About this file
This is a federal contract clause (ES7034) governing the rework and repair of nonconforming material, effective January 2012.
The clause defines rework as the reprocessing of nonconforming material to achieve complete conformance with drawings, specifications, and contract requirements. Repair is defined as reprocessing nonconforming material using approved written procedures to reduce nonconformance to a usable condition, with the understanding that the repaired item may not completely conform to all applicable requirements. Rework procedures and associated inspection procedures must be documented by the contractor and submitted to the Government Quality Assurance Representative (QAR) for review and approval prior to implementation, with the QAR retaining disapproval authority. Repair procedures must be documented and submitted on DD Form 1694 (Request for Deviation/Waiver) to the Contracting Officer for written approval before implementation. Both rework and repair submissions must include a description of the cause of nonconformances and preventive actions to be taken to avoid recurrence. All rework and repair procedures must include reinspection provisions that comply with Technical Data Package requirements and provide Government assurance that items meet reprocessing standards. The clause applies as a supply chain flow-down requirement to contractors and their suppliers, vendors, and subcontractors.
