified firms to provide First Aid Kit Supplies & Services and related goods and services. HCC expects to purchase up to $60,000 of goods and services each year, though this amount may vary. The selected contractor will be responsible for servicing 151 currently installed first aid kits across 20 different campus locations on a quarterly basis, with all first aid kits meeting the ANSI/OSEA Z308.1-2015 standard. A non-mandatory virtual pre-proposal meeting will be held on January 17, 2024, and proposals are due by January 31, 2024. HCC anticipates awarding to a single supplier, though may award to multiple vendors as "Primary" and "Secondary". Pricing must be all-inclusive, and HCC reserves the right to accept or reject any or all proposals. HCC is interested in maximizing value and encourages bidders to propose added value concepts and programs.

The RFP specifies that the selected contractor must have at least two sources for all item categories submitted, due to global supply chain challenges. Quantities are estimated and not guaranteed. HCC may require more or less. The contractor must provide the new first aid kits, install and service them per the scope of work. HCC has a Small Business Development Program that applies to this procurement, with points awarded for small business participation. The contract term is one year with four one-year renewal options.

Section 2 – Project Scope of Work/Services and Specifications

2.1 Scope of Services

HCC is soliciting proposals for a term contract for first aid supplies and related services from qualified firms to provide First Aid Kit Supplies & Services and related goods and services. This will vary upon project, need and situation. HCC reserves the right to award separate contracts to multiple contractors.

It is the responsibility of each vendor to examine the entire proposal response package, seek clarification in writing, and review their proposal response for accuracy before submitting. Questions relating to this RFP must be submitted in writing in Bonfire. The deadline for submission of questions relating to this RFP is listed on the Events Schedule within Bonfire. All questions submitted in writing prior to the deadline will be compiled and answered in writing through Bonfire. The College will not be bound by any information conveyed verbally.

HCC is seeking a supplier capable of servicing 151 currently installed first aid kits across 20 different campus locations in multiple buildings at each location. First aid kits will need to be serviced by the Contractor on a quarterly basis and all first aid kits will meet the ANSI/OSEA Z308. 1‐2015 standard. A list of items placed in the first aid kit will be approved by the Environmental, Health and Safety Department (EH&S). The selected Contractor will work with EH&S to develop an approved first aid kit supply list and ensure that ONLY these products are placed in the first aid kits. If additional kits are required, EH&S will assess and approve the additional kit(s). The selected Contractor will provide the new kit, install and service the first aid kit according to the parameters outlined in this scope of work.

2.2 SPECIAL REQUIREMENTS

Brand names and model numbers that may appear in the Specifications section and/or the BidTable are for reference only. It is not the intent of Houston Community College to restrict these bids in such cases, but to establish a desired quality of level of merchandise or to meet a pre‐established standard due to like existing items. Offerors may offer items of equal stature and the burden of proof of such stature rests with offerors.

Houston Community College shall act as sole judge in determining equality and acceptability of products offered. After opening of bids, but prior to award recommendation, Houston Community College may require additional documentation demonstrating equal or superior products as compared to products required.

Vendor may offer for sale additional items related to the scope of goods and/or services described above and/or listed on the BidTable. Though the related items offered may be considered during the award recommendation, and/or may be made a part of a subsequent contract, if any, with Houston Community College, the effect of the related items cannot be extended and totaled in determining the lowest bidder since an estimated usage is unknown. Purchases by HCC of related items should not exceed 20% of the total annual purchases under the contract.

The rates quoted on the BidTable (bid pricing sheets) within Bonfire must be all‐inclusive. “All‐inclusive" shall be construed as costs incorporating all charges for labor, material, equipment, travel, transportation, and any other cost incurred. No separate line‐item rates or charges will be accepted. Quantities are estimated. HCC may require more or less. In case of a discrepancy between unit and total pricing, unit pricing governs.

During the term of the contract, only industry‐wide changes in price, reflected by documentation from supplying manufacturer/mill(s) will be approved. Pricing is subject to manufacturer’s increase or decrease, and for the amount of the increase/decrease only. Prices cannot be increased for ninety (90) days after the contract begins. Prices cannot be increased within ninety (90) days of any previous price increase. Price reductions must be applied to Houston Community College costs as soon as applied to vendor’s costs.

2.2.1 Award

Houston Community College anticipates awarding to a single supplier. In the event multiple suppliers are awarded, it is the intention of Houston Community College to award as best serves the College’s interest in order to assure the College has sufficient coverage to meet its needs, therefore, Houston Community College reserves the right to award by item, category, overall, or as best serves the college’s interest. Award shall be made to the supplier providing the overall best value or most advantageous to the college as determined by the overall evaluation. "Best value" shall be interpreted as that which best supports the overall needs of the project and end users in consideration of all appropriate factors which impact cost and performance.

In addition, the College may award to more than one (1) vendor as “Primary” and “Secondary”. The “Secondary” vendor will be utilized as necessary due to time constraints, availability, etc. This Bid does not obligate Houston Community College to the eventual purchase of any product/service described, implied or which may be bid. Progress toward this end is solely at the discretion of HCC and may be terminated at any time prior to execution of an award.

2.2.2 Additions and Deletions

HCC, by written notice to the Contractor, at any time during the term of this contract, may add or delete like or similar locations and/or product, services to the list of locations and/or product, services to be performed. Any such written notice shall take effect on the date stated in the notice from the College.

HCC reserves the right to add or delete facilities serviced under the purchase order/contract. HCC will provide a written notice for a minimum of ten work days, to advise the supplier of any facilities/locations which are to be deleted or of any locations that are to be added and require services.

2.2.3 Estimated Quantities Not Guaranteed

The estimated quantities specified herein are not a guarantee of actual quantities, as HCC does not guarantee any particular quantity of equipment or services requested during the term of this contract. The quantities may vary depending upon the actual needs of the user department. The quantities specified herein are good faith estimates of usage during the term of this contract. Therefore, HCC shall not be liable for any contractual agreements/obligations the Contractor enters into based on all the quantities specified herein. There is no guaranteed amount of business, expressed or implied, to be purchased or contracted for by HCC.

2.2.4 Request For Samples

A sample of the products proposed may be required for inspection by Houston Community College after proposals are opened, by prior to award of job. The sample(s) of the unsuccessful vendors will be available for return after award. However, the sample(s) of the successful vendor(s) will be retained for comparison with the products shipped, and then available for return. The using departments will coordinate the delivery and return of sample with the vendor(s).

2.2.5 Acceptance Of Goods

Houston Community College reserves the right to test goods for quality and performance. Although the bid may be awarded and confirmed by a purchase order, the goods are subject to rejection if the product(s) fail to perform in accordance with all requirements and specifications and/or fail to meet the needs of the end user.

2.2.6 Usage Reports

Houston Community College reserves the right to request, and receive at no additional cost, up to two (2) times during the contract period, a usage report detailing the products and/or services furnished to date under a contract resulting from this bid. The reports must be furnished no later than five (5) working days after written request and itemize all purchases to date by HCC department, description of each item purchased, including manufacturer or brand, quantity of each item purchased, per unit and extended price of each item purchased, and total amount and price of all items purchased.

2.2.7 Invoicing

Vendor’s invoice shall include description of service, purchase order number, personnel and job performed, quantity and unit price as specified on the BidTable(s) and supplier’s invoice(s) for reimbursement. A brief narrative shall be included with each invoice.

All items listed on the BidTable(s) will be paid at the price bid. Regarding dedicated equipment, vendor should include delivery and any other charges into the rates. Any contingencies must be included into the elements on the BidTable(s).

Houston Community College will make payment within thirty (30) days of satisfactory deliver of equipment or within thirty (30) days from receipt of a correct invoice, whichever is later.

2.2.8 Evaluation

If products other than the products specified are bid, Houston Community College reserves the right to evaluate the products bid, at no expense to the College. As long as the products bid are equal to or better than those specified, they will be considered; however, the final decision as to whether or not the products bid are equal to or better than the products listed will lie solely at the discretion of HCC. Pricing will not be the only factor analyzed. After opening proposals, but prior to the award recommendation, HCC may require documentation demonstrating the effectiveness of supplier’s products as compared to the products required.

2.2.9 Toll/Parking Fees

Any and all toll/parking FEES incurred by the vendor during the term of this contract will be the responsibility of the vendor.

2.2.10 Change In Contract

Should any changes to the contract be required, a Change in Contract form shall be generated by HCC Procurement Operations and will be sent to the awarded vendor(s) for execution. Any changes in contract shall be in writing and must be signed by both Houston Community College and the awarded vendor.

2.2.11 Purchase Orders

Products and/or services must not be provided, and invoices will not be paid without a purchase order, signed by the Houston Community College Procurement. Purchase orders will be written in annual increments when applicable. Once a purchase order is issued, the using department will contact the vendor directly to place an order. Vendor must obtain the names of appropriate personnel and accept orders only from those persons having authority to place an order.

2.2.12 Vendor Qualifications

Using departments may find it necessary to obtain products on an emergency basis. Therefore, vendor shall have and maintain sufficient inventory of items as specified, in quantities relative to the needs of the contract. In addition, the vendor shall have capability to obtain contract items, if out of stock, from a predetermined source if such emergency arises. These items shall be charged at the contract price. If the vendor is unable to demonstrate sufficient stock backup capability, the entire bid is subject to rejection.

2.2.13 In addition:

b) Vendor shall be able to furnish and deliver requested items on an as needed basis, within seven

(7) business days, or less, of receipt of order.

e) Vendor shall maintain, at a minimum, normal working hours of 7:30 a.m. – 5:00 p.m. CST, Monday through Friday, except for official HCC Holidays.

f) Vendor shall only provide first quality products; no seconds, irregulars, or gray market items will be accepted.

2.2.14 Sourcing

As a result of the global pandemic, we are requiring all vendors to have at least two (2) sources of all item categories submitted for bids. Bidder shall provide the name and locations as detailed in the Requested Information section of this Bonfire project. HCC understands the shortages and lock downs of entire countries are real and have happened, therefore, we must have a vendor(s) who will work to ensure our needs can be met within the requirements set forth.

Quantities are estimated, HCC may require more or less. In case of discrepancy between unit and total pricing, unit pricing governs. The descriptions of the preferred products are provided in the BidTable in Bonfire.

3.2 Price Schedule

The respondent is to provide information and pricing for all items listed in the Price Schedule to support the purchase of the requested product/service. The Price Schedule will help HCC to fairly assess each proposer's pricing and evaluate the competitiveness of each proper's offer.

The proposer shall indicate annual cost within the BONFIRE Bid Table, Exhibit 1 – Schedule of Items & Prices.

3.3 Additional Services

In the event College may require additional related services to be performed by the awarded Contractor that are outside the scope of the Agreement (“Additional Services”) it may submit a written request for a proposal from the Contractor (“Proposal”), which Contractor may provide if Contractor is willing and able to perform such Additional Services. Such Proposal shall contain (a) a scope of work to be performed; (b) a fixed billing rate for the proposed services; and (c) any other information relevant to such Proposal. Section 4 – Proposal Evaluations

4.1 Evaluation Criteria

Step 1 The scoring of proposals for this RFP will occur in two (2) steps. During Step 1, an Evaluation Committee (“Committee”) will review all proposals to determine which proposers have qualified for consideration according to the criteria stated herein. The Committee’s evaluations will be based on all available information, including qualification statements, subsequent interviews, if necessary, reports, discussions, reference checks, and other appropriate checks. The highest rated proposer(s) evaluated by the Committee may be invited to make an oral presentation of their written proposal to the Committee.

Proposals will be evaluated using the following criteria:

Evaluation Criteria Available Points

Firm’s Qualification and Experience (Section 5.4.3 ‐ Tab 1) & Demonstrated qualifications of Personnel and Team (Section

5.4.4 ‐Tab 2)

Proposed Approach and Methodology, (Section 5.4.5 ‐ Tab 3)

Past Performance & References (Section 5.4.6 ‐ Tab 4)

Small Business Practices (Section 4.5.h ‐ Tab 6) 10

Completeness of Price Proposal (Information sufficiently complete and clear to enable HCC to evaluate vendor’s pricing for all elements of the required scope)

Not Considered in Step 1

Responsiveness to Requirements (Vendor submitted all required components of the solicitation response such that HCC is able to evaluate the vendor in all non‐price scoring categories and can verify vendor’s compliance with applicable law, policies, and certifications)

Pass or Fail

Total Points 100

Step 2 Following the evaluation, scoring, and ranking of all proposers based on the weighted factors above (Step 1), proposers earning a minimum of 80 points, and who are deemed otherwise responsible and eligible (see below), will enter the pricing phase (Step 2).

During this Step 2, all proposers scoring a minimum of 80 points during Step 1 will be re‐ranked, in the order of lowest price to highest price, giving price a weight of 100% at this phase for all qualifying proposers. All remaining proposers who did not receive a minimum of 80 points in Step 1 will remain in their same ranking position resulting from Step 1, and their price proposals will have no weight in Step 2.

In the event the HCC determines, in its sole discretion, that an insufficient number of firms received a minimum of 80 points in Step 1, such that there will not be adequate price competition among qualified firms in Step 2, HCC reserves the right to select up to three (3) of the top scoring proposers from Step 1 to move on to Step 2, even if such firms scored less than 80 points in Step

1. HCC may, however, refuse to select a second or third firm to move on to a Step 2 price evaluation if there is a greater than 10% spread (as calculated by the higher score minus the lower score, divided by the lower score) between a firm and the next highest‐ranked firm.

4.2 Eligibility for Award

Proposals which do not comply with all the terms and conditions of this solicitation will be rejected as non‐ responsive.

A person is not eligible to be considered for award of this solicitation or any resulting contract or to be a subcontractor of the proposer or prime contractor if the person assisted in the development of this solicitation or any part of this solicitation or if the person participated in a project related to this solicitation when such participation would give the person special knowledge that would give that person or a prime contractor an unfair advantage over other proposers.
