About this file

This document is a Supplemental Form 1 - Waiver Request for the Texas Volkswagen Environmental Mitigation Program (TxVEMP) administered by the Texas Commission on Environmental Quality (TCEQ). The form allows applicants to request waivers for the ownership and usage requirements for equipment being replaced under the marine vessel and locomotive ferry, tug, and switcher grant program. Applicants must provide a detailed explanation demonstrating good cause for the waiver and confirm whether the replaced equipment will continue to operate in Texas absent a grant award. Applicants who plan to purchase third-party equipment must also complete additional certifications regarding the third-party equipment's operation, condition, and suitability for replacement.

The TxVEMP grant program provides financial incentives for repowering or replacing older locomotive freight switchers and marine ferries or tugs to reduce NOX emissions in priority areas in Texas. This solicitation is established and administered by TCEQ in accordance with the Environmental Mitigation Trust Agreement for State Beneficiaries and the Beneficiary Mitigation Plan for Texas.

If you have questions about how to fill out this supplemental form for a waiver request, please contact us at 833-215-TXVW (8989) or VWSettle@tceq.texas.gov.

TCEQ may consider a request to waive one or more of the program requirements based on a finding of good cause.

• This may include short lapses in registration or operation due to economic conditions, seasonal work, or other circumstances.

• The burden is on the applicant to demonstrate why there is good cause to grant the waiver request.

Refer to Appendix C of the TxVEMP Request for Grant Applications (RFGA) for TCEQ’s basis for determining good cause.

Applicants requesting a waiver to one or more of the program requirements must complete Part A of this form. Applicants who have purchased third-party equipment, or who plan to purchase third-party equipment from another entity for the purpose of replacing and disposing of the equipment under TxVEMP, must complete Parts A and B of this form.

Please complete a separate Supplemental Form 1 for each activity that includes a request to waive one or more of the program requirements and submit the completed form with the Project Application Form (TCEQ-21000-a/b).
