About this file
This is a Warranty and Complaint Resolution Form (Exhibit #2) for the Texas Health and Human Services Commission's procurement of snacks and candy for Rusk State Hospital under IFB 529-HHS0016490v2. The contract term runs from September 1, 2025, through August 31, 2026, with renewal options available. This signed agreement must be submitted with the bid and establishes warranty and complaint resolution requirements for contractors providing local groceries to the facility.
The form requires contractors to guarantee product compliance with all contractual requirements and commit to resolving complaints within 90 days of notification. Associated costs for complaint investigations include storage costs beginning on the 10th day after vendor notification, HHSC employee costs at $20/hour starting 30 days after notification, sample and shipping costs, and third-party laboratory testing at AMS or FSIS approved facilities. If any portion of a delivered product is found non-specification, the entire shipment must be reimbursed or replaced by the vendor regardless of production run dates. Vendors must respond to problems within 72 hours of HHSC notification, and unacceptable responses or failure to meet resolution timeframes will result in vendor tracking reports and discontinuation of HHSC food awards to both the vendor and manufacturer.
