About this file

This document is an official response to questions filed by the Texas Comptroller of Public Accounts' State Energy Conservation Office (SECO) regarding Request for Information (RFI) No. 240i, which solicits input on developing a high-performance building evaluation system and energy efficiency performance standard for state agencies and higher education facilities. The RFI seeks feedback on potentially adopting the 2024 International Green Construction Code (IgCC) and ASHRAE 90.1-2022 standards for future design and renovation projects. SECO has extended the response deadline to January 30, 2026, to accommodate institutions affected by academic schedules and holiday closures. The document clarifies that SECO will determine whether to adopt IgCC provisions in their entirety or selectively, with final decisions informed by recommendations from an Advisory Committee and public comments. The RFI explicitly states that no Request for Proposals will be issued as a result of this information-gathering process, and the anticipated next steps involve compiling comments for Advisory Committee consideration rather than pursuing competitive procurement or contract awards.

Key clarifications provided in the responses address stakeholder concerns about the scope and implementation of proposed code standards. SECO confirmed that modifications to specific IgCC sections are permissible and that decisions regarding inclusion of 2024 IECC pathways will depend on Advisory Committee recommendations and RFI feedback. The agency also referenced previous adoption cycles, specifically the 2018 IgCC High-Performance Building Evaluation System followed by Advisory Committee recommendations dated July 2021, which are available through open records requests. No compensation will be provided to respondents for submission preparation costs, and all responses become public property of the Comptroller of Public Accounts. This RFI represents an informational initiative rather than a procurement opportunity, with no contractual obligation or vendor commitments resulting from participation.

Request for Information for a High-Performance Building Evaluation System and Energy Efficiency Performance Standard for State Agencies and Higher Education Facilities Design and Renovation Projects State Energy Conservation Office (RFI No. 240i)

Official Responses to Questions from Potential Respondents (December 29, 2025)

1. Considering that the RFI is focused on and specifically seeking input from Higher Education institutions and State Agencies, and recognizing that the current timeline overlaps with the end of the academic semester and the holiday season, which includes institutional breaks and shutdowns, would SECO be willing to extend the response deadline to allow for more comprehensive and thoughtful feedback?

RESPONSE: Please refer to Addendum No.1. SECO has extended the response deadline to January 30th, 2026.

2. Can SECO clarify if the proposal is to adopt IgCC in its entirety as a mandatory requirement for the covered buildings in addition to 90.1 or is looking to adopt/enforce specific sections (i.e., Chapter 6, Water Use Efficiency)?

RESPONSE: SECO will determine whether to adopt the 2024 IgCC in portions or in its entirety and will take recommendations from the Advisory Committee into consideration.

3. If there is interest in only specific sections, can SECO clarify what those are, or order of priority?

RESPONSE: See the response to Question #2.

4. Can SECO made modifications to sections of IgCC and adopt/enforce those for covered buildings?

RESPONSE: Yes.

5. Has SECO done a similar exercise in previous adoption cycles and if so, can you share the results or outcomes of those discussions and deliberations?

RESPONSE: SECO’s previous adoption cycle for was the 2018 IgCC High-Performance Building Evaluation System which was followed by the Advisory Committee’s recommendations dated July 2021. The recommendations are available by submitting an open records request to open.records@cpa.texas.gov or by utilizing the tools located on the website: https://comptroller.texas.gov/about/policies/open-records/.

6. Will a 2024 IECC pathway be included or only 90.1-2022?

RESPONSE: SECO will determine whether to include the 2024 IECC based on the recommendations from the Advisory Committee and the comments from this RFI.

7. Does SECO expect to publish an RFP related to this RFI?

RESPONSE: No.

8. This current RFI appears very similar to one SECO issued in 2020 (RFI No. 225j, “High Performance Building Evaluation System Using the 2018 International Green Construction Code (IgCC) for State Agencies and Institutions of Higher Education”). To our knowledge, the State did not subsequently release an RFP for services related to those code updates. Could you confirm whether an RFP was issued following the 2020 RFI? If so, who was awarded the project?

RESPONSE: RESPONSE: No RFP was issued following the 2020 RFI.

9. Could you please share what next steps the State envisions following this RFI? Specifically, does the State anticipate issuing a Request for Proposals (RFP) as a result of this process?

RESPONSE: SECO will not issue an RFP as a result of this process. The anticipated next steps are to assemble comments and to give those comments to the Advisory Committee to assist them in their recommendations.
