About this file

This is Addendum No. 1 to a Request for Qualifications (RFQ) issued by The Texas State University System for professional engineering services related to the Lake Ament Dam Alteration project in Terlingua, Texas. The addendum includes responses to questions from a pre-submittal conference held on December 3, 2024, along with detailed site photographs and technical specifications of the existing dam structure. The project involves engineering services for a rock masonry dam that is 125 feet long, 56 feet high, with a 12-foot top width, originally constructed in the 1910s. Key dates include a question submission deadline of December 10, 2024, at 12:00 p.m. CST and a qualification submittal deadline of January 7, 2025. Site visits during construction will be required at least monthly.

The construction cost limitation is set at $900,000, which covers only construction and demolition costs, not engineering fees. The project includes a HUB (Historically Underutilized Business) requirement where the selected firm must demonstrate good faith efforts to allocate 20% of engineering services to qualified HUB consultants. The dam is classified as "Intermediate" size with a "High" hazard classification by TCEQ, and currently shows multiple structural issues including cracks in both upstream and downstream faces noted in a 2016 TCEQ Dam Safety Inspection Report. The dam's current specifications include a normal pool elevation between 3543.7 feet (low-water mark) and 3551.0 feet (high-water mark), with a surface area ranging from 4.4 to 12.8 acres and a capacity between 16.4 and 76.7 acre-feet.

I. GENERAL:

A. The optional Pre-Submittal Conference was held on December 3, 2024, at The Texas State University System office in Austin, Texas and virtually. The Attendance Sign-In Sheets for in-person attendees are included as part of this Addendum along with the questions and answers presented in response to this solicitation as of December 10, 2024:

1. Question: What is the general expectation of the engineer during construction? Specifically, how often do we need to visit the site? We office out of Austin and it is quite a haul.

Answer: The standard language contained in our template agreement requires site visits during construction “no less than monthly” and more frequently depending on planned or actual activities at the site. The actual number of visits needed during the construction phase will be negotiated with the successful respondent.

2. Question: I noticed the 'construction cost limitation' is $900,000. Does this include all design fees? If not, is there a ballpark budget or expectation for design services?

Answer: The $900,000 Construction Cost Limitation is for construction/demolition only. The engineer’s fee will be negotiated with the successful respondent and will be based on the level of effort required to perform the engineering work.

3. Question: What is the TS’s HUB percentage goal for responding firms to meet or exceed? TSU supplied a sample Agreement with the RFQ which states that “The PE agrees to make a Good Faith Effort to allocate twenty percent (20%) of the services required under this Agreement to qualified consultants, which are HUB.” Does this include construction or only engineering services?

Answer: There is no specific HUB percentage goal that must be met.

However, the HUB Subcontracting Plan must demonstrate the Respondent’s good faith effort to allocate twenty percent (20%) of the services required under the agreement to HUBs. If the Respondent has made a demonstrated good faith effort but falls below the stated value, it has satisfied the intent of paragraph 1.13 of the RFQ. This requirement applies only to the PE services. The contractor will have a separate HUB percentage goal.

4. Question: Are there other specific HUB goals required, such as SMBE or WBE goals that will also need to be met?

Answer: No.
