About this file
This document is an Addendum to a Request for Proposal (RFP) issued by the University of Texas at El Paso (UTEP) for an Electronic Scooter ("E-Scooter") Share Program. The RFP has a scheduled submittal deadline of December 7, 2021, at 3:00 p.m. MST. The Addendum addresses various questions and clarifications related to the RFP, such as the University's openness to alternative proposals, including third-party advertising and early service implementation, as well as requirements around the El Paso permit, HUB subcontracting, and the number of operators. The University states it will review all proposals submitted and does not have a predetermined fleet size, but will mutually agree on the fleet size with the selected vendor.
The RFP does not specify a preferred per-minute rate for riders, leaving that to the respondents' recommendations. The contract opportunity is specific to UTEP and the local jurisdictions of El Paso County and the City of El Paso in the state of Texas. Respondents are required to electronically acknowledge receipt of the Addendum, and failure to do so will result in their proposal not being considered.

Electronic Scooter (“E-Scooter”) Share Program
Scheduled Submittal Deadline:
December 7, 2021 @ 3:00 p.m. MSPT
Please note the following additions, revisions, clarifications, corrections and/or deletions have been made to the above referenced Request for Proposal.
The following are the University’s response to questions regarding the Collection Services RFP;
Question Response
Specifications and Additional Questions (5.1 General) Does the University want vendors to address this section in their response or is this a statement preluding the rest of the section? There is no specific question to answer here.
Statement is a prelude to the rest of the section
Would the University consider a revenue proposal that included third-party advertising on campus if it did not conflict with any existing partnerships/contracts in place, and content controls were deemed to be sufficient. (Appendix 2, Question 6, “Royalty")
University to review all proposals.
Respondents are encouraged to provide multiple options
Would the University be interested in service on campus beginning prior to the April 1, 2022 timeline provided in the RFP document, provided that a contract is executed? (Section
1.3 Term of the Agreement)
Yes
The bid document states a requirement that vendors provide proof of a valid permit for shared mobility devices issued by the City of El Paso. Is this permit required at the time of proposal submission? If not, can you clarify a date by when a proposer would need to provide proof of the El Paso permit?
(Specifications and Additional Questions - Section 5.4 Scope of Work)
At time of award
Are vendors allowed to provide additional documents in an Appendix?
University to review all proposals submitted

RFP No.: 724-2108-JBT
In the primary RFP document, multiple references are made to the sample agreement (Appendix Two) including a requirement that Proposers redline Appendix Two for any exceptions and explain those exceptions in detail in their proposal. In addition to the RFP document, the University also distributed a HUB Subcontracting Plan, a Best Value Statement, and a document titled University of Texas at El Paso, RFP-General Terms and Conditions. The General Terms and Conditions document contains many provisions that overlap and conflict with the terms in Appendix Two of the RFP (as one example, the insurance minimums are different). Additionally, the document titled General Terms and Conditions is not referenced anywhere in the primary RFP document. What is the significance of the General Terms and Conditions document, and how should it be addressed in the response, if at all?
Please see section 4.1 of the T&C's document
We were hoping to better understand your process for HUB Subcontracting at UTEP. Specifically, would we meet the requirements of this RFP as long as we make a good faith effort to source HUB subcontractors, with good faith defined as it is in the state HUB documents? In addition, do you have a date this effort needs to be completed by? Should it simply be completed prior to launching scooters on campus?
All respondents need to complete an HSP.If vendors are planning to subcontract, please indicate the name(s) of the subcontractors on the HSP document. Vendors are required to do a good faith effort and reach out to potential HUB subcontractors in Texas regarding subcontracting opportunities. If vendor is self-performing, you are also required to complete an HSP and indicate on the form that you will be self-performing.
Can UTEP confirm that it is looking for one (1) operator? Or is it open to more than one operator? If so, how many?
University to consider all options
Roughly how large of a shared scooter fleet is UTEP looking for? Or is that number completely up to operators to propose?
No set number on the fleet. Will be mutually agreed upon with vendor and university based on operation need
Is there a preferred rate per-minute that you would like to have us charge riders?
Respondent to provide recommendations
