About this file

This is an Addendum No. 3 to a Request for Qualifications (RFQ) issued by the Railroad Commission of Texas (RRC) for Statewide Well Plugging and Related Services across multiple Oil and Gas Division Districts. The RFQ solicits qualified contractors to perform comprehensive well plugging and abandonment services for orphaned oil, gas, and saltwater disposal wells across seven service categories: routine well plugging, deep well plugging for wells exceeding 10,000 feet, federally funded well plugging, plugging in environmentally sensitive locations, site equipment removal and remediation, emergency response well plugging, and plugging wells near surface freshwater bodies. Contractors must maintain an active Organization Report (Form P-5) with the RRC, employ or contract with an RRC-approved cementer, demonstrate successful past performance, own necessary equipment, and maintain financial solvency. RFQ responses are due February 18, 2026, at 2:00 p.m. Central Time, with written inquiries required by January 16, 2026, and Health and Safety Plan (HSP) draft submissions for courtesy review due by January 30, 2026. The initial contract term is one year, with potential extensions for up to four additional one-year renewal terms at the RRC's discretion.

The RFQ demonstrates strong commitment to Historically Underutilized Businesses (HUBs), with 221 identified potential vendors and 125 qualifying as HUBs across multiple classifications including women-owned, Hispanic-owned, African American-owned, Asian-owned, and disadvantaged veteran-owned businesses. No specific contract value is guaranteed; however, the procurement allows federal funding through Department of Interior grant dollars under the Infrastructure Investment and Jobs Act, which introduces compliance requirements including Davis-Bacon Act prevailing wage standards and Build America Buy America Act provisions. The RRC reserves the right to award multiple contracts and obtain services from various sources, allowing for a flexible procurement approach. Contractors must be prepared to handle complex environmental remediation tasks potentially including soil remediation, habitat restoration, and carbon credit acquisition.

ADDENDUM #3

DATE: 01/28/2026

RFQ: 455-26-1006

TITLE: STATEWIDE PLUGGING AND RELATED SERVICES

PROPOSAL DEADLINE: Wednesday, February 28, 2026, at 2:00 PM Central Standard Time

Item 1:

The purpose of this Addendum is to publicize submitted questions with answers:

NO.

QUESTIONS

ANSWERS

1 1) On page 18 of 32, on the chart at the top of the page, the first box on the left says:

“Attachment 5: Sample Equipment List and

Specifications and Appendix B Rate Submission

Sheet” The top box on the right (in the “Return with

Response” column) says, “Yes, Sample Equipment

List and Specifications only (TAB E)” Does this mean we should include the Sample Equipment List and Specifications in Tab E just like they appear in the RFQ, OR should it be OUR Equipment List and

Specifications only, OR BOTH the Sample

Equipment List and Specifications AND our company’s Equipment List and Specifications?

2) Our next question relates to A.9.2

Confidential Information; Public

Information Act on pages 30-31 of 32. If our response does NOT contain any information that we claim is confidential and not subject to release under the PIA that needs to be excised, blacked our, or otherwise redacted, do we still need to prepare and deliver any USB storage devices with our response?

1.

Respondents shall submit their equipment list and specifications. The Sample Equipment List and

Specifications in RFQ 455-26-1006 serve as an example for Respondents to better understand the equipment list and specifications information they must provide in their proposal for RRC review.

2.

Yes, the Respondent must submit a USB along with their proposal, regardless of whether the information is deemed confidential or not.

2. On Table 5: Response Submittal Options on page 30 of 32, it lists that responses may be submitted by email to you. Would you please give some guidelines as to how you prefer the response to be emailed?

RRC will not accept E-Mail Delivery.

See Addendum No.2 Item 3: Amend Section “A.8.

SUBMITTING THE RESPONSE TO RRC”.

3. In Attachment 10 (Federal Forms: Federally Funded

Work Orders), there is a page titled “Exhibit

B: Disclosure of Lobbying Activities, Instructions for Completion of SF-LLL, Disclosure of Lobbying

Activities” immediately followed on the next page by a form “Disclosure of Lobbying Activities.” In the top right corner of this page, it says, “Approved by OMB 0348-0046”.

My question is that since we have had NO lobbying activities in the past, none presently, nor plan to have any lobbying activities in the future, does this form

(Disclosure of Lobbying Activities) need to be filled out? If it is required to be completed, I will need guidance as to how to do so.

Yes, Attachment 10 has to be filled out and submitted with the Respondent’s proposal.

4. I need your guidance. Similar to last round of bids, Select ONLY wants to provide pricing for projects located IN THE WATER. We’re just not price competitive with the type & size equipment we have

– so only suited for the wet work – which will restrict us to work for just a couple districts…

BUT – I don’t see anything that allows us to provide bids on liftboats, spudboats, crewboats, P&A barge, etc…

The RRC seeks Statewide Well Plugging and Related

Services to be performed within RRC Oil and Gas

Division Districts throughout the state of Texas (see

RFQ Attachment 1: Appendix A) and include plugging or re-plugging of abandoned oil and gas, or saltwater disposal wells and the providing of all labor, materials, equipment, tools, incidentals, and services necessary for the RRC, as directed.

Contracts will be awarded to Respondent's deemed highly qualified Statewide Well Plugging and Related

Services Vendors who demonstrate competence, detailed credentials and meet other evaluation criteria further described within this RFQ.

5. We would like the opportunity to Bill the RRC

Directly for our services We Offer Specialty

Wireline and Fishing Services.

6. What formats are acceptable for submitting proposals, and how many copies are required?

See Addendum No.2 Item 3: Amend Section “A.8.

SUBMITTING THE RESPONSE TO RRC”.

7. What is the earliest possible date under RFQ No.

455-26-1006 that approved contractors can begin plugging for the RRC of Texas?

After September 1, 2026

8. I had a question around the applicability of alternative well plugging technologies under the current solicitation.

We understand that the RFQ and Statement of

Services reference conventional cement-based plugging methods. Our company, provides Bismuth alloy-based barrier technology, which has been successfully deployed in a range of plugging, re-plugging, and well integrity remediation

Use of such technologies will be reviewed on a case by case basis. It could be used as a supplemental service for special circumstances within existing work orders.

applications, particularly in wells where cement has shown limitations (e.g., sustained gas migration, poor annular cement integrity, or restricted access).

We wanted to ask whether technologies such as ours could be considered under this contract framework -either as an approved alternative method, a supplemental technology within a work order, or through a qualifications-based submission - provided all regulatory and performance requirements are met.

9. 1. Can you provide an anticipated bond value that will be required by Respondents who receive Contracts from RRC? (Page 50, Section 1.01)

2. Will every well assigned in a Work Order require pre/post methane emissions quantification? (Page 20, Tab B)

3. For wells that are eligible for pre/post methane emissions quantification, are GPS coordinates required to be reported along with other flow data? (Page 20, Tab B)

4. For wells that are eligible for pre/post methane emissions quantification, will an

RRC representative be required to witness the testing? (Page 20, Tab B)

1. Bonds will not be required.

2. No

3. No

4. Yes, an authorized RRC representative will be present onsite.

10. 1.) Does the RRC anticipate performing or arranging any subcontracting, or will all subcontracting be the responsibility of the contractor?

2.) If the contractor is responsible for all subcontracting, may the contractor include a percentage markup on subcontracted services?

1. Yes, it is the contractor's responsibility to obtain subcontractors as needed.

2. Percentage markups will not be accepted by RRC.

11. 1. Are proponents permitted to submit a proposed administration fee for services that are subcontracted? (Minimum

Qualifications, page 10)

2. Are there any restrictions/exclusions to administration fees for subcontracted services due to the source of funds?

(Attachment 9)

3. Will costs associated to project specific bonding be accepted by RRC as part of the

Work Order during Work Order negotiations? (Page 50, Section 1.01)

4. Will services required to complete specific scope outlined in upcoming Work Orders, but that are not listed in the Statewide Rate

Submission Sheet, be accepted by RRC during Work Order negotiations?

(Appendix B, Page 73 and 74)

1. Proponents are not permitted to submit administration fees. RRC will not accept administration fees, mark-ups, percentage increases, nor price hikes for services, equipment and/or commodities provided by the prime contractor or subcontractor for services or equipment and/or commodities provided to RRC.

2. Yes, there are restrictions. RRC will not accept administration fees, mark-ups, percentage increase, nor price hike for contracted or subcontracted services provided to RRC, regardless of funding source.

3. Bonds will not be required.

4. For services, equipment and/or commodities that fall outside of the agreed statewide rate sheet will be discussed with the authorized RRC representative

(onsite) and negotiated prior to services or equipment and/or commodities provided to RRC.

All other aspects of RFQ# 455-26-1006 remain as is.
