1.0 INSTRUCTIONS
1.1 GSA will be accepting quotes for Fire Safety Surveys. The period for government acceptance of the quote is 60 days following the RFQ due date.
1.2 These services are being procured as a competitive negotiated Request for Quote (RFQ), using source selection procedures, as authorized by parts 12, 13 and/or 15 of the Federal Acquisition Regulation (FAR) and the General Service Administration Acquisition Manual (GSAM) located at: http://www.arnet.gov/far and http://www.arnet.gov/GSAM/gsam.html.
This solicitation will result in a best value, firm fixed price order.
1.3 The Government reserves the right to award single or multiple awards to the Offeror(s) providing the best overall value for each specific facility group in accordance with FAR
52.216.27. This request for quote does not commit the Government to award a contract or to pay any costs incurred in the quote preparation.
1.4 GSA's objective is to select the quote that offers the Best Value. “Best value” means the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement. It is advised that firms submit an offer that represents the firm’s best terms from a price and technical standpoint since the Government intends to award this contract to the Offeror possessing the overall “best value” to the government utilizing the lowest price technically acceptable source selection process (FAR 15.101). The evaluation factors are price, technical capability, and past performance (FAR 15.304).
1.5 The government will evaluate the quality and extent of the Offeror’s experience relevant to the requirements of this RFQ. The government reserves the right to consider other sources of information such as current and past procurements, other federal agency contracts, commercial sources, and the Past Performance Information Retrieval System (PPIRS).
The evaluation of past performance information will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirements, when such information is relevant to the acquisition.
1.6 Technical quotes will be evaluated separately from the price quotes by a technical team and should be clearly labeled as the “Technical Quote”. Price shall not be discussed in the technical package.
1.7 Interested firms are cautioned to submit adequate and sufficient information to enable the Government to fully ascertain its capability to perform all of the requirements of this acquisition. The data submitted with each quote should be complete and concise but not overly elaborate.
1.8 Government may make a final determination as to whether the Offeror’s price quote and technical package are acceptable or unacceptable solely on the basis of the initial quote as submitted. Accordingly, Offerors are advised to submit initial quote packages that are fully and clearly acceptable without additional information. Offers which do not present sufficient information to permit a complete technical evaluation by the Government may be determined to be technically unacceptable.
1.9 Whenever, the words “offer,” “proposal,” “Offerors,” or similar terms are used in this solicitation, they shall be read to mean “quotation,” “quoter,” or similar corresponding term to reflect that this solicitation is a request for quotation (RFQ) and not a request for proposal (RFP), or an invitation for bids.

2.3 Evaluation Factors:
FACTOR 1: Technical capability to meet the Government’s Requirement
a. The term “technical,” as used herein, refers to non-price factors other than past performance. More than one “technical” factor can be used and titled to match the specific evaluation criteria appropriate for the RFQ. The purpose of the technical factor is to assess whether the offer will satisfy the Government’s minimum requirements.
b. Provide (limited to three pages, each side of a sheet of paper constitutes one page) a written explanation describing:
1. Offerors must state whether they have the knowledge and ability of the requirements for fire safety testing and reporting.
2. How the Offeror intends to comply with the Statement of Work (SOW) and supply of all required documentation herein.
3. The Offeror shall “confirm that they understand the complexity and nature of the requirement, and are fully capable of providing the contracted service.”
4. This requirement is a small business set-aside; the Offeror shall confirm that they have the personnel and financial capability/capacity to perform the contract in accordance with FAR 52.219-14 -- Limitations on Subcontracting. Specifically addressing “(c) By submission of an offer and execution of a contract, the Offeror/Contractor agrees that in performance of the contract in the case of a contract for -- (1) Services (except construction). At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern.”
c. Technical capability will be rated on an “acceptable” or “unacceptable” basis using the ratings in Table
Table A-1. Technical Acceptable/Unacceptable Ratings
Rating Description
Acceptable Quote clearly meets the minimum requirements of the solicitation.
Unacceptable Quote does not clearly meet the minimum requirements of the solicitation.
https://www.sam.gov/portal/public/SAM/ mailto:%20min.kim@gsa.gov, Factor 2 – Qualifications of Key Personnel (No more than 2 pages per individual)
a. Any individual(s) proposed for performing the Fire Safety Surveys shall be a Registered Fire Protection Engineer with a minimum of 10 years of experience, or a minimum of 10 years of experience in the 804 series within the Federal Government. Offeror is required to submit certificates and resume, and show documentation of past experience on key personnel.
b. The Offeror shall identify key personnel, explain the roles and responsibilities, and provide resumes exhibiting the qualifications and experience of each key person. Resumes shall document 10 years of experience within the last 10 years. Please include information on certifications, education, training and longevity with the firm.
c. Qualifications of Key Personnel will be rated on an “acceptable” or “unacceptable” basis using the ratings in Table A-2:
Table A-2. Qualifications of Key Personnel Acceptable/Unacceptable Ratings
Rating Description Acceptable Quote clearly meets the minimum requirements of the solicitation.
Unacceptable Quote does not clearly meet the minimum requirements of the solicitation.
FACTOR 3: Present/Past Performance
a) Description: Provide a minimum of two references (i.e., name, title, telephone phone number, and project title/description) who can verify that YOUR Company provided recent services of similar scope and complexity as required herein. "Recent" is defined as "within the past three years.” Past Performance references may be contacted. The Government may also consider any additional past performance information that is available. Offerors are reminded that, while the Government may elect to consider data obtained from other sources, the burden of providing thorough and complete performance information rests with the Offeror.
b) GSA defines similar projects as fire safety surveys for federal facilities or general office buildings.
c) Standard for Evaluation: The Government will evaluate the relative merits of each Offeror’s past performance on similar projects. The minimum acceptance requirements for this factor are defined below. Specifically, the Offeror shall demonstrate itself as a business providing verifiable information and references for no more than three (3) projects completed or substantially complete (i.e. at least 75% complete) within the last three (3) years as of the date proposals are due for this Solicitation that:
1) Demonstrate ability to provide quality product or service.
2) Demonstrate responsiveness and ability to meet performance timelines.
3) Demonstrate ability to successfully manage costs and project budgets.
4) Demonstrate effective management/business relations to include effective key personnel, effective coordination, and effective interaction of team members and third party agencies.
5) Demonstrate overall Customer Satisfaction.
The present/past performance assessment will also be evaluated using information gleaned from the references provided by the Offeror, as well as any other information available to the Government to include, but not limited to the Past Performance Information Retrieval System (PPIRS) and Federal Awardee Performance and Integrity Information System (FAPIIS). If an offeror receives/received below a ‘satisfactory’ from any references, Provided Reference, PPIRS, and/or FAPIIS, the Offeror will receive and ‘unacceptable’ rating and will no longer be considered for award.
d) Present/Past Performance will be rated on an “acceptable” or “unacceptable” basis using the ratings in Table A-3:
Table A-3. Present/Past Performance
Rating Description
Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.
(See note below.).
Unacceptable Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.
Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
FACTOR 4: Price
Price will not be rated. Submit pricing for all Contract Line Item Numbers (CLINs). Provide total pricing for the entire offer.
Price will be evaluated using various price analysis techniques and the following:
Total Price: The total price is the sum of the prices for all the Contract Line Items (CLINs) of this solicitation.
Award will be made to the offeror provided its Price is determined to be fair and reasonable by the Contracting Officer.
This solicitation will be evaluated using the methodology of Lowest Price Technically Acceptable (LPTA). The award will be made to that Offeror that receives the following rating:
Factor 1 Technical Capability – Acceptable Factor 2 Qualifications of Key Personnel – Acceptable Factor 3 Present/Past Performance – Acceptable Factor 4 Price – Lowest priced offer after successful evaluation of Factors 1-3.
3.0 PRICE INFORMATION REQUIREMENT
Offeror shall submit pricing on the attached GSA Form 300, Order for Supplies and Services and CLIN Structure. The contents of the quote shall include a breakdown of lump sum prices which shows the total level of effort with all associated travel costs shown separately. Travel costs shall not exceed the Federal Travel Regulations (FTR) rates for the applicable geographical location.
4.0 RESERVED.
5.0 COMMUNICATIONS AND REVISIONS
5.1 Contractors are cautioned to submit sufficient information and in the format specified in the instructions. Contractors may be asked to clarify certain aspects of their proposal (for example, the relevance of past performance information) or respond to adverse past performance information to which the contractor has not previously had an opportunity to respond. Communications may be conducted to resolve minor or clerical errors and the Government reserves the right to award a contract without the opportunity for quote revision.
5.2 The Government intends to award based on initial offers, however, reserves the right to conduct fact finding or communication sessions if the Contracting Officer later determines them to be necessary. If communication sessions are conducted, the means and methods (e.g., in person, telephonic, written) will be determined by the Contracting Officer. This may result in a request for revised price. If final price revisions will be required for award determination, at the direction of the Contracting Officer, the Offeror shall then submit their Final Price Revision (FPR) for evaluation. Final selection and award will be made by the Contracting Officer to that Offeror that is determined technically acceptable and lowest price.
6.0 SECURITY REQUIREMENTS
See the attached GSA Policy regarding security requirements and the Contractor’s responsibilities.

52.209-5 -- Certification Regarding Responsibility Matters (Apr 2010)
(a)
(1) The Offeror certifies, to the best of its knowledge and belief, that --
(i) The Offeror and/or any of its Principals --
(A) Are [_] are not [_] presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;
(B) Have [_] have not [_], within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract;
violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks “have”, the offeror shall also see 52.209-7, if included in this solicitation); and
(C) Are [_] are not [_] presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision; and
(D) Have [_], have not [_], within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied.
(1) Federal taxes are considered delinquent if both of the following criteria apply:
(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the http://www.dlis.dla.mil/nato/ObtainCAGE.asp http://www.dlis.dla.mil/cage_welcome.asp liability is not finally determined until all judicial appeal rights have been exhausted.
(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(2) Examples.
(i) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability.
This is not a delinquent tax because it is not a final tax liability.
Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms.
The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
(ii) The Offeror has [[_] has not [_], within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.
(2) “Principal,” for the purposes of this certification, means an officer; director; owner;
partner; or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).
This Certification Concerns a Matter Within the Jurisdiction of an Agency of the United States and the Making of a False, Fictitious, or Fraudulent Certification May Render the Maker Subject to Prosecution Under Section 1001, Title 18, United States Code.
(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror’s responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision.
The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.
(End of Provision)
52.212-4 -- Contract Terms and Conditions -- Commercial Items (May 2015)
(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post-acceptance rights --
(1) Within a reasonable time after the defect was discovered or should have been discovered; and
(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.
(b) Assignment. The Contractor or its assignee may assign its rights to receive payment due as a result of performance of this contract to a bank, trust company, or other financing institution, including any Federal lending agency in accordance with the Assignment of Claims Act (31 U.S.C.3727). However, when a third party makes payment (e.g., use of the Governmentwide commercial purchase card), the Contractor may not assign its rights to receive payment under this contract.
(c) Changes. Changes in the terms and conditions of this contract may be made only by written agreement of the parties.
(d) Disputes. This contract is subject to 41 U.S.C. chapter 71,Contract Disputes. Failure of the parties to this contract to reach agreement on any request for equitable adjustment, claim, appeal or action arising under or relating to this contract shall be a dispute to be resolved in accordance with the clause at FAR 52.233-1, Disputes, which is incorporated herein by reference. The Contractor shall proceed diligently with performance of this contract, pending final resolution of any dispute arising under the contract.
(e) Definitions. The clause at FAR 52.202-1, Definitions, is incorporated herein by reference.
(f) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence such as, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.
(g) Invoice.
(1) The Contractor shall submit an original invoice and three copies (or electronic invoice, if authorized) to the address designated in the contract to receive invoices. An invoice must include --
(i) Name and address of the Contractor;

(x) Electronic funds transfer (EFT) banking information.

(B) If EFT banking information is not required to be on the invoice, in order for the invoice to be a proper invoice, the Contractor shall have submitted correct EFT banking information in accordance with the applicable solicitation provision, contract clause (e.g., 52.232-33, Payment by Electronic Funds Transfer— System for Award Management, or 52.232-34, Payment by
Electronic Funds Transfer—Other Than System for Award Management), or applicable agency procedures.
(C) EFT banking information is not required if the Government waived the requirement to pay by EFT.

(h) Patent indemnity. The Contractor shall indemnify the Government and its officers, employees and agents against liability, including costs, for actual or alleged direct or contributory infringement of, or inducement to infringe, any United States or foreign patent, trademark or copyright, arising out of the performance of this contract, provided the Contractor is reasonably notified of such claims and proceedings.
