(U) The following justification and approval for the use of sources limited to fewer than those required in FAR 8.405-1 is prepared in accordance with Federal Acquisition Regulation (FAR)

8.405-6(a). This acquisition is conducted under the authority of the Multiple-Award Schedule

Program (41 U.S.C. 251, et seq, and 40 U.S.C. 501).

1. Identification of the agency and the contracting activity.

(U) The U.S. Department of Justice, Federal Bureau of Investigation, (FBI) Professional

Services Acquisition Unit (PSAU) has prepared this limited source justification for highly skilled Subject Matter Experts (SME) to support the FBI, Critical Incident Response Group

(CIRG).

2. Nature and/or description of the action being approved.

(U) CIRG has a continued requirement for SME services. These services are currently being provided by one contractor on task order 15F06718F0004312 with Eagle Security

Group, Inc., (Eagle) under a General Services Administration (GSA), Federal Supply

Schedule (FSS) contract 47QSWA18D001C. The period of performance of the task order ends on April 27, 2020 after a base year and an exercised sole option year. Other option years are not available per a usual base plus four option years. This task order can be extended via current contract clause 52.217-8 Option to Extend Services. It cannot reasonably be competed by the time the current Period of Performance concludes. The FBI intends to compete this requirement in the near future for hopeful award after the six month base period. The period of performance for this contract extension award is for a six-month base period from April 28, 2020 to October 27, 2020.

Version 1.0 Page 2 of 3

(U) The FBI issued an unclassified RFQ to Eagle and the responsive Quote was evaluated.

The FBI is issuing a contract extension to Eagle to continue the services while the FBI plans, solicits, evaluates and successfully awards a new 12-month base period with four one-year option periods.

3. A complete description of the supplies and/or services required to meet the agency’s needs.

(U) This is a contract to provide expert mission support consulting, operational level training, and facilitation services to the FBI, CIRG with the overarching objective being to support the Bureau’s ongoing CIRG mission and augment existing skill levels. The contractor shall provide the FBI with professional services support at the FBI’s Gateway

Building, Triangle, Virginia and other locations such as FBI Headquarters, or as deemed appropriate. The objective of the contract is to provide professional support to the CIEDS

Front Office and in-turn, the JPO C-IED as part of its overall domestic architecture responsibilities. The CIEDS/JPO C-IEDS contractor personnel should demonstrate experience in law enforcement or military operations, information sharing, technology systems, command, legal requirements, report and policy document writing. The ability and experience in performing in a government focused, collaborative, interagency environment, is the objective.

(U) If CIRG does not extend contractor support services between the expiration of the existing Eagle contract and award of a new contract, CIRG will be at risk inherently putting

CIRG mission, personnel, and national security at risk.

(U) Estimated cost: $1,441,520.96 for a six-month base period from April 28, 2020 to

October 27, 2020.

4. The authority and supporting rationale (see 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

FAR 8.405-6 (a)(1)(i)(A) – An urgent and compelling need exists, and following the procedures would result in unacceptable delays.

(U) The FBI is limiting competition to one contractor, Eagle, as an urgent and compelling need due to lack of another contractual vehicle in place to ensure there is no break in service for the CIRG SME support services. The FBI cannot afford to have a break in service of contractor personnel providing support. In addition, the break in service would directly impact CIRG’s mission.

(U) The purpose of this contract extension is to bridge between the existing task order contract, and then compete the requirement for award after the six-month base period. The

FBI does not intend to use this bridge extension contract for any other purpose other than to ensure there is no break in service while the FBI ascertains a proper method for competing https://www.acquisition.gov/far/current/html/Subpart%208_4.html#wp1091891

Version 1.0 Page 3 of 3 the requirement. The administrative burden, time, and resources used to put in place a new bridge contract with a different contractor is not the most cost effective or efficient option for the FBI. Eagle is the incumbent providing these support services, in which case, already has established contractor personnel providing these services and does not require the significant time or resources necessary to transition in new contractors through the Visit Action

Requests (VAR), access to FBI computers and systems, and pending projects when time-sensitive tasks need to be completed. The current contract has the Option to Extend Services clause for use in a situation of this nature.

(U) While other vendors are capable of meeting the FBI’s requirements in general, no other vendor is capable of performing without interruption and/or delay. This contract extension is only for the immediate need of the FBI until a competed award can be successfully made.

5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).

(U) The contracting officer has determined, after considering the level of effort and the mix of skills available for the tasks needed, that the proposed order represents a reasonable total price and will be the best value for the FBI.

6. A description of the market research conducted among schedule holders, and the results of the research. A statement must be made that the supplies and services are available from the FSS.

(U) The FBI is aware of multiple companies that can provide the services as demonstrated by the last RFQ released; however, due to significant time constraints, lack of personnel during relocation transition, and current fiscal year constraints, utilizing the incumbent is the only logical alternative for immediate performance with an anticipated duration of several months.

7. Any other facts supporting the limited source justification.

(U) The previous Contracting Officer incorporated the clause to extend services. Use of it is appropriate.

8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.

(U) The FBI has already competed this requirement among GSA Schedule holders. GSA

Schedule prime contract holders that could perform this future requirement. This contract extension will be used to either transition work from Eagle to the new awardee or continue services with Eagle depending on the follow-on contract award evaluations.
