About this file

This document is the Terms and Conditions form for state and local contract opportunities issued by the Texas Department of Criminal Justice (TDCJ). The document establishes the bidding requirements, specifications, and delivery expectations for vendors submitting offers to TDCJ. Bidders must comply with all applicable state and federal rules and regulations and submit bids on the prescribed form with proper time stamping at the TDCJ office designated in the solicitation. Bids must be new and of current production unless otherwise specified, and all electrical items must meet applicable OSHA standards and regulations. The State reserves the right to make awards on the basis of low line item bids, low total bids, or any combination that serves the best interest of the State and the public. Awards are made in accordance with 34 TAC Rules 20.207(c)(2) and 20.306 regarding preferences. Delivery shall be made during normal working hours only unless prior approval has been obtained, with delivery timeframes specified in calendar days unless otherwise stated. Payment is made thirty calendar days after the date of the invoice, provided the goods or services are received, inspected, and accepted by TDCJ.

The pricing terms require bidders to quote F.O.B. destination with freight prepaid and allowances as specified within the solicitation specifications. No substitutions are permitted without written approval from TDCJ, and late or unsigned bids will not be considered unless circumstances beyond the bidder's control are documented. Bidders must enter their Federal Employer Identification Number and Texas Identification Number on all bid submissions. The State does not include sales tax or Federal Excise Tax in bids, and purchases made for State use are exempt from such taxes. Vendors must comply with numerous statutory requirements including the E-Verify system, suspension and debarment certifications, child support obligations, and various conflict of interest disclosures as required by Texas Government Code. Additionally, vendors must indemnify and hold harmless the State of Texas from any liability claims and comply with all applicable licensing agreements and accessibility standards as required by Texas Administrative Code Chapter 213.
