About this file

This Justification and Approval (J&A) document supports a sole-source contract for 6 repairs of Electron Tube, Twystron for the Air Force's Control Reporting Center (CRC) Weapon System. The contract will be awarded to Microwave Power Products (CAGE Code 99313) in Palo Alto, CA, under 10 U.S.C. 2304(c)(1) authority, with an estimated award date of 30 September 2025 and performance through 31 October 2026. The Air Force determined Microwave Power Products is the only vendor capable of performing these repairs due to exclusive ownership of critical technical data and proprietary design information.

The proposed one-year, firm-fixed-price contract includes four Contract Line Item Numbers (CLINs): Test, Evaluation & Engineering (TT&E), Minor Repair, Major Repair, and Data, each with 6 units. Market research, including a Sources Sought Synopsis posted on SAM.gov from 12 May to 12 June 2025, yielded zero responses. The government estimates the contract's total cost is confidential, with reverse engineering the Electron Tube estimated as cost-prohibitive. The 415th Space Communications Squadron (415 SCMS) will continue attempting to purchase data rights from Microwave Power Products to enable future competition.

A. This is a new repair contract for 6 ea repairs of Electron Tube, Twystron, on the CRC Weapon System as listed below. These 6 ea repairs of Electron Tube, Twystron, are vital to the capabilities of the CRC system due to

B. The estimated unit repair cost, quantity and extended cost are shown below:

CLIN Noun NSN Qty Unit of Issue Unit Cost Total Cost

0001 TT&E 5960000780684ZR 6 EA $ $

0002 Minor Repair 5960000780684ZR 6 EA 0003 Major Repair 5960000780684ZR 6 EA $ $ 0004 Data NSP

August 2023 CONTROLLED UNCLASSIFIED INFORMATION Page 3 of 5 following administrative CDRLs will be delivered as part of this effort in accordance with the PWS and CDRL list:

CAVAF, RIIR, Test Procedures, CPP, and Test Report. These administrative CDRLs do not include/provide additional IP rights to the Government for this requirement. This effort will include the following technical CDRLs (which do not grant any additional IP rights to the Government): ECP.

IV. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires use of the authority cited above.

A. The Government is unable to seek competition from other sources due to the Electron Tube, Twystron, containing owned by MICROWAVE POWER PRODUCTS. The

Therefore, this acquisition will be a follow-on contract for the continued provision of highly specialized services.

B. The Electron Tube, Twystron, repair services covered under this J&A are not available from any source other than MICROWAVE POWER PRODUCTS. MICROWAVE POWER PRODUCTS is the only vendor who has demonstrated the unique knowledge, and possesses the technical data required to fulfill this requirement.

MICROWAVE POWER PRODUCTS is currently performing this requirement under contract FA8250-19-D-0001, awarded sole source on 30 Sep 2019 with a completion date of 29 Sep 2024. The USAF does not possess or have the rights to the necessary data to support this requirement or to develop alternate sources to sustain the Electron Tube CRC. 415 SCMS made an attempt to purchase the data via email from MICROWAVE POWER PRODUCTS on 12 May 2025. The VP of Sales responded on 12 May 2025 that MICROWAVE POWER PRODUCTS was unwilling to sell the data.

C. 415 SCMS has determined that award to any other source would result in substantial duplication of cost that could not be recovered through competition and unacceptable delays in fulfilling its requirements. The Government estimates the cost to reverse engineer the Electron Tube, Twystron, to be $ The projected cost savings of any reverse engineering efforts would equate to a negative return on investment of $ The Government engineers estimate a minimum of - to reverse engineer a fully manufactured, tested, and functional Electron Tube, Twystron. Reverse engineering of this highly specialized requirement by any other source would be cost prohibitive and produce a negative return on investment to the Government and add unacceptable delays in fulfilling its requirements.

D. Accordingly MICROWAVE POWER PRODUCTS is the only firm capable of providing the services described in Section III above without the Government experiencing substantial duplication of cost that could not be recovered through competition and unacceptable delays in fulfilling its requirements.

V. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under

FAR 5.202 applies.

A. Sources Sought Synopsis: The Sources Sought Synopsis was posted under FA825025SSS0684 on 12 May 2025 at www.Sam.gov and closed on 12 Jun 2025. There were zero response(s) received to the Sources Sought.

B. Zero offerors expressed interest in the Sources Sought Synopsis

C. Synopsis: This requirement will be synopsized at www.Sam.gov as a notice of contract action IAW FAR 5.201

D. Other Actions: None

E. Qualifying Country Sources: None

VI. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Based upon (1) other than certified cost or pricing data provided in the offeror's proposal, (2) the program office's technical analysis of the offeror's Basis of Estimates (BoE), (3) independent government cost estimate (IGCE), and historical repair pricing, the contracting officer expects they will be able to determine that the anticipated cost to the Government will be fair and reasonable.

VII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

A. As described in Section V above, Market Research (MR), in accordance with FAR Part 10, has been conducted by posting a Sources Sought Synopsis advising industry of the pending acquisition and soliciting inquiries from interested parties.

B. In addition to ongoing market surveillance, the 415 SCMS team conducted the following Market Research activities: Searched various Government databases (SAM.gov, Haystack, and CIDS); SMEs from 415 SCMS were contacted for information on this requirement. The results of these searches did not yield any additional qualified sources.

C. Market research concluded that there are no alternate/additional sources capable of meeting the Government's requirement at this time and MICROWAVE POWER PRODUCTS (CAGE Code: 99313) is the only known company capable of satisfying the Government requirements.

D. The Electron Tube, Twystron, repair on the CRC weapon system does not have any commercial off-the-shelf sources. No commercial or non-developmental items are available that can be used to satisfy the agency's need.

E. This requirement is not a candidate for organic completion due to the Air Force not owning the data/drawings to perform the requirement.

VIII. Any other facts supporting the use of Other Than Full and Open Competition.

No further information

IX. List of any sources that expressed, in writing, an interest in the acquisition.

See Section V above

X. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services required.

At present, MICROWAVE POWER PRODUCTS is the only source that owns the data required for this effort. The required data is not available from any other source. 415 SCMS will continue to pursue purchasing the data rights from MICROWAVE POWER PRODUCTS to try to enable competition. Further, the Government will post a Source Sought Synopsis (SSS) as future requirements arise to see if any other contractors are interested in becoming qualified for this requirement.

Per PGI 206.304(a)(S-70) and as indicated by signature on the Coordination and Approval Document, the previous J&A has been reviewed and the Approval Authority determines that all stated actions to remove barriers to competition have been accomplished.
