About this file

This document is an Addendum to a solicitation issued by the Texas Health and Human Services Commission (HHSC) for psychological services to evaluate the competency to stand trial of 46B patients at Terrell State Hospital in Kaufman County and Texarkana City, Texas. The Scope of Work requires the contractor to provide dictated competency reports within 10 working days of evaluating each patient referral. The contractor must have a flexible work schedule up to 5 days per week, including some holidays, after-hours, or weekend shifts, but can determine their own schedule during normal business hours. The contractor must have a minimum of 3 years of experience providing similar services. Responses to the solicitation are due by August 1, 2024 at 10:30 am. The contract term and any renewal options are not specified.

The pricing structure and set-asides for the solicitation are not detailed in this Addendum. The document indicates there is an incumbent contractor, but does not provide further information. Funding sources and amounts are also not included. The Addendum primarily addresses questions and answers related to the Scope of Work and contractor requirements.

Addendum No. 1 - Solicitation Q&A

Solicitation Title: Psychology services to stand trial of 46B patients at Terrell State Hospital

Solicitation Number: HHS0014683-2

# Reference (If Applicable) Question Response

1.

Page 11 – Section 7 Scope of Work (SOW). 7.1 Scope of Services to be Performed.5th bullet: “Contractor will provide the dictated report regarding competency of each referral within 10 working days.”

Please clarify when the report regarding competency will be due.

Is it 10 working days from when I receive the referral or from when I evaluate the patient?

10 days from when you evaluate the patient.

2.

Section 7.1.2 Performance Schedule (page 12). “Contractor shall perform contracted services, including any minor adjustment call-back services, Contractor will be available for a flexible work schedule up to 5 days per week.

Contractor may work some holidays, after-hour or weekend shifts.

Please clarify “flexible work schedule.” I want to ensure that I make my own schedule and decide when, during normal business hours, I work. That includes which days of the week (Monday through Friday) and for how long I work each day. I understand that the amount of time I work is proportional to the amount of work referred; however, I would like to confirm that I choose what day and time (during normal business hours) I complete the referred work.

You make your own hours during normal business hours. However, referrals must be started within 5 days of receipt.

3.

Section 7.1.3 Services Outside Regular Business Hours (page 12).

“Emergencies: The HHS Agency reserves the right to declare any necessary work within the Scope of Services to be an emergency during regular service hours or outside regular service hours, and will request emergency services in writing. Contractor shall respond on-site to a request for emergency services within one (1) hour of notification and continue work until the services requested are complete to the satisfaction of the HHS Agency.”

Based on the services I will be providing, as listed and explained in this IFB (see section 7.1 Scope of Services to be Performed), there should be no reason for my services to be needed during an emergency, nor should my work be categorized as an emergency. I ask that this clause not be included in my contract. Moreover, it would take me more than 1 hour to respond to an onsite emergency, due to where my residence is located.

There will be no on-site emergencies for this contractor.

4.

Section 7.1.5 Minimum Experience and Qualifications (page 13) “e) The Bidder must provide a minimum of three (3) verifiable references for current or previous contracts of the same size and for similar or same services within the last <five years in Exhibit D – Bidder Reference Form and return with Response.”

I have never had a previous contract as a vendor to provide psychological services similar to those requested in this IFB. I have always worked as a full-time employee. For the past five years I was employed by the Federal government (i.e., the Bureau of Prisons in the Department of Justice). I recently chose to leave my full-time employment to work as a sole proprietor. Thus, I do not have references regarding prior contracts, but I can provide professional references from the past five years of my Federal service.

Are professional references (as opposed to contract references) what I should include in Exhibit D - Bidder Reference Form?

Personal references are acceptable.

5.

Section 7.1.7 Contractor Responsibilities (pages 13-14) “a) The Contractor shall furnish all labor, tools, transportation, equipment, materials, and supplies, as necessary, to perform the services and/or provide the goods, as required.”

In order to perform the services, as listed and explained in this IFB (see section 7.1 Scope of Services to be Performed), psychological testing may need to be administered to a patient in order to complete the service. It is typical practice, that as a contractor, I would have access to the psychological tests that are available and provided by the Psychology Department at Terrell State Hospital at no cost to me. I want to clarify that, I would have access to such materials, and would not incur a cost to use these materials, which may be needed to perform the job.

Contractor will have access to TSH testing materials at no charge.

6.

Page 26 - Section 13 Insurance Requirements “k) …The Health and Human Services Commission, its officials, directors, employees, representatives, and volunteers shall be added as additional insureds as respects operations and activities of, or on behalf of the named insured performed under Contract with HHS. The additional insured status must cover completed operations as well. This is not applicable to workers’ compensation policies.” (Page 27)

What is meant by this statement?

Please clarify what this means in terms of insurance coverage that I am required to have as a vendor providing psychological services pursuant to this arrangement.

Liability insurance is what is needed.

7.

Section 13.1 Specific Insurance Requirements

As a psychologist, with no employees, do sections 13.1.1 Worker’s Compensation and Employer’s Liability, 13.1.2 Commercial General Liability, 13.1.3 Commercial Automobile Liability, and 13.1.5 Umbrella Insurance apply to me? I expect, as a psychologist, providing a professional service, that only

13.1.4 Professional Liability

Insurance applies to me.

Only 13.1.4 applies to you. We will need your certificate of insurance.
