About this file

This is a Sole Source Justification Memorandum for the renewal of TACDS® V3.0 Filter Bundle licenses and maintenance services. The Naval Surface Warfare Center Panama City Division (NSWC-PCD), located at 110 Vernon Ave., Panama City, FL 32407, seeks to award a firm fixed price contract to General Dynamics Mission Systems (GDMS), 8201 E. McDowell Rd., Scottsdale, AZ. The acquisition covers 47 units of TACDS® V3.0 Filter Bundle 3-Year Renewal, which extends the Filter Bundle License and Maintenance Services in three-year increments on a per-unit basis and is required for Raise the Bar Compliance.

GDMS is identified as the sole responsible source under 10 U.S.C. 2304(c) and FAR 12.102(a) because GDMS is the sole developer and original equipment manufacturer of the Cross Domain Solution (CDS) devices, which have been approved for integration into the MVCS 1.2.1 and MVCS 1.3 tactical baseline systems to support LCS Mission Package Initial Operational Capability. Replacing these units with alternative products would invalidate completed testing and delay accreditation of the CDS and LCS Mission Package delivery. No market research was conducted among schedule holders due to the unique and non-substitutable nature of the requirement. The Contracting Officer determined that the sole source award represents the best value and lowest overall cost alternative to meet the Government's needs. The acquisition will be conducted using simplified acquisition procedures, and the requirement will be synopsized at sam.gov.

Subj: SOLE SOURCE JUSTIFICATION MEMORANDUM FOR TACDS RENEWAL

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Sole Source Justification.”

This is a sole source justification. Contracting activity is NSWC-PCD, 110 Vernon Ave., Panama City, FL, 32407.

2. Nature and/or description of the action being approved.

This action will award a firm fixed price contract to General Dynamics Mission Systems (GDMS), 8201 E. McDowell Rd., Scottsdale, AZ for the items listed in paragraph 3. of this document.

3. A description of the supplies or services required to meet the agency’s needs.

Line Product # Description Qty.

1 FILTERS-RENEWAL-3YR TACDS® V3.0 Filter Bundle 3 Year Renewal

Extends the Filter Bundle License and the Maintenance Services on the TACDS® V3.0 assessed Filter Bundle License in 3 year increments. Renewal is managed per TACDS® V3.0 unit. Required for Raise the Bar Compliance.

This acquisition will be conducted using simplified acquisition procedures. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 12.102(a).

The Naval Surface Warfare Center Panama City Division (NSWC PCD) currently has a requirement for the item(s) listed in Paragraph 3 of this document. The GDMS Cross Domain Solution (CDS) devices listed in Paragraph 3 of this document have been approved for the MVCS 1.2.1 and MVCS 1.3 tactical baseline systems. The units have been successfully configured to be integrated and implemented in the MVCS 1.2.1 and MVCS 1.3 baselines to meet the LCS Mission Package (MP) Initial Operational Capability (IOC). Replacing these units with another product or manufacturer would invalidate our completed tests and potentially cause delays to the accreditation of the CDS, testing and LCS MP IOC delivery.

GDMS is the sole developer and original equipment manufacturer (OEM) for these items and as such they are the only source with sufficient knowledge of the cross domain design and functionality to perform the requirement. Also, the GDMS Cross Domain Solution (CDS) devices are the only approved device for this system

As such, the government does not expect significant savings through competition and it is more advantageous to the Government to award on a sole source basis to the GDMS for the item(s) listed in Paragraph 3 of this document.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 12.102(a).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, GSMS is the only source that can meet the Government’s needs. This requirement will be synopsized in the government point of entry sam.gov.

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, GDMS is the only source that can meet this requirement.
