About this file

This is a Request for Offer (RFO) issued by the Texas Commission on Environmental Quality (TCEQ) for the Texas Information Management System (TIMS), involving the Texas Department of Public Safety (DPS), Texas Department of Motor Vehicles (TxDMV), and emissions testing stations across multiple Texas counties. The solicitation seeks a contractor to establish a telecommunications network and centralized database system to support real-time and batch electronic transmission of vehicle exhaust emissions inspection data. The RFO covers the Dallas-Fort Worth, Houston-Galveston-Brazoria, El Paso, Austin-Round Rock, and San Antonio areas, with responses due on October 14, 2025, and a pre-proposal conference scheduled for September 22, 2025. The contract period runs from the last signature date to August 31, 2031, with three distinct phases: Design and Integration (by May 3, 2026), Beta/Rollout (by July 30, 2026), and Operating Phase.

The contract anticipates no direct payments from the state, with the contractor recovering costs through per-transaction charges billed to emissions testing stations, not to exceed $0.36 per transaction. The contractor is responsible for developing and maintaining the entire system infrastructure, including telecommunications network, centralized database, application software, and help desk services. The system must support electronic communications between test analyzer systems and the Vehicle Information Database (VID), handle real-time and batch transmissions, and provide reporting capabilities for TCEQ, DPS, and TxDMV. The contractor must obtain TX-RAMP Level 2 certification prior to contract award and maintain an average system availability of 99.95%. Additional programming services are included, with up to 6,000 hours in the first operating year and 4,000 hours annually thereafter at no cost to TCEQ.

Selection

Depending on the applicable procurement method and solicitation type, in order to secure the best value for the State, TCEQ may take one or more of the following actions in the selection process:

• Accept the highest scoring Response without changes.

• Request clarifications, assurances, and corrections.

• Modify the selection criteria and apply it to BAFOs, provided that the modifications do not materially affect initial applicant eligibility or invitation to submit a BAFO. Conduct discussions on Responses scoring within a competitive range and request Best and Final Offers (BAFOs).

• Select the highest scoring BAFO and accept it without changes or negotiate acceptable terms.

• Award one or more contracts based on the amount of work that TCEQ foresees needing performed.

• Award contracts to other contractors at a later date under this Solicitation or through another appropriate method, including another solicitation.

• In the case of a tie that cannot be resolved by application of one or more statutory preferences, make a selection, in the best interest of the State, by drawing lots, tossing a coin, or drawing names with two witnesses to oversee the tiebreaking activity.

Certification of Interested Parties

Section 2252.908 of the Texas Government Code states that a state agency may not enter into certain contracts with a business entity unless the business entity submits a disclosure of interested parties (Form 1295) to the state agency at the time the business entity submits the signed contract to the state agency. The contract is voidable if the business entity fails to provide the disclosure of interested parties as required by statute.

Form 1295 must be filed electronically through the Texas Ethics Commission at https://www.ethics.state.tx.us/filinginfo/1295/ . The web site includes a list of Frequently Asked Questions.

The selected vendor(s) for a contract that meet the requirements to provide a Certification of Interested Parties will be given instructions at the time of award on how to submit the certification form.

Protest Procedures

An actual or prospective Responder or Contractor who is aggrieved in connection with the Solicitation, evaluation, or award of a contract by TCEQ may formally protest to the TCEQ Manager of Procurements and Contracts. TCEQ Protest Procedures can be found at 30 Texas Administrative Code Part 1, Chapter 11, Subchapter B, § 11.2.

SECTION 1: INTRODUCTION AND OVERVIEW OF REQUIREMENTS

1.1 PURPOSE OF THIS REQUEST

The purpose of this Request for Offer (RFO) is to select a Contractor to establish an Information and Data Management System, referred to as the “TIMS” or “system,” to support real-time and batch electronic transmission of motor vehicle information and test results to and from the test analyzer systems (TASs), as well as inquiries from the Texas Commission on Environmental Quality (TCEQ), the Texas Department of Public Safety (DPS), the Texas Department of Motor Vehicles (TxDMV), and local law enforcement agencies.

This Contract anticipates there will be no payments made by the State to the Contractor for services obtained under the Contract. The total price, including profit, for performance of the Contract will be billed back to the testing stations on a charge-per-transaction basis. The Texas Inspection and Maintenance (I/M) program requires an emissions test for gasoline-fueled, two through twenty-four year-old vehicles registered and primarily operated within an I/M program area. Vehicles that are commuting into the program areas on a routine basis and are registered in the counties adjacent to the I/M program counties may be incorporated by remote sensing, and thereby become subject to testing. The I/M program areas are the Dallas-Fort Worth area (Collin, Dallas, Denton, Ellis, Johnson, Kaufman, Parker, Rockwall, and Tarrant Counties), the Houston-Galveston-Brazoria area (Brazoria, Fort Bend, Galveston, Harris, and Montgomery Counties), the El Paso area (El Paso County), and the Austin-Round Rock area (Travis and Williamson Counties). The San Antonio area (Bexar County) will be added to the I/M program beginning November 1, 2026. The Contractor shall be responsible for creating and managing the Texas Information and Management System (TIMS) for the I/M program, including: the integration of the current database containing vehicle safety and emissions testing data; real-time transmission of motor vehicle information; and safety and emissions test information, reports, and ad hoc queries of the database. In addition, the Contractor shall be responsible for the development of various software applications that assist in inspection station and inspector administration, meeting U.S. Environmental Protection Agency (EPA) and state reporting requirements, identifying potentially fraudulent stations and/or inspectors (Triggers), identifying motorists who do not comply with the I/M program (registration denial element), and managing covert and overt auditing of inspectors and emissions testing stations.

1.2 DEFINITIONS AND ACRONYMS

The terms in this document shall have the meaning commonly ascribed to them unless specifically defined otherwise. The following defined references will be used throughout this solicitation and any contract:

Acceptance – Acceptance or approval of the system and completion of each project phase shall be made in writing only by the authorized TCEQ agent.

Annual – Occurring each year.

Application Software – Software designed to fulfill specific needs of a user.

ASM – Acceleration Simulation Mode. An emissions testing system that approximates mass emissions via pollutant concentration measurements during several steady-state modes using a dynamometer.

SECTION 2: INTRODUCTION TO THE INFORMATION MANAGEMENT SYSTEM

2.1 INTRODUCTION

This RFO outlines the requirements for an Information and Data Management System to support real-time and batch electronic transmission to and from TASs located throughout Texas to the central database maintained by the Contractor. The intent of this RFO is designed to take advantage of functional capabilities of OBD inspection equipment to validate vehicle identification, to electronically transmit inspection results via a telecommunications network, and to improve and more closely monitor the performance of the I/M program.

The primary operational objective of the TIMS is to facilitate real-time electronic transmission of emissions testing results, to enable immediate update of motor vehicle information, and to provide immediate access to critical management and enforcement data. In addition, the Contractor is responsible for the development of various software applications for the TIMS that assist in station and inspector administration, EPA and State reporting, identifying potentially fraudulent stations and/or inspectors (Triggers), identifying motorists who do not comply with the I/M program (registration denial element), and managing covert and overt auditing of inspectors and emissions testing stations. The Contractor shall also be responsible for the development and maintenance of the hardware and hosting this system. The Contractor is required to support the electronic collection of data from fixed and remote sites and the processing and analysis of that data to identify emissions testing stations and vehicles that are not in compliance with State laws.

Additionally, the Contractor must:

• provide on-line inspection as well as TSBs and manufacturer’s recall information to all emissions testing stations in a manner that will assist “test-and-repair,” “test-only,” and “recognized repair” facilities in maximizing mobile source emissions reductions and achieving cost-effective vehicle repairs; and

• create a flexible, responsive system environment that allows the Contractor, TCEQ (including TCEQ authorized entities), DPS, and TxDMV to obtain immediate access to inspection data for program performance auditing; to detect and resolve potential problems at the inspection and/or repair site; to process and monitor both inspection site and vehicle-specific data for assistance in the reduction or elimination of fraud that dilutes the effectiveness of the I/M program; and to verify vehicle status.

2.2 OBJECTIVES OF THE SYSTEM

The primary TIMS objectives are to:

• electronically transmit all emissions test, calibration, and analyzer repair and maintenance records from TASs to the VID;

• provide on-line inspection, waiver, diagnostic, and repair information to assist emissions testing stations in maximizing mobile source emissions reductions and cost-effective vehicle repairs;

• maximize the matching of test results with the appropriate vehicle record in the VID by creating a more accurate vehicle database;

TEXAS COMMISSION ON

Page 28 of 179 Request for Offer: 582-26-00018

• transmit vehicle history to the TAS, and, where the vehicle’s most recent result is a failed test, enable the TAS to automatically set testing parameters for a “Re-inspection” test mode and alert technician to the “Failed” status;

• store and manipulate data from inspections, including the processing and tracking of citations;

• prohibit unauthorized emissions tests;

• prohibit unauthorized access to the system; and

• collect, process, and analyze data, including:

support enforcement programs that are directed toward eliminating fraud and noncompliance in the performance of emission-related inspections and repairs;

facilitate the development of vehicle emissions performance profiles and diagnostic information; and support the vehicle registration denial element by identifying motorists who do not comply with the I/M program.

2.3 TIMS REQUIREMENTS

The Contractor shall be fully responsible for providing and maintaining hardware, software, communications interface, application development, and ongoing service support. The system must handle transmissions from fixed and remote sources and must demonstrate flexibility to support new application development and expanded database requirements.

The system includes the establishment of a telecommunications network and a centralized VID. The database system shall be housed and operated within a computer system run by the Contractor. The host for the primary and back-up VIDs and the “Help Desk” services must be located in the United States. The VID system shall:

• incorporate and maintain specified vehicle data from the TxDMV files;

• incorporate emissions…
