About this file

This is Addendum No. 1 to Request for Qualifications (RFQ) 2026-016 issued by the City of Waco, Texas, Purchasing Services for Section 3 Build America, Buy America (BABA) Compliance Monitoring Services. The City seeks a qualified firm to provide comprehensive compliance monitoring services for federally funded public facility improvements and housing construction projects, including pre-construction training, weekday help desk support (8:00 a.m. to 5:00 p.m.), worker training on economic opportunities, on-site assessments, benchmark reviews, reporting analysis, record keeping, and federal audit assistance. The current construction budget for related projects is estimated up to $6,000,000 with potentially up to 60 subcontractors. The contract is valued at a not-to-exceed amount of $150,000 with an option to increase over 18 months. Qualifications submissions are due May 14, 2026, at 2:00 p.m. Central Time with opening at 2:01 p.m. via Zoom. Interviews are tentatively scheduled for May 15-22, 2026, with final ranking by May 25, 2026, and award notification by June 5, 2026. The City intends to establish an annual as-needed contract with two, two-year renewal options.

Evaluation will be conducted on a 100-point technical scale assessing firm expertise and experience (maximum 50 points), personnel expertise and experience (maximum 35 points), and timeline and service delivery capability (maximum 15 points); the Project Review Committee may conduct oral interviews with top-rated firms. No Davis Bacon-Related Acts (DBRA) requirements apply to this procurement at this time. The City will not allow prime contractor subcontracting of the work. Software costs are allowable, and the City does not have software of record for managing Section 3 compliance. Submissions containing price data will be automatically disqualified, as pricing will be negotiated following qualifications evaluation. Qualified firms must be licensed or registered to practice in Texas, maintain no conflicts of interest, provide five references with at least one from the past 24 months, and carry insurance coverage including workers' compensation, commercial general liability, business automobile liability, and professional liability of at least $1,000,000.

Section 3 Build America, Buy America Compliance Monitoring Services Addendum 1, May 7, 2026

Responses to Open Questions:

Do you have a contract value for this project?

The current NTE amount is $150K, with option to increase over 18 months.

What is the construction budget?

How many subcontractors does the City anticipate for construction projects?

Is there a Davis Bacon-Related Acts (DBRA) requirement for this project? If so will this be handled under a separate solicitation?

The construction budget will vary, but currently there is potentially up to $6,000,000 in related projects.

The amount of subcontractors could be up to 60 and could be additional, depending on the project.

No, this is strictly related to Section 3. No Davis Bacon would be involved at this time.

We are only seeking Section 3 compliance monitoring at this time, but BABA could be part of the monitoring in the future.

Will the City allow the prime contractor to subcontract a portion of the proposed contract work? If so, are there any restrictions on the use of subcontractors or consultants, and what is the approval process for changes in project personnel?

• No

Should be answered in the course of describing previous experience and other projects/services provided.

Is there software of record that the City prefers for managing Section 3 compliance?• No.

If there is not a software platform already in place, are software costs allowable?

No, there is not a software in place. Software costs could be allowable.

Under Section IV “Requested Services”, subsection A Professional Services Requested (page 8 of RFQ pdf), please clarify if the City is seeking both Section 3 compliance monitoring services and BABA compliance monitoring services as they are two separate federal mandate programs.

Can the City clarify the weighting or scoring breakdown for each evaluation criterion, and specifically, which evaluation criteria categories and scoring values take precedence if there is a conflict between those listed in Section VI, subsection B (Evaluation Criteria) and subsection C (Final Selection)?

• 1. A select committee will evaluate and rank all qualification submissions. The City reserves the right to award the contract directly following this phase. 2. If initial scores are competitive, the committee may invite top-tier candidates for interviews. Scoring at this stage may utilize weighted criteria or revised standards as determined by the committee. 3. Final rankings will be based on interview performance. The highest-ranked respondent will be invited to begin contract negotiations.

Under Section VI “Evaluation of Submittals & Award of Contract”, subsection B.2.c “Timeline and overall evaluation of the firm & its ability to provide the service” (page 13 of RFQ pdf), where should proposers place this element in its RFQ response?
