2. Previous above ground and underground disposal activities
3. Soil Contamination
4. Pesticide and Herbicide Usage
5. Storm water runoff onto or off of the subject property
6. Land uses of bordering properties
7. Location of nearby solid waste disposal sites
8. Above ground and underground utilities, pipelines, and tanks
9. Other potential hazards and liabilities
Each of these issues will be discussed below. It should be noted that the discussion and conclusions refer only to the property being assessed and does not include any.
neighboring property, except when specifically named. The discussions below are.
based upon on-site observations; review of available documents, drawings and maps;
interviews with gas, water, and electrical utility company personnel; and review of records and/or databases from local fire and environmental enforcement officials, Texas Commission on Environmental Quality, Texas Department of Health, United States Environmental Protection Agency personnel, property owners, and others necessary to compile this Phase I Environmental Site Assessment.
The following report is a summary of work performed using the guidelines set forth in the ASTM Standard Practice E 1527-13, Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process.
This report also generally conforms to the ASTM Standard’s suggested form of content.
Format modifications have been made to the ASTM standard’s suggestion by Smith Inland to assist in better reading and understanding of the report’s findings.
PURPOSE
The purpose of this Phase I ESA is to identify, to the extent feasible pursuant to the Scope of Work, limitations discussed in the report, and recognized environmental conditions (RECs) relative to the subject property. As defined in the ASTM Standard, an REC is:
The presence or likely presence of hazardous substances or petroleum products on a property under conditions that indicate an existing release, a past release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater, or surface water of the property. The term includes hazardous.
substances or petroleum products even under conditions in compliance with laws.
Smith Inland Environmental Services, Inc. ©1985-2023 Phase I ESA Lot 2, Block 1, Exchange Park Addition
The term is not indicated to include de minimus conditions that generally do not represent a material risk of harm to public health or the environment and that generally would not be the subject or an enforcement.
action if brought to the attention of appropriate governmental agencies.
Conditions determined to be de minimus are not recognized as environmental conditions.
LIMITATIONS AND EXCEPTIONS
The Scope of Work with regard to this ESA does not incorporate ASTM Standard non-scope considerations, such as asbestos containing building materials, lead-based paint, lead in drinking water, wetlands, regulatory compliance, cultural and historic resources, industrial hygiene, health and safety, ecological resources, endangered species, indoor air quality, and high voltage power lines.
The subject property in this report is referred to as the “site” unless specifically.
addressed separately. Site boundaries were not readily apparent but were.
approximated based on maps and by visually discernable physical features that could be.
readily identified.
Phase I ESAs are non-comprehensive by nature and are unlikely to identify all environmental problems and will not eliminate all risk. This report is a qualitative assessment. Smith Inland offers a range of investigative and other services to suit the needs of our client base, including more quantitative investigations. Although risk can never be eliminated, more detailed and extensive investigations yield more information, which may help the Client understand and better manage risks.
Since such detailed services involve greater expense, we ask our clients to participate in identifying the level of service that will provide them with an acceptable level of risk.
Smith Inland performed this Phase I ESA in general accordance with the guidelines set forth in the ASTM standard. No warranty, either expressed or implied, is made.
Environmental issues not specifically addressed in this report were beyond the scope of our services and not included in the evaluation.
This report may be used only for the Client and only for the purposes stated. Since site activities which include land or facility use, and on and off-site conditions, regulations, or other factors beyond our control could change after the completion of this report, findings and opinions can be considered valid only as of the date of the site visit.
This report should not be relied upon after 180 days from the date of its issuance (per ASTM Standard E 1527-05, Section 4.6). Any party other than the Client who wishes to use this report shall notify Smith Inland of such intended use.

HISTORICAL LAND USE
Review of Historical Aerial Photographs revealed the following:
1995 and 2003 USDA Historical Aerial Photographs
The convenience, parking area, and canopy are evident in the photograph. It is unknown whether the store was operational. There are no cars at the site in the 1995 photo, at the time of the photograph, so its status is unknown. The 2003 photo shows the store in operational status.
2010 and 2022 Historical Aerial Photographs
These photos show no changes in the property other than the fact that the store has been closed and the property continues to decay from a lack of use and maintenance. It does not appear that the underground storage tanks have been removed from the site.
The site does not appear to have been operational for many years.
According to the Texas Commission on Environmental Quality, there have never been any permitted landfills on the property.
PESTICIDE AND HERBICIDE USAGE
No visual evidence of abnormal use or storage of pesticides or herbicides was noted during the on-site assessment. The subject property has received no exceptional care to the vegetation that is located on the subject property.

OTHER POTENTIAL HAZARDS AND LIABILITIES
Mr. Gary Smith, Radiation Specialist with the Texas Department of Health, Austin, Texas provided information pertaining to radon levels within the State of Texas. More than 4,000 homes throughout the State of Texas were evaluated for radon analysis. Of these, 2,692 valid winter measurements were returned. When examined statewide, Texas has a low level of radon in homes and structures. The EPA’s threshold level of concern occurs when the calculated average exceeds 4.0 pC/l (picoCuries per liter). Mean levels for McLennan County are 0.5 pC/L. There is an extremely low potential of radiation exposure due to excessive levels of radon in structures in McLennan County.
