About this file

This document is a Sole Source Justification (SSJ) for a contract between the Naval Sea Systems Command and Leonardo Diagnostic/Retrieval Systems (DRS). The contract is for evaluating software and hardware of Printed Wire Assemblies (PWAs) for Advanced Secondary Propulsion Unit (ASPU) Motor Controllers, which were originally designed and built by DRS. This is the third of four contract phases, with a one-year performance period beginning 30 days after award, using Research, Development, Test & Evaluation (RDT&E) funds.

The justification emphasizes DRS as the sole source due to their proprietary designs and patents for submarine motor drive components. A Notice of Intent was posted on SAM.gov from 3-8 April 2024, though no competitive responses are anticipated. The government determined DRS is the only viable contractor because their Motor Controller components are highly specialized, specifically designed for the USS Jimmy Carter, and cannot be replicated by other manufacturers. Previous market research and similar historic contracts have confirmed DRS's unique capability to perform these specialized services.

SSJ No.: 25-30JA

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR

CERTAIN COMMERCIAL ITEMS IN ACCORDANCE WITH FEDERAL

ACQUISITION REGULATION (FAR) 13.5

On the basis of the following justification, I hereby approve the use of a sole source proposed contractual action pursuant to the authority of: 10 U.S.C. 3204(a)(1)

Procurement Request Number: N4523A25RC05P81

1. Agency and Contracting Activity

Naval Sea Systems Command contracting activity Northwest Regional Maintenance Center/Puget Sound Naval Shipyard and Intermediate Maintenance Facility (PSNS & IMF) proposes to enter into a sole source contract with Leonardo Diagnostic/Retrieval Systems (DRS) using simplified procedures for certain commercial items included in FAR subpart 13.5.

2. The nature and/or description of the action being approved.

The contemplated action for approval is the award of a sole source contract with DRS to evaluate software and hardware of Printed Wire Assemblies (PWSs) owned and stored by PSNS & IMF.

The PWAs are components of Advanced Secondary Propulsion Unit (ASPU) Motor Controllers, which were designed, patented, and built by DRS.

3. A description of the supplies and/or services required, including the delivery schedule and/or the period of performance (inclusive of all option periods), and the estimated dollar value of the acquisition.

This effort represents the third of four phases. The Contractor shall provide all management, labor, equipment, and tools necessary to evaluate the software and hardware of the existing legacy PWAs. The Contractor shall receive legacy PWAs from the Government for testing and analysis. The Contractor shall visually inspect the legacy PWAs received and associated components. The Contractor shall use the test fixture from the Phase 1 contract (N4523A-24-P- 0803) to conduct testing and analysis of the received legacy PWAs. After completion of testing and analysis, the Contractor shall advise if the received legacy PWAs can be repaired and if so the cost of repair. The Contractor will retain all received legacy PWAs for repair and/or disposition during Phase 4.

The Period of Performance (POP) for this action is anticipated to begin 30 calendar days after award end one calendar year after award.

The total estimated dollar value of this acquisition is This acquisition will not include options. RDT&E funds will be utilized.

4. The statutory authority permitting sole source.

10 U.S.C.3204(a) (1): The property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency

5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring use of the authority.

The Original Equipment Manufacturer (OEM) is DRS. DRS designed, patented, and built Motor

Controllers are variable frequency motor drives that support propulsion units on board US Navy submarines. The ASPU Motor Controller components are highly complex in design and are an integral part of an approved system configuration that was specifically designed and built by DRS for the USS Jimmy Carter (SSN 23). The components to be analyzed and repaired for the ASPU Motor Controllers are proprietary designs and are direct replacements for components presently installed. Other manufacturers cannot produce similar products or perform similar services because the OEM interface designs are patented and protected from all third parties by DRS, and the services are performed utilizing proprietary drawings. No alternative products or systems exist to perform the function of the ASPU system. Upon completion of the analysis and refurbishment, the ASPU Motor Controller components, to include the PWAs, must meet and ensure no deviation from form, fit, function or design, to ensure it interfaces satisfactorily with other system components. This can be met only if components manufactured by DRS are used. Based on this rationale, proceeding with procurement of this requirement on a sole source basis to DRS is in the best interest of the Government.

6. A description of efforts made to ensure offers/quotes are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized in SAM.gov (as required by FAR 5.2) and, if not, which exception under 5.202 applies.

A Notice of Intent was posted to the Government-wide Point of Entry (GPE), SAM.gov, on 3 April 2024. The posting will close on 8 April 2024. It is not anticipated that any responses will be received due to the fact that DRS is the OEM, their designs are patented and protected from all third parties, and the services are performed utilizing proprietary drawings. In addition, for similar historic contracts, notices were posted to SAM.gov and no other companies responded.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the contracting officer that the anticipated cost to the government will be fair and reasonable.

The Contracting Officer has determined that the anticipated cost to the Government for the services covered by this J&A will fair and reasonable.

8. A description of the market research conducted and the results or the reason market research was not conducted.

The Requirement Generator vetted sources via Google and Ability One SBA Dynamic SB.

None were capable of providing the requested services. Previous market research determined that DRS is the only source available to complete the requirements of this contract. Similar historic contracts (N4523A22D5700 and N4523A24P0803) were awarded to DRS through sole source justifications. No other source has shown interest or capabilities in performing this requirement.

9. Any other facts supporting the use of sole source.

Based upon the technical certification on file, technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

None

11. A statement of any actions the agency will take to remove or overcome any future barriers to competition.

For the reasons set forth in paragraph 5, PSNS & IMF has no plans at this time to compete future contracts for the type of services covered by this document. If another potential source emerges, PSNS & IMF will assess whether competition for future requirements is feasible.
