About this file

This is Addendum No. 1 to Solicitation 405-26R0004228 issued by the Department of Public Safety (DPS) Procurement and Contract Services in Austin, Texas, effective May 1, 2026. The addendum provides answers to vendor questions regarding law enforcement and criminal investigation training services and clarifies the mandatory pricing schedule item description. The solicitation seeks qualified vendors to deliver statewide training across six regional locations (San Antonio, Dallas, Houston, Lubbock, El Paso, and McAllen) covering advanced search and seizure laws, constitutional protections, criminal enterprise insights, and related topics. The contract term spans five years from September 1, 2026, through August 31, 2031, with annual evaluation periods and potential extension options. DPS requires vendors to deliver a minimum of 18 classes per year, with training typically consisting of 8 to 9 schools annually comprising up to 20 days of instruction per year. Class durations generally include a 36-hour Advanced Fourth Amendment course held over 4 days, an 8-hour Criminal Enterprise Class, and a 2-hour Covert Operations School block, though all courses must not exceed 40 hours. Vendors must acknowledge receipt of this addendum prior to the specified deadline or risk rejection of their offer.

Pricing must be submitted on a per-day-of-instruction basis for each region and contract year, with all costs inclusive of travel expenses and course materials (printed manuals, USB drives, handouts). The per-day rate must cover both instructors and all associated costs; DPS historically paid materials separately but now prefers inclusion in the daily rate, with vendors expected to allot a percentage increase each year for inflation. Respondents must provide two experienced instructors with a minimum of 10 years of law enforcement training experience, who may be subcontractors provided they meet all qualification requirements and pass DPS background checks. Instructors must meet at least one TCOLE requirement: hold a valid instructor license, possess an appropriate teaching certificate, or be formally designated in writing as a subject matter expert by the Training Coordinator. DPS will provide all training venues, audiovisual equipment, and required TCOLE documentation, while vendors are responsible for submitting instructor biographies, lesson plans, learning objectives, and course evaluations within 30 days of contract award, with an additional 30 to 60 days anticipated for TCOLE approvals. No minimum or maximum class sizes are specified beyond practical exercise constraints, with previous training limited to a maximum of 24 students for search warrant review exercises. Vendors may submit references from both prime contractors and subcontracted instructors, and Section 508 compliance documentation for VPAT requirements applies only to online registration tools, not printed course materials.

Solicitation 405-26R0004228 Law Enforcement and Criminal investigation Training Questions and Answers

1. Section C.2.3 requires a minimum of two experienced instructors with 10+ years of experience. May one or both instructors be subcontractors to the prime contractor, provided they meet all qualification requirements and are subject to DPS background checks?

Answer: Yes.

2. Section C.2.3 references "law enforcement training" experience.

Does DPS consider training delivered to law enforcement by legal scholars, former prosecutors, or constitutional law experts (who are not sworn officers) to satisfy this requirement, provided they have

10+ years of experience training law enforcement personnel?

Answer: Yes.

3. Are instructors required to hold TCOLE instructor certification, or is it sufficient that the training content meets TCOLE continuing education credit standards?

Answer: Please see response from our Training Operation Division (TOD)

An instructor teaching a course must meet at least one qualifying requirement. They must either hold a valid instructor license through TCOLE, possess an appropriate certificate (Texas Teaching Certificate), or be formally designated in writing as a subject matter expert for the course by the Training Coordinator

(TOD Chief). Below is the rule outlining the requirements for an instructor.

§ 215.10. Course Instructor Requirements.

(a) An instructor teaching a course must:

(1) hold a valid instructor license;

(2) certificate; or

(3) be designated, in writing, as a subject matter expert in the course by the training coordinator.

(b) The instructor is responsible for:

(1) ensuring compliance with commission rules and guidelines;

(2) preparing, maintaining, and submitting the reports of training within the time frame specified by the Training Coordinator;

(3) the administration and conduct of each course taught;

(4) at a minimum, providing a complete lesson plan, clear learning objectives, instructor biography, approved class roster and original sign-in sheet, and course evaluation to the training coordinator for the training file;

(5) enforcing all attendance and other standards set by the commission or the training advisory board;

(6) maintaining the discipline and demeanor of each student during class;

(7) distributing or presenting learning objectives to all students at the beginning of each course;

(8) ensuring that all learning objectives are taught; and

(9) ensuring examinations are proctored or supervised to have fair, honest results.

4. Section C.2.2 states a minimum of 18 classes per year. What is the typical class duration DPS anticipates — is it 5 days (40 hours) per the maximum, or does DPS expect shorter sessions as well?

Answer: Typically, our Advanced 4th Amendment class is 36 hours and is held over 4 days. However, the requirement is met as long as all topics are covered, and the class does not exceed 40 hours. Advanced

4th Amendment is usually held 4-5 times each year. This contract will also cover our Criminal Enterprise

Class which consists of one whole 8-hour day, usually on the first day of that school, and our Covert

Operations School (COPS) requires a 2-hour block on the first day as well. Typically, we hold a minimum of 2 Criminal Enterprise classes and 2-3 COPS schools each year. Training will be per day. Total 8-9 schools each year comprised of up to at least 20 days of training each year.

5. May DPS provide the anticipated distribution of training sessions across the six regions for Year 1, so respondents can plan logistics and instructor scheduling?

Answer: Yes, we prefer to plan our classes 1 year in advance in order to accommodate other required core classes. However, there are times where shorter notice may be needed, and the training lieutenant will work with the vendor for those circumstances.

6. Section C.2.2 states DPS must approve instructors, materials, and proposed training before training begins. What is the anticipated timeline for DPS review and approval of submitted materials after contract award?

Answer: 30 days for material to be submitted and approximately an additional 30-60 days for TCOLE approvals.

7. The Mandatory Pricing Schedule requires a single per-day rate per region per year. Should this rate cover all costs for a single instructor, or is DPS expecting pricing that covers two instructors co-teaching on the same day?

Answer: Price should cover both instructors and all travel expenses. Please allot a percentage increase each year for inflation.

8. Are course materials (printed manuals, USB drives, handouts) included in the per-day rate, or does DPS anticipate a separate line item for materials?

Answer: Historically, DPS has paid for materials separately. We prefer to include this cost in the per day rate.

9. Does DPS provide the training venue and AV equipment, or is the contractor responsible for securing training locations?

Answer: DPS will provide all logistics required for training and submit all required TCOLE documents.

10. What is the minimum class size DPS anticipates per session? Is there a maximum?

Answer: That will depend on practical exercises and what the curriculum entails. Previous training included a max of 24 to review practice search warrants. Students had “homework” and instructors would review at night then debrief the next day.

11. May respondents submit references from their proposed subcontracted instructors' prior engagements in addition to (or in lieu of) references from the prime contractor's direct experience?

Answer: Preferred to have references for all instructors prime or subcontracted to base quality of training.

12. For the VPAT/Section 508 compliance documentation (Section C.2.1, item 10): Is this requirement limited to the online registration tool, or does it extend to printed course materials as well?

Answer: This only applies to the online registration tool.
