About this file

This is Addendum No. 1 to RFP No. 0719-LP issued by the Texas General Land Office (GLO) for Coastal Construction Services related to the Old Queen Isabella Causeway Removal & Artificial Reef Construction project in Cameron County, Texas. The project involves marine demolition and removal of old causeway bridge components including concrete pile caps, pilings, railings, and deck spans, along with subsurface debris removal and sediment screening. The removed structures and concrete debris will be used to construct an artificial reef approximately 10.1 miles offshore from the Brownsville Ship Channel entrance jetties. The RFP was released on December 5, 2024, with responses due by February 7, 2025, at 2:00 p.m. CT.

The addendum clarifies several key points, including setting the liquidated damages rate at $500 per day (reduced from the originally stated $1,000) for failure to achieve substantial completion within the contract time. It also specifies that all debris within the limits prescribed by the Before Demolition Causeway Survey must be removed from the bay bottom, whether existing prior to or resulting from demolition work. While contractors are not required to backfill voids generated by pile removal, they are encouraged to use existing submerged sediments for backfilling where practicable. The addendum must be acknowledged by respondents by returning a signed copy with their solicitation response.

Texas General Land Office -2- RFP No. 0719-LP Addendum No. 1

RFP 0719-LP Questions and Answers

Question 1: 2.5 Liquidated Damages “If Contractor fails to achieve Substantial Completion within the Contract Time, Contractor shall be liable to the GLO for liquidated damages of $500.00 per day until the Contractor achieves Substantial Completion. The GLO’s damages for Contractor’s failure to perform its obligations under a contract resulting from this RFP are impossible or difficult to estimate and the amount of liquidated damages specified is a reasonable forecast of just compensation and is not a penalty.”

Exhibit B, 2.01(d) “Liquidated Damages: If Contractor fails to achieve Substantial Completion of the Project within the Contract Time, Contractor shall be liable to the GLO for liquidated damages of $1,000.00 per day until the Contractor achieves Substantial Completion of the Project. The Parties agree that: the GLO’s damages for Contractor’s failure to perform its obligations under this Contract are impossible or difficult to estimate;

and the amount of liquidated damages specified herein is a reasonable forecast of just compensation and is not a penalty.”

Which of these values will be used for liquidated damages?

Answer 1: Contractor shall be liable to the GLO for liquidated damages of $500.00 per day until the Contractor achieves Substantial Completion.

Question 2: 2.1 Scope of Services Requested “The Contractor shall perform all services required to complete the Project in accordance with the Project Manual, which includes furnishing all plant, equipment, labor, transportation, fuel, power, lighting, water to perform the work, in addition to any incidental related work, in strict accordance with Project Manual specifications for: marine demolition and removal of old causeway bridge concrete pile caps, concrete pilings, concrete railings, and concrete deck spans; removal of subsurface causeway debris and screening of said debris and sediment; backfilling screened sediment within the work area limits; and placement of removed structures and concrete debris from the work area to construct an artificial reef approximately 10.1 miles offshore from the Brownsville Ship Channel entrance jetties as shown in the Project Manual.”

Does “removal of subsurface causeway debris” include any debris that is present prior to our arrival on site or that is identified in our initial survey, or does this refer solely to debris created during demolition?

Answer 2: All debris within the limits prescribed by the Before Demolition Causeway Survey, existing prior to or resulting from the Contractor’s work to demolish the causeway, shall be removed from the bay bottom.

Question 3: Will Contractor be required to fill in the voids left after removing piles, or is the requirement simply to redistribute the sediment “within the work area limits” not exceeding 2 feet above preexisting levels?

Texas General Land Office -3- RFP No. 0719-LP Addendum No. 1

Answer 3: The Contractor is not required to backfill voids generated by pile removal; however, backfilling using existing submerged sediments, to the extent practicable, is encouraged.
