Federal Acquisition Regulation (FAR) Part 16 Exception to Fair Opportunity Justification under Multiple Award Indefinite Delivery Contracts

1. Contracting Activity: National Guard Bureau, Operational Contracting Division at 111 S. George Mason Drive; Arlington, Virginia 22204.

2. Description of Action: Army National Guard (ARNG) requests a Firm Fixed Price bridge task order under contract W52P1J-18-D-A138; CACI ISS Inc. (CACI), 14370 Newbrook Drive, Chantilly, VA 20151. The Government projects an award no later than 30 September 2020 and will use fiscal year (FY) 2020 Operation and Maintenance funds for the base year of this contract. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(j)(B). This bridge contract action will provide the Government with the time required to compete a follow on action.

3. Description of Supplies/Services: This effort provides for continued support for the Military Construction operations of the Army National Guard’s 54 state and territories;

Facility Management Officers provides technical support for the Engineering and Base Operations Support System (ENBOSS or ARNG ENBOSS). The Office of the Chief, Installations Division, Army National Guard (ARNG-IEZ), is responsible for exercising management control over the Army National Guard (ARNG) military construction (MILCON) program. This role requires establishing policy and providing the systems necessary so that Construction and Facility Management Officers (CFMO) within the fifty-four States and Territories can prepare and submit required military construction documentation through the ENBOSS application. ENBOSS has been the primary method for MILCON documentation preparation since it went into full-scale production use in March 2008. This effort provides for continued support for the Military Construction operations of the Army National Guard’s 54 state and territories; Facility Management Officers provides technical support for the Engineering and Base Operations Support System (ENBOSS or ARNG ENBOSS). ENBOSS produces standardized, highly accurate, military construction documentation for submission to Congress as part of the annual DoD budget process. ARNG currently maintains documentation on approximately 7,000 Military Construction projects within the ENBOSS system and over 482 users.

4. Authority Cited. 10 U.S.C. 2304c(b)(2) as implemented by FAR 16.505 (b)(2)(i)(B) – Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

5. Reason for Authority Cited. CACI developed the ENBOSS application in 2008 for

Installations Command, the Army Reserve, and the Army National Guard. In order to provide the necessary time to compete the follow on action, the Government requires the use of this bridge contract. CACI has been the only contractor to support this requirement. While the previous acquisition was competitively solicited, only one other firm submitted a proposal proposing. Based on the previous acquisition, the Government requires the additional time to ensure that barriers to competition a removed and that the Government provides adequate information in order provide a more competitive requirement to support the Government’s efforts. This bridge action provides National Guard Bureau a one-year base period and a one year option to support a follow on competition of this requirement. The ENBOSS support services provided by CACI are highly specialized in that there are currently no in-house resources that can provide ENBOSS support. CACI originally developed ENBOSS and has provided contract support for this application for the past twelve years. The technical expertise that has been developed since its inception in 2008 is extensive.

The ARNG is the only component to execute 100% MILCON obligations through the ENBOSS application provided by CACI. ARNG MILCON execution for the last ten years is 92% average. Notably, high execution coincided with using the ENBOSS application.

While the Government owns the source code for the ENBOSS software, no other vendor has the expertise or the institutional knowledge and understanding of how the software applies to the ARNG and each of the 54 states and territories. However, based on market research, the Government believes that this requirement could be competed and requires the use of a bridge to better posture the follow-on acquisition as a competitive acquisition. CACI provides highly specialized support without substantial duplication of cost. The Government found companies during market research for this acquisition expressed interest in performing this requirement. While a competed action to support this software would significantly increase the complexity, the Government intends to use this bridge to ensure a successful competition of the follow-on requirement. With the 597,461 lines of code driving the complexity of this requirement, the Government cannot expect any other company to instantly understand how the software functions upon contract award. Because ENBOSS encompasses 597,461 lines of code working in concert to support NGB’s MILCON budget process, the Government will work to ensure the requirement is adequately documented in order to reduce the barriers to competition under the follow-on competition. ENBOSS is a Government-owned system developed for DOD facility management officers to plan and program MILCON requirements. Not being able to use ENBOSS will reduce the commands’ ability to collect, validate, and summarize programming requirements for Program Objective Memorandum (POM) submission to the HQDA staff. The ARNG MILCON execution depends on the ENBOSS application.

ENBOSS created by CACI provides the mechanism to plan, and program ARNG facilities, enhancing the training environment for ARNG soldiers. Quality facilities improve recruitment and retention. ENBOSS supports the HQDA EXORD 067-19 (Army Campaign Plan 2019+) Line of Effort “Readiness” supporting installation readiness. ENBOSS supports the Assistant Chief of Staff for Installation Management

(ACSIM) to establish a comprehensive plan to modernize installations through the Army Installations of the Future initiative that sets conditions to develop secure installations that integrate infrastructure, facilities, and services to build readiness and project power as an integral part of Army readiness.

ENBOSS Support Services from CACI is a computer system that assists the States in the generation of DD Forms 1390 and DD Forms 1391, required for Military Construction Projects (MILCON). The DoD Financial Management Regulation Volume 2B, Chapter 6 dated December 2010, 060301.3.b. states that each proposed construction project will be supported by DD Form 1390/1391C, Military Construction Project Data. The DoD Financial Management Regulation Volume 2B, Chapter 6 *December 2010 060301.3.b. states each proposed construction project will be supported by DD Form 1391/1391C, Military Construction Project Data. These will be prepared in accordance with guidance contained in Section 060502. DD Form 1390, Military Construction Program, will be prepared for each installation at which major construction is planned, utilizing the format prescribed in Section 060502. DD Form 1390S, Guard and Reserve Forces Military Construction, will be utilized by the Guard and Reserve Components. A process review board determined that best management practice (BMP) of creating programming documents would be more efficient if the process was automated.

Risk Management Framework is the integrated information security framework managed to support ENBOSS’s ability to maintain certification and accreditation credentials, identify risks to the system, assess those risks, and take steps to reduce risks to an acceptable level through shared lessons learned. CACI is involved sustaining application certification for the Defense Information Systems Agency and the Defense Enterprise Computing Center.

ENBOSS is collaborative application tool that enables the ARNG to construct facilities estimates to meet the needs of the The Adjutant General (TAG) for each state and territory to provide trained and ready forces to meet the needs of the Nation and the State. In the previous contract, CACI worked to begin moving this application to the Cloud, which will provide users a better overall experience. In the event the contract is awarded to a new contractor it would take several months before the system would be completely operational. Updating the ENBOSS artifacts with any changes required from HQDA G9 and US Army Corps of Engineers (USACE) could take up to a month.

Migrating ENBOSS to mil cloud requires a Security Controls and Assessment Validation (SCA-V) taking a month to complete the initial inspection, following the initial SCA-V several weeks will be required to fix any errors or failures in the system and another week to re-inspect. If the new contract were to be awarded in August the ARNG would have missed the opportunity to submit MILCON projects for the FY27 Presidents Budget. In addition to the effort for a new contactor to understand how the system works and functions within the Cloud, the new contractor would have to finish migrating this application, update training materials, user manuals, and conduct new user training.

This increases the risk of unsuccessful performance to an unacceptable level.

ENBOSS takes the requirements from US Army Force Management Support Agency (USWFMSA) website (FMSWEB), Full Time Support Management Control System (FTSMCS), Army Regulations, Universal Facility Codes (UFCs), and National Guard Regulations to estimate the cost to construct an Army National Guard Facility.

FMSWEB information includes size and rank structure of the unit and storage requirements for weapons, tents, camo nets and other items. With these inputs, ENBOSS is able to create cost estimates for construction cost of the facility to accommodate weapon storage, vehicle parking, office space, and classrooms.

ENBOSS programmers frequently update ENBOSS on requirements and regulations so projects created in ENBOSS have the most recent regulatory requirements included in the cost estimates. The Government during this bridge will work to adequately document requirements to support a competition that supports this application’s size and complexity. This bridge action will also provide necessary time to provide an adequate handoff between contractor’s to ensure the Government has the necessary support to transition from the bridge to the awardee of the competed action.

This bridge contract will work to avoid a significant degradation in services or mission failures in a follow-on competed action. Without ENBOSS, the states will have to review multiple UFCs and Army Regulations to determine project estimates. States do not have a dedicated staff to devote to thousands of hours reviewing hundreds of UFCs and Regulations. ENBOSS programmers are subject matter experts on MILCON regulatory requirements and intertwined within the construction community to know when updates are required. These changes affect the cost of the facility. It can take up to five years to program the funding, submit plans, and construct a facility. During this time UFCs, Regulations, and Policies change. If the state is not able to adjust the cost of the facility based on requirements the state is in jeopardy of busting their construction bid or creating an Anti-Deficiency Act (ADA) violation.

ENBOSS is the ARNG feeder system into the HQDA, Programming, and Administration & Execution (PAX). PAX is the DD1390/91 generating system used to submit project requirements for the President’s Budget (PRESBUD). PAX is a repository for military construction projects. The PAX application does not have the capability to tailor the project requirements; PAX is a simple database, unlike ENBOSS. ENBOSS can create accurate project estimates based on the command's requirements based on forces structure or regulatory changes. The Government during this bridge will work to ensure the follow-on acquisition contains required information to ensure interested offerors have necessary system information to avoid delays information being provided to HQDA. This would result in increased workloads by the G9.

6. Actions to Increase Competition. ENBOSS is a software application that requires substantial knowledge and time for a company to understand the intricate coding.

During this bridge the Government will ensure that the follow-on acquisition has the necessary documentation to adequately compete the requirement. Furthermore, the ARNG G9 is developing an easier process to determine ARNG facility cost estimates by simplifying requirements with NG PAM 415-12 within the next 6 months. The revising of planning requirements IAW regulation NG PAM 415-12 will remove complex buildings

Based on the foregoing justification, I hereby approve the procurement of ENBOSS Support Services in the amount of using an exception to fair opportunity pursuant to the authority of 10 U.S.C. 2304c(b)(2) as implemented by FAR 16.505(b)(2)(i)(B) – Only one awardee is capable of providing the supplies or services, subject to availability of funds, and provided that the services herein described have otherwise been authorized for acquisition.
