Statement of Work for Snow Plowing and Removal

1. Introduction The contractor shall furnish all supervision, labor, materials, supplies, transportation, and equipment to provide efficient snow plowing and sanding services at the National Weather Service (NWS), Radar site located at 185 Barton Road, Hodgdon, ME.

The contractor and employees shall meet all State required licensing and insurance for equipment being used. Also, the contractor shall perform the required service complying with the Occupational Safety and Health Act (OSHA), Federal Clean Air Act, and all Federal, State and Local Codes. The C&A requirements of clause 73 do not apply and a Security Accreditation Package is not required. The service dates to be covered by the contract will be a 7-month period from October 1 through April 30 of each season.

It is the responsibility of the contractor to comply with all applicable State and Federal laws governing the health and safety of its employees, including all regulations promulgated under the OSHA. Such compliance shall include, but not be limited to, ensuring that all employees are properly trained for the work to be performed and have been supplied with all necessary protective and safety equipment.

The contractor should be aware and bid accordingly to the average amount of snow fall for the area.

2. Work to be Performed Equipment, materials, and furnished personnel shall be consistent with the best industry standards for snow plowing and removal services. Snow plowing services will be considered “automatic” and “on-call”. The intent of this requirement is to remove all snow from roadways and parking areas. This includes approximately 2200 square ft. The road shall be monitored and kept clear of subsequent drifting so continuous access to the site is possible with regular passenger vehicles. The contractor may have to perform snow removal more than once during a snowfall period to keep up with the accumulation of snowfall. Salting and Sanding service to be provided on request by the NWS. The contractor will decide how to use his/her resources to meet the specified outcome.

The contractor shall perform snow removal when a new snow accumulation of four (4) or more inches occurs, or upon request by the NWS. The contractor shall report within two clock hours when two inches of snow has accumulated. If the snow falls during the late night hours, the contractor shall report by 5:00 AM. When requested, the snow removal shall be performed within two (2) hours of the request, or at a time agreed to by the NWS.

The contractor will monitor the snowfall amounts in the area and provide snow removal service whenever accumulation has exceeded the four (4) inch depth criteria. The road into the Radar should be plowed to the edge of the road surface (edges will be marked by contractor).

The Radar system is utilized for Public Safety; loss of system availability may impact weather warning capabilities. If the Radar becomes unavailable during critical weather events, it is our intention to restore system availability as soon as possible. This type of situation would be considered an emergency. If an emergency situation occurs and snow removal is needed to reach the site, the NWS will inform the contractor and the contractor will need to elevate the priority of the NWS snow removal request.

This requirement shall include:

The contractor will perform the following snow plowing activities whenever the above conditions have been met:

· Mark the road edges as needed on or after October 1 of each year. This should be done only once per winter and only if the old markers have been damaged or removed.

· Remove snow on the RADAR Access road between the access road gate and the Radar Site.

· Remove snow in the area in front of the Radar Site vehicles can park with enough additional room for a full sized truck to turn around.

· Remove snow from in front of the Radar Site fence gate to allow the gate to open all the way.

· Salt or similar melting agent may be applied to all plowed areas when requested by the NWS.

· Any damage resulting from the contractor’s actions to NWS or other property while conducting snow removal operations on behalf of the NWS will be reported to the NWS within 24 hrs.

6. Performance Period Service Dates

Base Period: October 1, 2015 through April 30, 2016 Option Period One: October 1, 2016 through April 30, 2017 Option Period Two: October 1, 2017 through April 30, 2018 Option Period Three: October 1, 2018 through April 30, 2019 Option Period Four: October 1, 2019 through April 30, 2020

7. Priority List The contractor shall meet with the NWS designee to establish the priorities for starting snow plowing services at the start of each season. Regular meetings may also be necessary during the snow season to review the contractor’s performance or make necessary adjustments in the priorities for snow plowing and removal services. The priority of snow plowing can and may be dictated by the NWS designee.

8. Equipment Operation and Responsibility

The contractor shall be responsible for the safe, careful and efficient operation of equipment and all equipment shall be maintained in good operating condition. The breakdown of equipment shall not relieve the contractor of the responsibility of providing snow removal services. All equipment and personnel operating under the terms of this contract shall be in full conformance with Federal and State regulations. The Government is not providing or responsible for any equipment or materials.

9. Responsibility for loss, damage, death, or injury

Except as otherwise provided by law, the Government will not be responsible for the loss of, or damage to the contractor’s equipment, or death of or injury to the contractor’s personnel, or for the death of, or injury to persons or for damages to property resulting from contractor’s negligent performance under this contract. The contractor shall be responsible for all damages to persons or property that occurs as a result of his fault or negligence, or the fault or negligence of his employees or agents, while performing the requirements of this contract.

10. Conformity

If any of the services do not conform to the contract requirements, the Government may require the contractor to perform the services again in conformity with the contract requirements, at no increase in contract amount. If the defects in services are not corrected by performance, the Government may (1) require the contractor to take necessary action to ensure that future performance conforms to contract requirements and (2) reduce the contract price to reflect the reduced value of the services performed.

If the contractor fails to expeditiously take the necessary action to ensure that further performance will be in conformity with contract requirements, the Government may terminate the contract for default.

11. Billing

The contractor will bill on a monthly basis in arrears for the service provided. The contractor will be paid for actual services performed. If no snowfall occurs during the period of performance the Government will not incur any fees.

Invoices from the contractor will be submitted to the NWS on a monthly basis, and will be addressed to the NWS at the address below.

12. Supervisor One supervisor must be provided by the contractor to accomplish snow removal in accordance with best practices of the industry and shall provide proper supervision of all jobs. Directions of snow removal will be coordinated with the NWS designee as needed, however, detailed instructions for carrying out such directions will be the responsibility of the supervisor. In all respects, the contractor is responsible for the work being performed.

The supervisor shall be required to provide and wear a working cell phone and respond to calls from the government representative within ten minutes during the performance of duty. Numbers shall be furnished to the appropriate field office prior to any work being performed under this contract. The supervisor must be able to speak, read and write in English.

13. Contact List

The contractor must submit the names, telephone numbers and cell phone numbers to be used as a 24 hours, seven day a week contact point. Likewise, the contractor may contact the NWS designee to plan the snow removal.

14. Service Delivery Summary

The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.
