Code, Part 1, requiring HHSC to establish a prescription assistance program for Texans.
ARTICLE II. SCOPE OF WORK
2.1 PROGRAM BACKGROUND
The Texas Cares Program was established by House Bill (H.B.) 18, 87th Regular Session, 2021, to assist uninsured Texans in gaining access to prescription benefits. The Texas Cares Program strives to improve accessibility to prescription drugs for individuals who are unable to access comparable medications through insurance or other health care programs.
In review of the current prescription landscape, it was found that approximately 98% of the top
200 most prescribed medications are available through existing drug assistance options.
Additionally, research found that many prescription medications which are considered cost prohibitive are available through manufacturer PAPs. There is a significant need to maximize access to prescriptions through existing free and low-cost resources by increasing awareness and strategic navigation.
The Texas Cares Program seeks to increase prescription drug access for Texans through a comprehensive community-based model and SaaS Solution. With this strategy, Navigators will https://dir.texas.gov/texas-risk-and-authorization-management-program-tx-ramph https://dir.texas.gov/texas-risk-and-authorization-management-program-tx-ramph https://statutes.capitol.texas.gov/Docs/GV/htm/GV.2262.htm#2262.055 https://texreg.sos.state.tx.us/public/readtac$ext.TacPage?sl=R&app=9&p_dir=&p_rloc=&p_tloc=&p_ploc=&pg=1&p_tac=&ti=34&pt=1&ch=20&rl=115 https://texreg.sos.state.tx.us/public/readtac$ext.TacPage?sl=R&app=9&p_dir=&p_rloc=&p_tloc=&p_ploc=&pg=1&p_tac=&ti=34&pt=1&ch=20&rl=509
Version 2.10 (09/12/2023) RFO No. HHS0014057v2 Page 11 of 67 assist individuals with finding and applying for existing drug manufacturer and third-party PAPs.
The Texas Cares Program is dedicated to assisting Texans while meeting them where they are, embodying the program mission – Bringing Care Closer to Texans.
Many pharmaceutical manufacturers offer PAPs which provide medications to eligible Clients at no-cost or low-cost. There are currently over 350 known PAPs available, with varying eligibility and applications. Although there are numerous PAPs available, many providers, Clients and advocates note that program requirements can be difficult to navigate and time consuming.
Additionally, since the application forms and eligibility criteria for PAPs can change as a result of manufacturer updates, ensuring that the most up-to-date information for these programs is used can be difficult for providers, Clients and advocates.
A comprehensive community-based model SaaS Solution can facilitate the process of identifying these PAPs, and act as a single “port” of entry for Navigators to assist Clients with applications for assistance. This single “port” of entry will find and autofill applications for all PAPs that a
Client is eligible for, reducing workload and saving time.
2.2 SCOPE OVERVIEW
HHSC seeks a qualified Contractor to provide a comprehensive community-based model SaaS
Solution that meets or exceeds the requirements as specified in this Solicitation. The Contractor shall provide all software, hardware, and personnel resources necessary to implement and maintain the Solution, unless specifically stated as the responsibility of HHSC.
The Contractor must provide a Solution that can be used by HHSC to assist Clients in gaining medications and prescription therapies, which may otherwise be cost prohibitive. The Solution must include reporting and analytics, security, cataloging, processing, producing, and retaining data to meet HHSC policies. The Solution must have processing capabilities, enhanced reviewing features, comprehensive reporting, agility in handling large quantities of data, and advanced production capabilities.
The Solution must be capable of being adapted and modified to meet HHSC’s business needs through configuration. In addition, the Solution must be scalable and flexible to accommodate changes in technology, security, legislative mandates, and any other changes within the scope of this Solicitation.
The Solution must:
a. Contain an existing central repository or library of available drug-manufacturer and third-party prescription assistance programs (PAPs) available to Clients;
b. Streamline the application process, reduce errors, update the applications as needed, and aid in the search of available PAPs;
c. Act as a central point of entry to search for PAPs that a Client may qualify for, determine eligibility, and directly submit specific application forms to the program providers;
Version 2.10 (09/12/2023) RFO No. HHS0014057v2 Page 12 of 67
d. Use the most current versions of application forms for manufacturer PAPs and other third-party prescription assistance;

a. Phase I – Transition;
b. Phase II – Operations; and
c. Phase III – Turnover.
2.2.2 User Base
The Texas Cares Program will grow the user base iteratively. Within the first year of the Contract term, less than fifty (50) Users will be required. Over time, the Solution must have capacity to be scaled to host 1,500 plus Users. User types include:
a. HHSC Users - Texas Cares Program staff administrators that oversee enrollment, training, and certification of Organizations, Sites, and Navigators to facilitate access by Texans to drug manufacturer or third-party PAPs for assistance;

Version 2.10 (09/12/2023) RFO No. HHS0014057v2 Page 13 of 67
Clients in person. Site Managers will provide oversight of enrolled Navigators who are associated to their Site. A Site Manager can also be a Navigator.
Please note, a single User may fall into more than one (1) type listed above. If the user falls into more than one category, they count as only one user.
2.2.3 Contractor Personnel
The Contractor shall provide key personnel to provide support for the Solution to HHSC throughout the life of the Contract.
The Contractor’s key personnel must include an account manager who will serve as the
Contractor’s primary point of contact to HHSC for coordinating and directing Contractor resources as required, addressing concerns or issues raised by HHSC, and for generally managing the business relationship, during the Contract Term. The account manager will be responsible for ensuring a successful project fully compliant with all appropriate security laws, policies, procedures, and regulations throughout the Contract term.
HHSC reserves the right to alter the designation of any Contractor personnel as key personnel.
HHSC, at its discretion, may request that the Contractor remove key personnel providing Services under the Contract, if HHSC believes that such an individual is not providing the Services as described within the Contract and the Contractor, after notice, has been unable to resolve performance issues relative to such individual.
2.2.4 Deliverable Approval
The Contractor must provide all Deliverables listed in the following tables on or before the dates specified in the Contract:
a. Table 2 – Configuration Requirements;
b. Table 3 – Training Requirements;
c. Table 4 – Security and Compliance Requirements;
d. Table 5 – Scalability and Availability Requirements;
e. Table 7 – UAT Requirements;
f. Table 8 – Go-live Requirements;
g. Table 9 – User Report and Volume Report Requirements; and
h. Table 13 – Turnover Requirements.
The Contractor must submit each written Deliverable to HHSC for review and approval prior to use. HHSC approval is contingent upon HHSC’s determination the Deliverable conforms to the agreed upon specifications identified in the Contract. HHSC’s approval of the Contractor’s work products or processes will not relieve the Contractor of liability of errors and omissions in the work products or processes.
Version 2.10 (09/12/2023) RFO No. HHS0014057v2 Page 14 of 67
HHSC shall notify the Contractor of Deliverable approval or rejection, in writing. If the
Deliverable is rejected, HHSC’s written notification will include the reason(s) for rejection and the steps the Contractor must complete so the Deliverable will be acceptable.
Upon receipt of the corrected and resubmitted Deliverable, HHSC shall review the corrected
Deliverable to confirm that the identified deficiencies have been corrected and brought into compliance with specifications and that the corrections have not directly or indirectly caused other deficiencies. HHSC shall have the option to continue the evaluation process until the written
Deliverable is brought into compliance with the Contract specifications.
If the Contractor is unable to provide any Deliverable within the scheduled timeframe, the
Contractor’s account manager must contact HHSC in writing, and provide a reason for the delay and the proposed revised schedule, which HHSC may accept or reject at its sole discretion.
The Contractor’s failure to comply with applicable deadlines for Deliverables, or other HHSC requests for information may result in adverse action against the Contractor (see, Exhibit N, Key
Performance Measures and Liquidated Damages).
Any Deliverable that is not explicitly accepted in writing by HHSC is rejected.
2.2.5 Key Performance Measures and Associated Remedies
HHSC will monitor the performance of the Contractor and all requirements of the Contract are subject to performance evaluation by HHSC. HHSC has identified Key Performance Measures
(KPMs) in Exhibit N, Key Performance Measures and Liquidated Damages.
For the contractual obligations subject to a KPM, the KPM will be used to gauge the Contractor’s commitment to successful performance, its willingness to stand behind its Goods and Services provided during the Contact Term, as well as its confidence in its ability to perform.
The Contractor will achieve the KPMs specified in Exhibit N, Key Performance Measures and
Liquidated Damages and may have liability for liquidated damages based on KPM failure as further described in each KPM. Liquidated damages will not be assessed if HHSC determines that the Contractor is not responsible for the failure described in the respective KPM.
For purposes of the KPMs, all measurement periods shall be monthly unless otherwise specified.
In addition, the term “day” refers to a Calendar Day, unless otherwise specified in the text. Partial days beyond the due date shall be rounded up to a whole day for the purposes of the KPM measurement. Also, an hour is not prorated i.e., a fraction of an hour means an hour.
When a liquidated damages measure refers to a percentage point, or portion thereof, the "portion thereof" means that a full percentage point deviation is not required to assess the liquidated damages. For example, if the standard is 99% and the results achieved are 98.6%, the liquidated damages that may be assessed is based on one (1) percentage point. If the results achieved are
97.9%, the liquidated damage that may be assessed is based on two (2) percentage points. HHSC is not required to provide the Contractor with notice and opportunity to resolve issues to System
Agency’s assessment of liquidated damages in accordance with Texas law.
Version 2.10 (09/12/2023) RFO No. HHS0014057v2 Page 15 of 67
In the event the Contractor fails to perform or complete the obligations in a timely manner, HHSC may, in addition to the remedies set forth elsewhere in the Contract, impose the remedies which include the following:
a. Compliance by the Contractor, at no cost to HHSC, with the performance improvement activities and timelines specified in a written corrective action plan(s) approved by HHSC;
b. Additional or ad hoc reporting by the Contractor, at no cost to HHSC, to address performance issues;
c. To the extent that HHSC has not received full performance of any Contractor obligations, HHSC may exercise its statutory right to withhold authorization for payments for invoices for any Services not actually received in conformance with Contract requirements. See
Section 2155.322 of the Texas Government Code (requiring State agencies to inspect and certify receipt of goods or Services for compliance with Contract requirements); and
d. Assessment of liquidated damages as listed in Exhibit N, Key Performance Measures and Liquidated Damages.
2.3 SOLUTION REQUIREMENTS
The Solution must be:
a. Compatible with standard Internet browsers, including but not limited to, Google Chrome, Microsoft Edge, Mozilla Firefox, and Apple Safari;
b. Capable of being viewed on a desktop, tablet or mobile device;
c. Capable of providing and supporting access for up to 1,500 synchronous Users, logins, or access points to obtain the information concurrently;
