About this file

This Invitation to Bid (ITB) is issued by the Oregon Department of Fish and Wildlife (ODFW) to procure alfalfa hay for the Elkhorn Wildlife Area, which serves to provide supplemental winter feed for elk in Baker and Union Counties. ODFW seeks to procure approximately 450 tons of current year, quality, weed-free alfalfa hay in 50-ton lot increments, with a preference for second crop alfalfa but acceptance of first and third crop alternatives. The alfalfa must be delivered in 3x4 bales weighing up to 1,500 pounds with no bales exceeding 8 feet 6 inches in length. Bids are due by August 31, 2026, at 2:00 PM Pacific Time, with the Intent to Award notification anticipated for September 7, 2026, and the protest period ending September 14, 2026. All hay must be available for pickup or delivery by September 30, 2026. ODFW will inspect hay following bid closing and award contracts based on quality specifications including moisture content below 16 percent, less than 5 percent grass content, and a minimum 40/60 leaf-to-stem ratio. Bidders must be located within 150 miles of the Elkhorn Wildlife Area; those within 30 miles of North Powder, Oregon, will have their hay picked up by ODFW with loading costs included in the bid, while those further away must provide delivery FOB North Powder with freight costs included in the per-ton price.

This procurement uses the Intermediate Bidding method and is funded entirely with federal funds, requiring compliance with federal contract provisions including those related to debarment, non-discrimination, and whistleblower protections. ODFW reserves the right to make multiple awards if needed and will rank hay based on specific quality criteria including absence of rain after cutting, weed-free status, and optimal leaf-to-stem ratios. Bidders must submit required forms including a Bid Cover Sheet, Bid Submittal Form, COBID Certification and Outreach Plan, and a Responsibility Inquiry. Oregon-based bidders receive a 10 percent preference on bid calculations. The bid firm offer period is 180 calendar days from opening. No subcontracting set-asides or incumbent information is specified. The contract is structured as a purchase order with a standard form provided in Attachment A, and successful bidders must comply with all federal requirements including those related to equal employment opportunity, environmental standards, and recovered materials procurement.

SECTION 1: GENERAL INFORMATION

1.1 SUMMARY OVERVIEW

The State of Oregon, acting by and through the Department of Fish and Wildlife, (“Agency” or “ODFW”), is issuing this Invitation to Bid (ITB) to establish one or more Contracts for 2026, quality, weed-free Alfalfa Hay. ODFW prefers Second Crop Alfalfa but will be accepting alternate pricing for First and Third Crop Alfalfa. Hay is for feeding winter Elk in Baker and Union Counties and will be distributed from ten feeding sites in both counties.

ORS 496.146(9) authorizes the State Fish and Wildlife Commission (“Commission”) to establish and develop wildlife management and refuge areas. ORS 496.146(11) authorizes the Commission to enter into contracts with any person or governmental agency for the development and encouragement of wildlife research and management programs and projects. Acting under the Commission’s direction and in accordance with OAR 635-300-0001 through 635-300-0015, ODFW develops and maintains the Elkhorn Wildlife Area Program.

The goals and objectives of the Elkhorn Wildlife Area Program are:

(1) To mitigate the loss of traditional big game winter range areas along the north, west and south portions of the Powder River Valley through habitat management and supplemental feeding program.

(2) To provide supplemental and subsistence feed for wintering elk and deer to alleviate damage to private lands.

(3) To provide habitat for big game animals and the other wildlife indigenous to the area.

(4) To provide hunting and other wildlife-oriented recreation opportunities for the general public.

To meet the requirements of the Elkhorn Wildlife Area Program described above, the Agency needs to procure large amounts of feed.

This purchase is funded with 100% Federal funds. Contract(s) resulting from this ITB incorporate the terms and conditions set forth in the ITB, including without limitation the federal contract provisions for non-federal entity contracts under federal awards set forth in Attachment A.

Due to the large quantity of Alfalfa Hay being purchased, ODFW reserves the right to make multiple awards. Alfalfa Hay shall be available for pick up or be delivered on or before September 30, 2026.

1.2 SCOPE OF WORK/STATEMENT OF WORK/SPECIFICATIONS

Alfalfa hay shall be the current year, quality, weed free (not certified), second crop or better cutting, in 3 x 4 bales, no bales measuring over 8’6” in length, and weighing up to 1,500 pounds. If supply is not available, ODFW is accepting alternate pricing on first and third cutting alfalfa. Alfalfa must be in stacks at Bidder’s site. ODFW is requesting bids on an expected total of 450 tons.

Bids will be accepted for alfalfa in fifty (50) ton lots. Single or multiple lots may be bid and purchased from a single successful Bidder.

DAS Procurement Services, Version 1.0 – February 20, 2019 Page 4 of 28

After the Bid Closing Date, Bidders will be contacted, and hay being offered will be inspected by ODFW staff. Bid(s) will be awarded after hay is inspected. Alfalfa will be ranked based on the following criteria:

• No rain after cutting.

• Bale moisture content less than 16%, measured in the stack.

• Weed free (not certified).

• Less than 5% grass. Hay with more than 5% grass will be rejected.

• Minimum 40/60 leaf to stem ratio; prefer 60/40 leaf to stem ratio.

• No bales measuring over 8’ 6” in length.

ODFW may consider 3x4, first and third cutting alfalfa if needed.

Bids will only be accepted from bidders growing the hay within 150 miles of the Elkhorn Wildlife Area.

Bids received with pick up locations within thirty (30) miles of North Powder, Oregon, will be picked up by ODFW, with Bidder loading alfalfa onto ODFW trailer. Bid price will include bale loading.

All bids received from locations further than thirty (30) miles from North Powder, Oregon, shall include delivery FOB North Powder, Oregon. FOB Bids shall include any “Freight Added” charges in the per ton bid price. Deliveries shall be coordinated with staff at the Elkhorn Wildlife Area and be delivered to:

A. Simplified Acquisition Threshold. Contracts for more than the simplified acquisition threshold currently set at $150,000, which is the inflation adjusted amount determined by the Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) as authorized by 41 U.S.C. 1908, must address administrative, contractual, or legal remedies in instances where contractors violate or breach contract terms, and provide for such sanctions and penalties as appropriate.

B. Termination for Cause and Convenience. All contracts in excess of $10,000 must address termination for cause and for convenience by the non-Federal entity including the manner by which it will be effected and the basis for settlement.

C. Equal Employment Opportunity. Except as otherwise provided under 41 CFR Part 60, all contracts that meet the definition of “federally assisted construction contract” in 41 CFR Part 60-1.3 must include the equal opportunity clause provided under 41 CFR 60-1.4(b), in accordance with Executive Order 11246, “Equal Employment Opportunity” (30 FR 12319, 12935, 3 CFR Part, 1964-1965 Comp., p. 339), as amended by Executive Order 11375, “Amending Executive Order 11246 Relating to Equal Employment Opportunity,” and implementing regulations at 41 CFR part 60, “Office of Federal Contract Compliance Programs, Equal Employment Opportunity, Department of Labor.”

D. Davis-Bacon Act, as amended (40 U.S.C. 3141-3148). When required by Federal program legislation, all prime construction contracts in excess of $2,000 awarded by non-Federal entities must include a provision for compliance with the Davis-Bacon Act (40 U.S.C. 3141- 3144, and 3146-3148) as supplemented by Department of Labor regulations (29 CFR Part 5, “Labor Standards Provisions Applicable to Contracts Covering Federally Financed and Assisted Construction”). In accordance with the statute, contractors must be required to pay wages to laborers and mechanics at a rate not less than the prevailing wages specified in a wage determination made by the Secretary of Labor. In addition, contractors must be required to pay wages not less than once a week. The non-Federal entity must place a copy of the current prevailing wage determination issued by the Department of Labor in each solicitation. The decision to award a contract or subcontract must be conditioned upon the acceptance of the http://www.ecfr.gov/cgi-bin/text-idx?SID=66f1eac60ecb3f2fcd992313ae9775dc&node=pt2.1.200&rgn=div5

The Act provides that each contractor or subrecipient must be prohibited from inducing, by any means, any person employed in the construction, completion, or repair of public work, to give up any part of the compensation to which he or she is otherwise entitled. The non-Federal entity must report all suspected or reported violations to the Federal awarding agency.

E. Contract Work Hours and Safety Standards Act (40 U.S.C. 327-333). Contractor must include a provision for compliance with 40 U.S.C. 3702 and 3704 for contracts in excess of $100,000 that involve the employment of mechanics or laborers, as supplemented by Department of Labor regulations (29 CFR Part 5). Under 40 U.S.C. 3702 of the Act, each contractor must be required to compute the wages of every mechanic and laborer on the basis of a standard work week of 40 hours. Work in excess of the standard work week is permissible provided that the worker is compensated at a rate of not less than one and a half times the basic rate of pay for all hours worked in excess of 40 hours in the work week. The requirements of 40 U.S.C. 3704 are applicable to construction work and provide that no laborer or mechanic must be required to work in surroundings or under working conditions which are unsanitary, hazardous or dangerous. These requirements do not apply to the purchases of supplies or materials or articles ordinarily available on the open market, or contracts for transportation or transmission of intelligence.

F. Rights to Inventions Made Under a Contract or Agreement. If the Federal award meets the definition of “funding agreement” under 37 CFR §401.2 (a) and the recipient or subrecipient wishes to enter into a contract with a small business firm or nonprofit organization regarding the substitution of parties, assignment or performance of experimental, developmental, or research work under that “funding agreement,” the recipient or subrecipient must comply with the requirements of 37 CFR Part 401, “Rights to Inventions Made by Nonprofit Organizations and Small Business Firms Under Government Grants, Contracts and Cooperative Agreements,” and any implementing regulations issued by the awarding agency.
