About this file

This document is a Justification and Approval for Other Than Full and Open Competition for the acquisition of ENGYS' HELYX CFD software and services for the DARPA Liberty Lifter Wing over Wave Test program.

DARPA is acquiring a one-year license for ENGYS' HELYX CFD and HELYX Marine software packages, as well as 160 hours of software development support, for a total estimated value of under competitive conditions. ENGYS is the only responsible source capable of providing the required software modifications to implement rigid moving boundary conditions needed for the Liberty Lifter program. Market research concluded that no other commercially available CFD software could adequately model the complex aerodynamic and hydrodynamic interactions required. The contracting officer determined the proposed pricing to be fair and reasonable based on market analysis. The period of performance is August 12, 2024 through August 11, 2025.

JUSTIFICATION AND APPROVAL FOR

OTHER THAN FULL AND OPEN COMPETITION

SUBJECT: Justification for Other than Full and Open Competition for the Acquisition

Contract for the DARPA Liberty Lifter Wing over Wave Test Software

PART 1 - JUSTIFICATION

1. Agency and Contracting Activity Identification:

This justification and approval for other than full and open competition is executed by the Defense Advanced Research Projects Agency (DARPA) and contracted through the DARPA Contracts Management Office (CMO).

Description of Action:

New Action Under FAR 13.5 Proposed contractor’s name: ENGYS Contract type: Firm Fixed Price

2. Description of Supplies or Services:

HELYX is a comprehensive general purpose Computational fluid dynamics (CFD) software package for engineering analysis and design optimization of enterprise applications, based on ENGYS' own open-source CFD simulation engine. HELYX is a unified, off-the-shelf CFD software product compatible with most Linux and Windows platforms, including high-performance computing systems. In addition to the base software components delivered for installation (HELYX-GUI and HELYX-Core), the package also incorporates an extensive set of ancillary services to facilitate the deployment and usage of the software in any working environment.

ENGYS will provide the Government with one annual user license for HELYX CFD, one annual user license for HELYX Marine Software package, and 160 hours of support for software development.

ENGYS will provide CFD software that is capable of accurately simulating complex flow field interactions between aerodynamic and hydrodynamic governing first principles in appropriate inertial reference frames that describe core functionalities of the Liberty Lifter program. ENGYS will also engage in a software development task that seeks to enhance the CFD software package such that a rigid moving boundary condition can be implemented in lieu of a complex air/water interface to simplify computational complexity without a major loss of accuracy.

Total estimated dollar value:

The anticipated Period of Performance is August 12, 2024 through August 11, 2025.

3. Statutory Authority Cited:

The statutory authority permitting other than full and open competition is:

A. _X Only one responsible source 10 U.S.C. 3204(a)(l).

B. __ Unusual and compelling urgency 10 U.S.C. 3204(a)(2).

C. __ Industrial mobilization; engineering, development, or research capability; or expert services 10 U.S.C. 3204(a)(3).

D. __ International agreement 10 U.S.C. 3204(a)(4).

E. __ Authorized or required by statute 10 U.S.C. 3204(a)(5).

F. __ National security 10 U.S.C. 3204(a)(6).

G. __ Public interest 10 U.S.C. 3204(a)(7).

4. Unique Qualification and Use of the Statutory Authority Cited:

FAR 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Efforts Made to Ensure Offers are Solicited From as Many Potential Sources as Practicable:

The software provided by ENGYS is uniquely positioned to provide a comprehensive solution to the core aerodynamic, hydrodynamic, and flight dynamics that describe the Liberty Lifter program. The vast majority of commercially available off-the-shelf (COTS) software vendors offer solutions to only a subset of the total physical phenomena describing the Liberty Lifter program. As such, ENGYS offers the Liberty Lifter Project Management Office (PMO) a unique computational modeling solution that both encompasses and helps mitigate some of the highest risk components of the program.

The application of CFD software DARPA requires, for use in the Liberty Lifter program, requires software modification from their version. This software modification will better enable the CFD simulation to compute and analysis rigid moving boundary conditions required for Liberty Lifter. Subsequently, ENGYS is the only responsible source capable for providing ENGYS CFD software development and only ENGYS are allowed to manipulate their own software.

6. Determination of Fair and Reasonable Costs:

In accordance with FAR Part 15 and the Defense Federal Acquisition Regulation Supplement Part 215, the Contracting Officer will utilize the appropriate proposal analysis techniques cost reasonableness assessments to ensure that the final agreed-to price is fair and reasonable. Upon conclusion of negotiations.

The contracting officer determines that the anticipated prices will be fair and reasonable in accordance with FAR 13-106-3(a)(2)(i) market research and FAR 13-106-3(a)(2)(iii) current price lists. By signing the justification, the contracting officer makes a determination that the costs/prices to the government are expected to be fair and reasonable.

7. Market Survey Conducted and Results or a Statement of Reasons Why Market Research was Not Conducted:

Market research was conducted. Through market research the Government only identified one authorized source for the software modifications. The only authorized source to modify the software is the creator ENGYS. Therefore only ENGYS can receive the award to modify the ENGYS software.

8. Other Factors Supporting Use of Other Than Full and Open Competition:

Market research determined that alternative COTS software solutions including commercial, academic, and government owned packages offered modeling strengths in single principled areas of aerodynamics, hydrodynamics, or flight-dynamics.

Investigated software solutions included CREATE-AV Kestrel, CREATE-SH NavyFOAM, CREATE-SH Marine Aligned Kestrel Offshoot (MAKO), OpenFOAM, ANSYS Fluent, Siemens STAR CCM+, and NASA’s FUN3D software packages. The results of this market research effort concluded that, other than ENGYS HELYX Marine CFD, a single software solution that encompassed all three principle areas of interest could not be found in an “off-the-shelf” manner and thus would require a substantial development effort which increases both cost and risk to the Liberty Lifter program.

ENGYS has provided a product price list cataloging the prices they provided to the Government are standard pricing metrics. A search of similar products from competitor companies in CFD software resulting in the following finds. The cost of Ansys Fluent starts at around for a perpetual license (only for Ansys Fluent, the price can be higher if you require more modules). The cost of Simcenter STAR-CCM+ Essentials is for a one-year license. The cost of SimFlow CFD software Professional is for a one-year license. The cost of Autodesk CFD: Simulation software for engineering complex liquid, gas, and air systems is for a one-year license.

9. Sources Who Expressed a Written Interest in the Acquisition:

N/A

10. Actions to Remove or Overcome Barriers to Competition:

DARPA will take all necessary actions to remove and overcome any barriers to competition before any subsequent acquisitions for the services, including challenges to restrictive data markings, data rights, preparation of a performance-based work statement.

11. Delivery requirements:

Deliverables include:

HELYX CFD SW Package HELYX Marine SW Package
