About this file

This document is a Special Terms and Conditions file for a contract involving the Texas Commission on Environmental Quality (TCEQ), outlining the key contractual provisions. The contract is set to commence upon full execution or on September 1, 2025, whichever is later, and will terminate on August 31, 2025, unless early terminated or renewed. TCEQ reserves the option to add or subtract like items or services, including additional site locations during the contract term.

The contract requires the vendor to maintain commercial general liability insurance and worker's compensation coverage when performing work on TCEQ premises. Pricing must remain firm for the initial contract term, and the vendor is obligated to exercise reasonable care for TCEQ equipment, potentially being required to replace or reimburse for any lost or damaged equipment. The insurance provisions include naming TCEQ and its officers as additional insureds to the Commercial General Liability Insurance and include a waiver of subrogation in favor of TCEQ for any bodily injury, property damage, or other losses arising from the contract.
