About this file

This is an Executive Order (2022-02D) issued by the Governor of the State of Ohio establishing procurement restrictions related to Russian institutions and companies in response to Russia's invasion of Ukraine. The order applies to all State agencies, boards and commissions, state educational institutions, and pension funds. The Executive Order directs these entities to divest from Russian investments, terminate existing contracts with Russian institutions or companies, and refrain from entering into new contracts with such entities. The Department of Administrative Services, through Ohio's Chief Procurement Officer, is tasked with ensuring compliance through standard contract language, agency procurement officer training, and the establishment of disclosure requirements. Agency Procurement Officers must require all service providers and prospective contractors to affirm their understanding of the Order's requirements and disclose the principal location of business for all contractors and subcontractors supplying services to the State.

The Order defines "Company" broadly to include sole proprietorships, partnerships, corporations, national associations, and other business organizations including subsidiaries and affiliates operating to earn a profit. All quotations, statements of work, and service proposals must include affirmations of compliance with the Order's prohibitions and disclosure requirements, with non-compliant proposals being rejected. Procurement manuals, directives, policies, and procedures must be updated to reflect these requirements, and all Agency Procurement Officers must receive adequate training on the Order's terms. The Executive Order was signed on March 3, 2022, in Columbus, Ohio, and remains in effect unless rescinded or modified by a future Executive Order. The order is intended to work in conjunction with Executive Order 2019-12D, which prohibits contracting and purchasing of services from overseas sources.
