About this file

This document is Addendum Number 1 for a Request for Qualification (RFQ) Solicitation 582-25-00013 issued by the Texas Commission on Environmental Quality (TCEQ) for an Emergency Action Plan. The addendum, dated May 2, 2025, provides additional information about a confidentiality requirement, specifically adding a new Special Term and Condition 13 that requires contractors to complete a Non-Disclosure Agreement (NDA) upon contract award. Responses are due by May 27, 2025, no later than 3:00 PM Central Time. The addendum includes Attachment D, a Confidentiality and Non-Disclosure Agreement that outlines the terms for handling confidential information, with specific provisions about protecting sensitive data related to dams, spillways, safety records, structural plans, and inspection reports.

The NDA emphasizes that contractors must not disclose confidential information without prior written authorization from TCEQ, and must take all necessary steps to protect the secrecy of the information. The agreement remains binding until the confidential information is no longer deemed confidential by the State of Texas, and violations may result in cancellation of the contractor's access to the information. The document is governed by Texas state law and includes provisions for severability and non-continuing waivers. While the addendum does not provide specific financial details, it reinforces the strict confidentiality requirements for potential contractors working on the Emergency Action Plan project.
