About this file

This document is an Attachment A for Artificial Intelligence requirements for the Texas Department of Transportation (TxDOT) under Solicitation No. 601440000047108. The attachment outlines comprehensive requirements for vendors proposing AI technologies or solutions to TxDOT, mandating detailed explanations of AI functionalities, including specific actions, outputs, deployment strategies, and operational characteristics. Vendors must provide explicit documentation about their AI systems, covering aspects such as decision-making processes, data utilization, potential biases, reliability assessments, and human-in-the-loop involvement.

The attachment establishes strict guidelines for AI implementation, requiring vendors to notify TxDOT 45 days prior to introducing any new AI functionality or making changes to existing systems. TxDOT reserves the right to cancel the contract without penalty if proposed AI technologies do not comply with their Acceptable Artificial Intelligence policy. The document also provides precise definitions for key terms like Artificial Intelligence, AI Systems, Information Resources Technologies, and Human-in-the-Loop decision making, with specific emphasis on how data is defined, collected, and maintained within the TxDOT ecosystem.

Attachment A - Artificial Intelligence Solicitation No. 601440000047108

1 – 2

1. Artificial Intelligence (AI):

1.1. Vendor must provide a detailed explanation of all AI, whether proprietary or publicly available, that may be used in the delivery of technology solutions and/or services.

This explanation must include, but is not limited to, the following:

1.1.1. The specific actions and outputs generated by the AI (decisions/output).

1.1.2. A description of what the AI functionality recommends, decides, documents, reports, or affects when deployed.

1.1.3. An overview of how the AI functionality is utilized within the solution.

1.1.4. Clarification on whether the AI functionality is optional or mandatory.

1.1.5. Information on the presence of Human-in-the-loop (HITL) involvement.

1.1.6. The types of data being utilized by the AI.

1.1.7. The classification and categorization of the data being used.

1.1.8. Details on the handling of data, including if it is being transferred outside of TxDOT, used to train an AI model, etc.

1.1.9. Measures taken to mitigate biases and hallucinations within the AI model.

1.1.10. An assessment of the reliability of the AI algorithms and models deployed.

1.1.11. Strategies for handling unexpected inputs and edge cases.

1.2. During the term of the contract, if any changes occur where new AI will be introduced, or the AI functionality originally submitted by the vendor will change. The vendor must send notification a minimum of 45 days prior to implementing any changes to existing or new AI functionality to TxDOT for review by TxDOT to ensure compliance with TxDOT’s policy for Acceptable Artificial Intelligence. TxDOT reserves right to cancel the contract without penalty if any AI functionality will not comply with TxDOT’s policy for Acceptable Artificial Intelligence.

1.3. AI is defined as:

1.3.1. Artificial Intelligence (AI) – A machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations, or decisions influencing real or virtual environments.

2 – 2

1.3.2. Artificial Intelligence (AI) System– Any application that contains an AI component regardless of size or usage.

1.3.3. Information Resources Technologies (IRT) – Data processing and telecommunications hardware, software, services, supplies, personnel, facility resources, maintenance, and training. [Source: Texas Government Code, Chapter 2054.003]

1.3.4. Human-in-the-Loop (HITL) decision making - Human-in-the-loop decision making involves a human decision-maker working in tandem with AI to improve decision making outcomes. In HITL systems, the AI system provides input, recommendations, or predictions that the human decision-maker evaluates and approves or rejects.

1.3.5. TxDOT Data – As defined by TxDOT Data Classification Policy, is information that is written, produced, collected, assembled, or maintained under a law or ordinance or in connection with the transaction of official business:

1.3.5.1. by TxDOT;

1.3.5.2. for TxDOT where TxDOT owns the information, has the right of access to the information, or spends or contributes public money for the purpose of writing, producing, collecting assembling, or maintaining the information; or

1.3.5.3. By an officer or employee of TxDOT in the officer or employee’s official capacity and pertains to official business of the government body.

1.3.5.4. has context menu.
