About this file

This document is an addendum to a Request for Qualifications (RFQ) issued by the Department of Public Safety (DPS) of the State of Texas for Engineering, Architectural, and Land Surveying Services. DPS is seeking the most qualified firms to provide professional services to support various deferred maintenance and renovation projects for DPS facilities and infrastructure across six regions in Texas. The RFQ outlines four service groups: Group 1 - Engineering, Architectural, and Surveying Services; Group 2 - HVAC Testing, Adjusting, Balancing and Commissioning; Group 3 - Construction Materials Testing Services; and Group 4 - Facilities Condition Assessment Services. Respondents must submit qualifications by October 13, 2023, and DPS plans to award contracts by November 10, 2023 for an initial five-year term.

The RFQ provides detailed scope requirements for each service group, qualifications criteria, and instructions for submitting responses. It also includes contract terms specific to this procurement, such as insurance, criminal background checks, confidentiality, and dispute resolution procedures. Respondents must demonstrate financial viability, provide references, and submit a HUB Subcontracting Plan. DPS will select the most qualified respondent(s) based on competence and qualifications, and then negotiate fair and reasonable pricing.

Questions & Answers Solicitation # 405-23R0007034

Revised-March 10, 2015 PCS form 004

1. Can you tell me, since we only provide Land Surveying Services, can we submit an RFQ for Group 1F only or do we need to team with an AE firm?

a. To submit for Service Group 1 – all categories must be included. Historically, some of the firms that submitted and were awarded had teams of subcontractor firms in order to complete the entire service group.

2. Regarding the referenced project, does DPS expect SOQs to be submitted for full teams, or by individual discipline? Does DPS plan to select different individual disciplines to complete the required services for each region? For example, my firm is an architecture firm. Should we submit only our qualifications, and hope to be selected for the architectural services needs of our region, or should we include other disciplines in our SOQ and expect to be selected as a complete team that can satisfy the needs of all services required under each Service Group?

a. Service group 1 will be awarded to a firm that provides all services necessary to support 1A, 1B, 1C, 1D, 1E and 1F. A prime Contractor may subcontract to provide the services.

3. Page 9, Item C.2.1 list 34 groups of services. Are we applying for any one or more group in our proposal, or must the proposal include all 4 groups?

a. Contractors may submit proposals for one or more service groups.

4. Page 18, C.11 – Criminal Background check – does this occur after award of contract, or must it be done at the proposal phase with key personnel?

a. Background checks will occur after award of contract. If staff are unable to pass background, the contract may be canceled.

5. Is there a pre-proposal web presentation that was done, or will be done, for this proposal?

a. No pre-proposal conference will be held for this solicitation.

6. References: Our firm has continuously held IDIQ contracts with TXDOT Facilities for the past 13 years. However, TXDOT will not give references. Is there a way we can somehow include our TXDOT firm rating or Project manager rating in the reference section?

a. Past projects completed with any public or private entity with requirements of similar size and scope can be included in the reference list.

7. Can you please define “Financial Rating information” listed in section D.7.2.E on page 28?

a. Financial Rating information includes Dun & Bradstreet Business Information Report or a similar 3rd party report that includes a viability and risk score.

8. What is the length of the contract for new purchase orders for the AE services?

a. The blanket contract will be awarded for a five year period.

9. I've been trying to figure out if I need to reach out to you on getting setup a Texas Payee Identification Number? I don't have this number yet.

a. Please complete Exhibit F.4 (AP-152 form) and DPS will complete the setup if awarded.

10. Can respondents choose which items (A through O) they would like to pursue? I refer to the list on Page 8.

Revised-March 10, 2015 PCS form 004

a. Contractors are required to perform all services classified under each applicable service group. Contractors may submit for one or more Service Groups. The Service Group(s) proposed must be stated in the proposal response.

11. We have projects in almost all sections of Texas. Can we choose more than one region?

a. Contractors may submit for one or more regions. Contractors must specify which regions are proposed in their response.

12. First page (page 1) of the solicitation says it must be signed. Does this mean a “wet” signature or is electronic signature acceptable?

a. A wet or electronic signature is acceptable.

13. Insurance and Financial: What type of proof do we need for this solicitation? Do we need to include this information in our proposal? This is routine for us to include a general statement form, however, most of the time an entity will specify amounts of coverages per category.

a. DPS has a general requirement per Section C.10 to include Certificate of Insurance with general coverages. If selected for award, Contractor will be notified of additional coverage, if necessary.

14. For Service Group 1 – Engineering, Architectural, and Surveying Services, is the DPS looking for the prime firm to submit an entire team of all listed disciplines (1A – 1F) or can the firm only submit the categories for which they are qualified in house (ie only 1B civil, 1D structural and 1F land survey)?

a. Contractors are required to perform all services classified under each applicable service group. Contractors may submit for one or more Service Groups. The Service Group(s) proposed must be stated in the proposal response.

15. Do we need to show six similar projects per discipline under C.6.2 or is that total?

a. Proposals must display a minimum of six reference projects to exemplify the types of work described in the solicitation and service group being offered.

Reference projects must easily convey the professional services performed by the proposing Prime and Subcontractors, if applicable. Contractors are encouraged to submit more than the minimum number of reference projects in order to fully demonstrate capabilities, if necessary.

16. Per the RFQ on page 18, C.11 A, It states that project personnel must submit to a fingerprint-based background check. What scope of required personnel needs to be fingerprinted? And will that cost be reimbursed?

a. DPS is responsible for conducting background checks at no cost to the vendor.

All personnel that will set foot in DPS buildings must be background checked.

17. Since a contract was not provided with the RFQ, will the awarded Firm have an opportunity to negotiate any possible terms and conditions of an awarded contract, if any exceptions are requested?

a. Any items considered for negotiation must be specified on the Exceptions Summary Form Exhibit.

18. We are a HUB-classified firm. Does our firm count as part of the 51% HUB goal?

a. If you are registered as a State of Texas HUB, this does count towards agency

HUB goals.

Revised-March 10, 2015 PCS form 004

19. Do you have MBE goals as well?

a. DPS only participates in the State of Texas HUB program.

20. For 405-23R0007034, please clarify whether the intent of the RFQ is to have one prime firm satisfy all regions and all categories or whether smaller firms may submit for a region and only one Group. An example would be is it acceptable to submit for Region 2 Southeast Texas Region and Service Group 3 (only).

a. Yes, Contractors may submit for one or more Service Groups. The Service Group(s) and region(s) proposed must be stated in the proposal response.

21. With regards to the referenced solicitation, it appears there are two sections requesting information for the submittal. Page 26 through 29 appear to be the bulk of the request, with additional items outlined on pages 14 and 15. Would DPS like the information on page 14 and 15 to be listed as “additional information” under Volume Two?

a. Please refer to the amended Solicitation Section D for complete requirements.

22. If a vendor would like to submit a proposal to provide services under Service Group 1, please confirm that the selected vendor must be able to perform ALL services within Service Group 1. Please further confirm that a vendor cannot propose to perform services in only 1A or 1B.

a. Correct. Service groups will be awarded to a firm that provides all services necessary to support 1A, 1B, 1C, 1D, 1E and 1F. A prime Contractor may subcontract to provide the services.

23. Please clarify the number of past projects we should submit. In Group 1, one project would not require all services that are within that group. Would you want 6 past projects for each subgroup or or 1-2 past projects for each subgroup?

a. Proposals must display a minimum of six reference projects to exemplify the types of work described in the solicitation and service group(s) being offered.

Reference projects must easily convey the professional services performed by the proposing Prime and Subcontractors, if applicable. Contractors are encouraged to submit more than the minimum number of reference projects in order to fully demonstrate capabilities, if necessary.

24. Please clarify this statement: "The Respondent must demonstrate overall readiness to promptly begin services after an award." In what manner would you want us to demonstrate readiness?

a. Proposals must display that Contractors have the personnel/ resources to provide required services within the region(s) proposed in a timely manner.

25. If a responder intends to submit on multiple service groups, are separate submissions of Volume II required? Or is it acceptable to provide only one Volume II submission identifying relevant experience for the different service groups?

a. Proposals do not need to have duplicate sections, but Volume II must clearly state each service group and region for which the firm is applying, and contain all necessary requirements to demonstrate qualifications for each.

26. We are a certified HUB firm and will use the HSP Section 3 as Self Performing. At the time of a project assignment, if requiring a needed consultant, could we complete a HSP then?

Revised-March 10, 2015 PCS form 004

a. A revised HSP submitted based on the individual assigned project, if applicable.

27. Can we respond to more than 1 service type in our response to the RFQ?

a. Yes, Contractors may submit for one or more Service Groups. The Service Group(s) and region(s) proposed must be stated in the proposal response.

28. If we are submitting for more than 1 service type (1B and 1F), should we identify six similar past projects per service? For example, if submitting for both civil engineering and land surveying, should we submit 6 civil engineering projects and 6 land surveying projects for a total of 12 projects?

a. Service groups will be awarded to a firm that provides all services necessary to support 1A, 1B, 1C, 1D, 1E and 1F. A prime Contractor may subcontract to provide the services.

29. Is the Business Continuity and Disaster Recovery Plan required with our response, or within 10 days of contract award? There is conflicting language for this requirement (page 28-29, section D.7.2, letter I).

a. The Business Continuity and Disaster Recovery Plan must be submitted within 10 days of award.

30. Please confirm that your HUB goal for the above-referenced solicitation is 21.1%.

a. Confirmed.

31. Am I able to reformat any of the forms, such as the Information and Certification Form?

Or does it need to be the exact PDF downloaded from ESBD.

a. Please use provided DPS forms in their current format.

32. HUB Subcontracting Plan (HSP), given that no particular project has been provided for this solicitation, what is the recommended approach to filling in the percentages for the HSP since the percentages would vary for each type of project under this contract?

a. Please submit an HSP plan for your firm in response to the solicitation. If awarded, a revised HSP can be submitted based on the individual project requirements.

SECTION B—SERVICES AND PRICES

B.1 PRICING REQUIREMENTS

B.1.1 Pricing Instructions

A. DPS seeks a Contractor to provide the services described in Section C, Statement of Work, on a no minimum, as needed, as requested basis. When requested, pricing is firm fixed price for the services requested and authorized by DPS as provided under this Contract.

Respondent must offer pricing on this basis. DPS will negotiate pricing prior to award of this Contract if the pricing offered appears that it may not be best value to DPS.

This Solicitation does not include a request for pricing and Respondents may not include any pricing or fee information in their responses to this Solicitation.

Under Texas Government Code, Section 2254.003, DPS may not select a provider of Professional Services or a group or association of providers or award a contract for Professional Services on the basis of competitive Responses submitted for the contracted Services, but will make the selection and award based on a two-step process:

1. On the basis of demonstrated competence and qualifications to perform the services;

and

2. For a fair and reasonable price. DPS will negotiate fees with the successful respondent.

The professional fees under this Contract may not exceed any maximum provided by law.

DPS will negotiate fees with the Respondent recommended for award.

B.1.2 Financial Rating Report, Financial Resources, and Ability to Perform

A. Bidder must provide evidence of its financial resources and its ability to provide the commodities or perform the services for which Bidder is submitting a response. This includes information Bidder believes is pertinent to demonstrate its financial capability, financial solvency, and capacity to fulfill the requirements of this solicitation.

B. Evidence of financial stability include providing audited financial statements for each of the last two years of Bidder’s operations or, in the alternative, financial statements compiled, reviewed and attested by an independent certified public accountant or certified public accounting firm. Bidder may submit a copy of its Dun & Bradstreet (D&B) Business Information Report. If a D&B is submitted the report must include Bidder’s Viability Score and the Portfolio Comparison Score or similar ratings.

C. In lieu of providing financial statements in its Proposal, a Bidder may provide a statement regarding its financial stability and viability to perform under any resulting contract. If Bidder elects this approach rather than audited financial statements, the Bidder must submit a statement, with appropriate supporting documentation, Page 6 of 33 Approved 9/10/2019 sufficiently detailed to demonstrate financial solvency, and to verify the capacity to fulfill the requirements of this solicitation.

D. Bidder must provide information and any other financial information reasonably requested by DPS consistent with the services provided by Bidder or otherwise required by the then applicable DPS policies for similar contracts.

E. Selected Contractor must also submit to the Contract Administrator its financial rating information within 120 days after the end of Contractor’s fiscal year.

F. DPS reserves the right to investigate and determine the financial integrity and responsibility of a Bidder and to reject a response on the grounds of Bidder’s lack of financial soundness, or if DPS reasonably concludes, after reviewing the information submitted by Bidder as well as all other relevant information obtained by DPS, that significant issues exist that could jeopardize Bidder’s full and timely performance. DPS also reserves this same right throughout the life of the Contract, including before executing any optional renewal with Contractor.

B.2 INVOICE REQUIREMENTS

A. Invoices are Contractor’s billing for services rendered. DPS will pay Contractor based on itemized invoices submitted to and approved by DPS. The invoices must be itemized and clearly identify the actual commodities and services provided.

B. Contractor’s invoice must include the following: the Contract number, the remittance address, and any prompt discount offered. Contractor must email the invoice to the Contract Monitor listed in the Contract and to apinvoices@dps.texas.gov.

The State of Texas will not incur any penalty for late payment if the invoice fails to conform to the requirements of this section or if Contractor did not email the invoice to the appropriate email addresses identified in this section.

B.3 PAYMENTS

A. DPS recommends that Vendor receive payments by electronic funds transfer (EFT), also known as direct deposit. If Vendor elects to be set up for direct deposit payment, Vendor must submit a completed Direct Deposit Authorization Form (74-176).

B. Regardless as to whether Direct Deposit is chosen, Vendor must submit a completed Application for Texas Identification Number (AP-152) and Request for Taxpayer Identification Number and Certifications (W-9) Form with its response.
