About this file
This document is the Terms and Conditions for state and local contract opportunities issued by the Texas Department of Criminal Justice (TDCJ). The terms and conditions apply to and become part of any bid submitted in response to TDCJ solicitations. The document establishes bidding requirements, including compliance with all applicable rules, regulations, and statutes governing purchases in the State of Texas. Bids must be time-stamped at the designated office before the hour and date specified for the bid opening, with late or unsigned bids not considered except under circumstances where the bidder has authority to bind the firm in a contract. The State reserves the right to make awards on the basis of low line item bid, low total of all items, or any other combination that serves the best interest of the State and may reject any or all bids at its sole discretion. Award decisions will be made in accordance with 34 TAC Rules 20.207(c)(2) and 20.306, considering factors including prices, bidders' previous record of performance and service, quality and conformance to specifications, and other best value factors.
Pricing for goods and services must be firm for TDCJ acceptance for 90 days from the bid opening date, with discount from list bids not acceptable unless specified in the bid. Payment shall be made thirty calendar days after the State receives an unsolicited invoice, the date services are completed, and the date all deliverables are received. Specifications require that all items be new unless otherwise specified, with manufacturer's standard warranty applying unless otherwise stated in the Invitation for Bid. The vendor must comply with multiple statutory and regulatory requirements including electronic funds transfer provisions, material safety data sheet submissions, e-accessibility standards, recycled product identification, indemnification clauses, and various certifications related to suspension and debarment, terrorism, child support compliance, and discrimination prohibitions. The document includes extensive vendor affirmation requirements, dispute resolution procedures, audit rights, intellectual property ownership provisions, and force majeure clauses, with all disputes to be resolved according to procedures outlined in Texas Administrative Code and Texas Government Code provisions.
