About this file

The document is a Supplemental Form 1 - Waiver Request for the Texas Commission on Environmental Quality's (TCEQ) Rebate Grants Program under the Texas Emissions Reduction Plan (TERP) Solicitation No. 582-24-85807-RG. The form allows applicants to request waivers for the ownership, registration, and usage requirements for vehicles being replaced under the program. Applicants must provide a detailed explanation of good cause for the waiver and confirm the vehicle will continue to be operated in Texas if a grant is not awarded. Applicants requesting to purchase third-party vehicles or equipment must also complete Part B to provide vehicle/equipment information and obtain consent from the current owner.

The Rebate Grants Program provides financial incentives to repower or replace older on-road heavy-duty diesel vehicles and select non-road diesel equipment in order to reduce nitrogen oxides (NOx) emissions in nonattainment areas and affected counties in Texas. The program is established under the Texas Health and Safety Code and administered by TCEQ. Applicants must demonstrate good cause for waiving the ownership, registration, and/or usage requirements in order to be eligible for the grant funding.

Supplemental Form 1 – Waiver Request for Rebate Grant Program Project Application Form

Texas Commission on Environmental Quality (TCEQ) Texas Emissions Reduction Plan (TERP)

Solicitation No. 582-24-85807-RG

Under Texas Health and Safety code (THSC), §386.104(j), TCEQ may consider a request to waive one or more of the program requirements based upon a finding of good cause.

• This may include short lapses in registration or operation due to economic conditions, seasonal work, or other circumstances.

• The burden is on the applicant to demonstrate why there is good cause to grant the waiver request.

Refer to Appendix B of the Rebate Grants Program Request for Grant Applications (RFGA) for TCEQ’s basis for determining good cause.

Applicants requesting a waiver to one or more of the program requirements must complete Part A of this form.

Applicants who have purchased third-party vehicles, or who plan to purchase third-party vehicles, from another entity for the purpose of replacing and disposing of those vehicles under the Rebate Grants Program must complete Parts A and B of this form.

Please complete a separate Supplemental Form 1 for each activity that includes a request to waive one or more of the program requirements and submit the completed form with the Project Application Form (TCEQ-20332).
