SECTION 2

SCOPE OF WORK AND EVALUATION CRITERIA

582-26-00024 Scientific Expertise and Research Services Page 15 of 93

SCOPE OF WORK

I. BACKGROUND

The mission of Texas Commission on Environmental Quality (TCEQ) is to protect public health and natural resources in Texas consistent with sustainable economic development. The goal is clean air, clean water, and the safe management of waste.

To accomplish this, TCEQ bases decisions on the law, common sense, sound science, and fiscal responsibility. To help facilitate TCEQ’s mission through sound science, there is a need to utilize scientific expertise outside of the agency. Such expertise is invaluable to provide state-of-the-science methods for determining chemical risk, for setting safe levels of chemicals in the environment, and for evaluating the work of other agencies. Those activities, in turn, provide benefits for TCEQ’s toxicology, permitting, air monitoring, remediation, and compliance programs, among others.

TOXICITY FACTOR DERIVATION

Toxicity factors are chemical-specific short- and long-term health- and welfare-based concentrations or doses that are set to protect human health and welfare (odor and vegetation effects), including susceptible subgroups. TCEQ staff prepares chemical-specific Development Support Documents (DSDs) that outline the hazard assessment and dose-response processes used to derive chemical-specific inhalation or oral toxicity factors. The toxicity factors are developed using RG-442 “Guidelines to Develop Toxicity Factors” (TCEQ, 2015) (hereafter referred as RG-442 Guidelines).1

Inhalation toxicity factors derived by TCEQ include reference values (ReVs), effects screening levels (ESLs), and unit risk factors (URFs). Health-based ESLs are calculated from ReVs and URFs. Air monitoring comparison value (AMCV) is a collective term for all chemical-specific short- and long-term air concentrations that are used to evaluate air monitoring data (consisting of ReVs and ESLs). Both ESLs and AMCVs are chemical-specific ambient air concentrations set to protect human health and welfare. Short-term ESLs and AMCVs are based on data concerning acute health effects, odor potential, and vegetation effects, while long-term ESLs or AMCVs are generally based on data concerning chronic noncarcinogenic or carcinogenic health effects, or both, and occasionally on long-term vegetation effects.

ESLs are used in the evaluation of air permit applications as well as proposed rules and regulations (e.g., Permits by Rule). AMCVs are used in the evaluation of air monitoring data. TCEQ also derives oral toxicity factors that are used in the development of protective concentration levels (PCLs) to establish cleanup levels for remediation sites and in the development of thresholds protective of human health for application to surface water.

Derivation of these chemical-specific toxicity factors involves systematic review, hazard assessment, and dose-response analyses. TCEQ is seeking a Contractor

1 https://www.tceq.texas.gov/downloads/toxicology/publications/rg-442.pdf

582-26-00024 Scientific Expertise and Research Services Page 16 of 93 with expert knowledge in methods for development of toxicity factors and systematic review.

COMMENTS ON FEDERAL RULES

TCEQ reviews and provides public comments on documents released by the US government as part of federal rulemaking, and TCEQ gets only a brief window of time in which to prepare these comments. TCEQ most often provides comments on US Environmental Protection Agency (USEPA) rulemaking documents, including for the National Ambient Air Quality Standards (NAAQS). Because TCEQ and the State of Texas are impacted by the USEPA’s rules, it is important that those rules are based on rigorous and objective review of the available scientific evidence. There are still significant gaps in knowledge in some of the science used as the basis for federal rules, such as in evidence integration, interpretation of epidemiology study results, and risk modeling. TCEQ is seeking a Contractor with expert knowledge in areas such as causality determinations, risk assessment methodologies, and epidemiology.

CHEMICAL RISK ASSESSMENT

Chemical risk assessment is a process for evaluation of risks to defined populations caused by chemicals in different media. Chemical risk assessment includes identification of hazards, determination of the dose-response between the chemical and the effect, evaluation of the exposure to the chemical, and integration of this information to estimate the risk from the chemical. The conclusions from these risk assessments are used by risk managers at TCEQ to make decisions about protection of public health and the environment. Often the concerns of citizens and legislators about risk from exposure to chemicals in the environment will come down to decisions in, or conclusions from, chemical risk assessments.

Application of chemical risk assessment at remediation sites is one example where chemicals of concern (COCs) are evaluated in air, water, and soil to aid in risk management decisions. Another area of active work in the risk assessment field is the choice of appropriate chemical hazard and dose-response determinations. This includes determinations for many chemicals present in water, such as disinfection byproducts, heavy metals such as lead, and chemicals that are typically regulated to prevent unpleasant odor or taste (such as sulfates) but that may also have health effects at high enough concentrations.

Some of the open questions about a chemical’s’ risk can be addressed with a thorough review of the literature and analysis of available knowledge. Other questions require development of new methods of risk assessment itself to address problems that cannot be solved with current methodologies. To address the considerations of data review and risk assessment method development, TCEQ is seeking scientific expertise to pursue research that advances the science of risk assessment.

II. DESCRIPTION OF WORK

Work will be proposed in written Work Orders to which the Contractor will respond with a Work Order Budget and, if required by the Work Order, a written Work Plan. All Work must be completed by the Work Order expiration date. The

582-26-00024 Scientific Expertise and Research Services Page 17 of 93

Work Order process is defined in the Procedures for Work Orders Section.

A. Contractor must provide specialized toxicological, modeling, risk assessment, or epidemiological analyses to assist TCEQ, as well as to pursue research that advances the science of risk assessment. The goal of the resulting contract is as follows:

• to assist TCEQ in providing the necessary data to help answer questions posed by stakeholders such as concerned citizens, legislators, and the scientific community;

• to assist TCEQ in the development of toxicity factors, in writing comments for federal rulemakings, and in conducting risk assessments;

• to advance knowledge and methods in these fields; and

• to assist in organization of data for analysis. To accomplish this goal, TCEQ is seeking additional scientific experts in subjects such as: water quality, systematic review, dose-response modeling, epidemiology, the Texas Risk Reduction Program (TRRP), physiologically-based pharmacokinetic (PBPK) modeling, and associated software programs such as R, Microsoft Access, or SAS.

B. The Contractor shall provide scientific expertise for support of, and interaction with, TCEQ scientists. At the discretion of TCEQ, activities described below may be included in any or all Work Orders, in whole or in part:

• Specialized analyses in toxicity factor derivation, which may include assistance with or method development of systematic reviews, hazard identification, dose-response analyses, advanced mathematical modeling, or analysis of epidemiology studies.

• Drafting comments on regulatory documents, particularly on portions of the documents related to causality, risk assessment methodologies, and epidemiology study analyses.

• Performing advanced statistical analyses of toxicological or epidemiological data, which may require the use of specialized software.

• Review and synthesis of chemical-specific literature.

• Conducting original research in the areas outlined in bullets 1-3.

• Contributing to writing and publishing of the Work performed under this contract.

• Provide training to TCEQ staff in areas where TCEQ staff may lack expertise, such as epidemiological assessments or statistical analysis of toxicological or epidemiological data. The Contractor will develop original work to address the above areas of interest.

Contractor shall assess or conduct systematic reviews, literature reviews, document reviews, statistical analyses, database development, risk assessments, and other related activities. This may involve researching and presenting background information on risk assessment of chemicals of concern, toxicity factor derivation, or advanced statistical analysis of toxicological and epidemiological data. Contractor may be required to produce Work within a short time frame (e.g., 30 days).

4. TECHNICAL APPROACH TO PERFORMING THE SCOPE OF WORK (35

POINTS);

Place information behind TAB 5 of the Response.

Following are four (4) example work orders that represent the types of Activities that TCEQ anticipates the Respondent may complete as separate Work Orders under the umbrella contract. Respondents shall submit a Work Plan and Work Order Budget that demonstrates the Technical Approach for each of the four (4) Example Work Orders for Evaluation. Each Work Plan should be formatted as described in the Procedures for Work Orders section of the Sample Contract. Use the line items from the Budget in Attachment B: Work Order Budget to break out the various costs. For- profit organizations do not need to break out the profit in the Budget as it is understood to be included in each of the Price/Cost amounts.

1. Example Work Order 1: Use of probabilistic risk methods in toxicity factor development.

a. Background TCEQ’s Guidelines to Derive Toxicity Factors outlines methods for deriving levels of chemicals in the environment that confer no or minimal human health risk from exposure. A subset of these values are based on chemicals and health effects that are assumed to have a threshold dose-response, meaning that there are concentrations/doses that confer no increased risk from exposure. To provide protection against these chemicals/health effects, TCEQ derives reference values (reference concentrations (RfCs) or reference doses (RfDs) that are set at levels that will confer no increased risk with exposure. These reference values are single, deterministic values that provide assurance of safety if measured concentrations are below the value, but they provide no information about risks if concentrations are above the value. To provide more information about chemical risk, probabilistic methods can be used that provide a continuum of risk, rather than a single deterministic value.

Such probabilistic reference values help provide…
