About this file

This document contains the Terms and Conditions for the Texas Department of Criminal Justice (TDCJ) for state and local contract opportunities. The terms and conditions apply to all bids submitted in response to TDCJ Invitations for Bid (IFBs) and establish the requirements for bidders, product specifications, delivery terms, inspection and testing procedures, and award criteria. Bids must comply with all applicable rules, regulations, and statutes of the State of Texas and be submitted on the designated form with proper time-stamping at the TDCJ office before the specified bid opening time. All items bid must be new unless otherwise specified in the IFB, and all electrical items must meet OSHA standards and regulations. Delivery shall occur during normal working hours only unless prior approval is obtained, and the State reserves the right to make awards on the basis of low line item bid, low total bid, or any combination that serves the best interest of the State. The award policy considers prices, bidders' previous performance and service record, quality and conformance to specifications, and any other best value factors indicated in the solicitation. Payment shall be made thirty calendar days after the invoice is received, provided that all goods have been received and the date of services completion is verified.

Bid prices should be firm for TDCJ acceptance for up to ninety days from the stated opening date, and discount bids are not acceptable unless specifically requested. Bidders must enter their Texas Identification Number or Federal Employer Identification Number and must comply with multiple certifications and compliance requirements, including E-Verify verification, suspension and debarment status, child support compliance, and various conflict of interest and boycott certifications as required by Texas Government Code. No substitutions are permitted without written approval from TDCJ Contracts and Procurement Department. The contractor must maintain a Vendor Maintenance Direct Deposit and Substitute W-9 Form for electronic funds transfer and comply with all shipping and invoicing instructions, including proper itemization with description, unit price, and unit of measure. The State is exempt from Sales Tax and Federal Excise Tax. Failure to follow shipping and invoice instructions may result in merchandise rejection and return at vendor expense without notice. The contract is subject to audit by the State Auditor's Office and the legislative audit committees, and any disputes arising under the contract shall be resolved according to the procedures for resolving contract claims and disputes under Texas Administrative Code Rule 155.31, with funds contingent upon availability of appropriated funds.
