2.0 STATEMENT OF WORK
2.1 CII FORM REQUIREMENTS
2.1.1 Form Size and Format
2.1.1.a The awarded vendor must be able to produce CII Prescription Forms in their current design and format to prevent confusion regarding authorized prescriptions.
2.1.1.b The minimum order quantity is to be one (1) pad consisting of fifty (50) prescription forms. All prescriptions must be distributed in sets of fifty (50) prescription forms.
2.1.1.c Pads will consist of forms grouped in a stack with control numbers running from low to high. Forms are to be bound in such a manner to allow the forms to remain securely in the pad until use and to remain intact on removal. Pads will include a cover for front and back of a stock to be agreed upon by vendor and TSBP. Prescription forms are to be 4 ¼” x 5 ½”. Pads will include instructions to the prescriber for use of pads. Pads will also include instructions for re-ordering pads. All instructions will be provided by TSBP. Instructions are subject to change at any time by TSBP. The prescription pad and its packaging must not contain information concerning any pharmaceutical product or other advertising or solicitation unless expressly approved by TSBP. Any changes must have prior approval from TSBP.
2.1.2 Printed Security Features
The prescription form shall incorporate the following security features:
a) The prescription form will contain a blue overlay that will void itself when copied by means of a hidden word feature.
b) The ink will bind to the paper so that toner cannot be lifted without damaging the prescription form.
c) Each prescription form will have a control number in a format determined by TSBP imaged or printed variably, in a horizontal direction. TSBP will determine the format of the control number.
d) Each prescription form will incorporate a State of Texas seal as a background image.
e) Each prescription form will include a thermochromic ink feature as indicated on current prescriptions to validate its legitimacy.
f) Each prescription form will void itself if chemicals are used to modify any writing on the prescription.
g) Each prescription form will include bar code(s) that contain data fields mutually agreed upon by the vendor and TSBP, including but not limited to: prescriber DEA number, control number, license number, or other numbers to be used in verification of prescriptions.
h) Each prescription will include a watermark image within the body of the paper that cannot be copied, duplicated, or scanned.
2.1.3 Sample Evaluation
2.1.3.a Proposers must provide samples of a prescription pad to include all of the security features described in Section 2.1.2.
2.1.3.b Due to the highly sensitive nature of this work, a PDF file to print the sample pad will only be provided on request. Proposers are only authorized to print samples for purposes of this RFP.
The point-of-contact for PDF print files is:
David Hardy, CTCD, CTCM 1801 Congress Ave., Ste. 13.100 Austin, TX 78701 Phone: 512-305-8023 Fax: 512-305-8075 E-mail: david.hardy@pharmacy.texas.gov

2.2 DELIVERY OF PADS
2.2.1 Turnaround
2.2.1.a Contracted vendor must be able to provide routine production and distribution of pads at least three (3) to five (5) times per week. Production and distribution of prescription pads must be completed in three (3) business days or less from the date the relevant order file was made available to the vendor. Total turnaround time from receipt of order to delivery to prescriber is to be no more than ten (10) days, exclusive of holidays and weekends.
2.2.1.b Emergency prescription pad orders, identified as such by TSBP, must be produced and distributed within twenty-four (24) hours of receipt of order from TSBP.
2.2.1.c Deliveries must be signed for by the prescriber. No deliveries are to be scheduled for weekends. Awarded vendor is required to provide all possible cooperation in ensuring deliveries are made on working days.
2.2.2 Packaging Security
2.2.2.a Prescription pads must be produced and packed in order of the date received. The orders may vary in quantity. Prescription pads must be mailed in a container of sufficient size and strength to provide safe transport of the goods. Prescription pads are to be shipped FOB destination. The prescription pad and its packaging must not contain information concerning any pharmaceutical product or other advertising or solicitation unless expressly approved by TSBP.
2.2.2.b Pads must be shipped so that the pads are not visible or otherwise identifiable as prescription pads from the outside of the package. Shipping labels should only contain the prescriber’s name, address, and other information required to make a timely delivery (i.e. it should not show DEA numbers, license numbers, or similar sensitive information).
2.2.3 Delivery Service
2.2.3.a TSBP requires that vendor distribute prescription pads in a verifiable manner. Vendor may use certified mail, delivery confirmation, USPS signature verifying receipt, or other similar service. Proof of delivery must be provided to TSBP upon request. See Sec. 2.2.1.c for Restrictions on delivery days.
2.2.3.b Deliveries are Free On Board Destination. The awarded vendor will pay costs for lost or stolen deliveries.
2.2.4 Loss Recovery Evaluation
Proposers must outline what steps will be taken to recover and trace lost shipments. Responses to this section of this RFP will be evaluated. Maximum possible score: 20 points.
2.3 GENERAL SECURITY
2.3.1 Data
TSBP will provide to the vendor an electronic order file containing data for the production of prescription forms. Order files will be provided daily, on each business day. Order files will include the prescriber’s name, DEA number, address, city, state, zip code, phone number, and a unique prescription control number for each set of pads. Vendor will receive order files by secure FTP.
2.3.2 Control Numbers
The unique prescription control number for each set of forms will be in a format to be determined by TSBP and communicated separately from this SOW. In order to prevent counterfeiting of RX pads, the format is to remain confidential between TSBP and authorized vendors. The vendor will only transmit control numbers of printed pads to recipients authorized by TSBP to receive the information.
2.3.3 File Maintenance
2.3.3.a The vendor must maintain files containing control numbers and the DEA number of the ordering party. These files are to be transmitted regularly to TSBP’s selected Prescription Monitoring Program vendor.
2.3.3.b Vendor must maintain a file containing prescription form production information. The file should contain, at a minimum, the date the order file was received from TSBP, the date the forms were printed, the date the forms were shipped to the prescriber, and the tracking information for the order (if applicable). The file must be maintained one (1) year from the date the order was received by the vendor and made available to TSBP on request.
2.3.4 Physical Security Requirements
2.3.4.a Due to the highly sensitive nature of controlled substance prescription pads every effort must be taken to prevent theft, diversion, and counterfeiting.
2.3.4.b The production facility must have restricted access. TSBP reserves the right to require background checks on any individual involved in the production of prescription forms. TSBP reserves the right to audit vendor’s security measures, including by visitation, without prior notice. For disaster recovery purposes, a second facility must have the capability of undertaking this work.
2.3.4.c All data associated with production of prescription forms (prescriber information, form design, control numbers, etc.) will remain the property of TSBP at all times and shall not under any circumstances be divulged to other parties. Vendor may not use data for any purpose not specified in writing by TSBP. Vendor’s personnel shall have access to the data and the prescription forms only when necessary to process prescription orders.
2.3.5 Plant Security Evaluation

c) Access to data files.
d) Oversight of printing.
