GENERAL INFORMATION

1.1. Introduction

The Texas Comptroller of Public Accounts (Comptroller), acting for and on behalf of the Texas Treasury Safekeeping Trust Company (Trust Company), issues this Request for Proposals No. 240L (RFP) to solicit Proposals from qualified, independent persons or entities to provide turnkey Investment Management and Related Services for two (2) Texas local government investment pools, TexPool and TexPool Prime, as described in this RFP (Services).

All requisite services are referred to as “Services” in this RFP and are more fully described in Part II (Scope of Work) of this RFP. In this RFP, all references to Comptroller shall also include Trust Company.

Comptroller and Trust Company anticipate making contract award to one (1) Successful Respondent for the Services. The date of award, number of contracts awarded, and all procedures relating to a Contract are the sole discretion of the Comptroller and Trust Company. Comptroller and Trust Company reserve the right not to award a contract for the performance of all or part of the Services. The contract resulting from this RFP, if any, will be referred to as the “Contract.” Successful Respondent, as an independent contractor, shall provide Services under the Contract with Successful Respondent’s own personnel.

All costs associated with the Services must be included in the Respondent’s Proposal. Proposals that do not meet all of the requirements or contain all of the required documentation specified in this RFP will be rejected as non-responsive.

1.2. Background

General.

The Trust Company was created by the Texas Legislature and serves as a special-purpose entity that manages, safeguards, and invests public funds and securities belonging to the state of Texas, its agencies and local political subdivisions of the state. The Comptroller is sole officer, director and shareholder of Trust Company.

The Public Funds Investment Act (PFIA), Chapter 2256 Texas Government Code, provides that certain entities, including local governments, state agencies, and investment pools acting on behalf of two or more local governments, state agencies, or combinations of such entities, may purchase, sell, and invest funds and may contract with an investment management firm registered under the Investment Advisers Act of 1940 (15 U.S.C. Section 80b- 1 et seq.) to provide for the investment and management of its public funds or other funds under its control.

Additionally, the PFIA authorizes creation of investment pools that invest public funds jointly on behalf of entities that participate in such pools and sets forth laws and standards applicable to such investment pools and participation in the investment pools.

Trust Company provides investment services to 2,990 Participants (as of March 31, 2026) throughout the State through administration of two (2) local government investment pools, TexPool and TexPool Prime. Comptroller and Trust Company retain ultimate oversight and responsibility for the investment management and administration of TexPool and TexPool Prime. Trust Company has an existing contract for Investment Management and Related Services for TexPool and TexPool Prime; the contract will expire December 31, 2026, subject to Trust Company’s rights to extend, renew or terminate. Trust Company has identified a continuing need to contract for the Investment Management and Related Services for TexPool and TexPool Prime and seeks to meet this need through a contract resulting from this RFP.
