About this file
This is a Sole Source Justification Memorandum for a firm fixed price contract award to DeVal Lifecycle Support by the Naval Surface Warfare Center Panama City Division (NSWC-PCD), Code 024, located at 110 Vernon Avenue, Panama City, Florida 32407.
The acquisition involves 28 units of item number 1567575, AERO-64 Soft Belt Adapters, with a total estimated value exceeding $25,000. The requirement will be conducted using simplified acquisition procedures and will be synopsized on sam.gov due to the threshold. DeVal Lifecycle Support is the original equipment manufacturer (OEM) of these adapters, which are the only adapters certified and approved for use with the specified support equipment. The justification for sole source award is based on the unique certification requirements; alternative belts would require time-consuming and costly certification and approval processes that would delay the project. Additionally, these items are only available directly from DeVal Lifecycle Support as they do not utilize distribution channels. The Contracting Officer has determined that sole source award represents the best value to the Government, prioritizing mission readiness of Special Operating Forces and avoiding extended equipment downtime costs and operational impacts. No market research was conducted among schedule holders, as DeVal Lifecycle Support is the only source capable of meeting the Government's needs.

MEMORANDUM
Subj: SOLE SOURCE JUSTIFICATION MEMORANDUM FOR AERO-64 SOFT BELT
ADAPTERS
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Sole Source Justification.”
This is a sole source justification. Contracting activity is NSWC-PCD, Code 024, 110 Vernon Ave., Panama City, FL, 32407.
2. Nature and/or description of the action being approved.
This action will award a firm fixed price contract to DeVal lifecycle support for the items listed in Paragraph 3 of this document..
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
Qty.: 28 Item: 1567575 Desc.: AERO-64 Soft Belt Adapter
This acquisition will be conducted using simplified acquisition procedures with a total estimated value greater than $25,000. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
Restricting Competition for Commercial Acquisitions Below the Simplified Acquisition Threshold FAR 12.102(a).
The Naval Surface Warfare Center Panama City Division (NSWC PCD) currently has a requirement for the item(s) listed in Paragraph 3 of this document. DeVal Lifecycle Support is the OEM of the items listed in Paragraph 3 of this document. These items are the only adapters certified and approved for use with the support equipment. If another belt were to be selected, it would have to go through certification and approval, resulting in significant project delay and unplanned costs. These items are only available direct from DeVal Lifecycle Support as they do not sell through distribution.
As such, the government does not expect significant savings through competition and it is more advantageous to the Government to award on a sole source basis to the DeVal Lifecycle Support for the item(s) listed in Paragraph 3 of this document.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 12.102(a).
The Contracting Officer has determined that this order represents the best value to the Government.
This determination is based on the unique and time-sensitive mission requirements of Special Operating Forces. Awarding this as a sole-source order is the most advantageous approach. The best value is achieved by ensuring mission readiness and avoiding the costs and operational impacts of extended equipment downtime.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, DeVal Lifecycle Support is the only source that can meet the Government’s needs. This requirement will be synopsized in the government point of entry sam.gov because it is estimated greater than $25,000.00.
7. Any other facts supporting the justification.
None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, DeVal Lifecycle Support is the only source that can meet this requirement
